A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
ROSEMEAD DENYING DESIGN REVIEW 89-46 FOR THE
CONSTRUCTION OF A 13-UNIT APARTMENT BUILDING IN
THE P-OD ZONE FOR PROPERTY LOCATED AT 9214-18
MARSHALL STREET, ROSEMEAD.
THE CITY COUNCIL OF THE CITY OF ROSEMEAD DOES HEREBY RESOLVE AS

Council finds:
Section 1. The City Council finds, determines and declares as
An application authorizing the proposed apartment project in the
P-OD zone at 9214-18 Marshall Street was filed by Harold Konop
representing Mission Development Co.; and
The Planning Commission conducted a duly noticed public hearing
on said application on November 20, 1989; and
The Planning Commission denied the application, by a majority
vote, by the adoption of its Resolution No. 89-85; and
Harold Konop filed a timely appeal to the decision of the
Planning Commission; and
The City Council conducted a duly noticed public hearing on said
application on January 9, 1990.
Section 2. Concerning the merits of the application, the City
1. The plans do not indicate proper consideration for the
relationship between the proposed apartment building and existing
residential homes that exist or have been approved for the
general neighborhood;
2. The proposed apartment building in its exterior design and
appearance is so at variance with the appearance of other
existing buildings or site developments in the neighborhood in
relationship to its size and bulk as to cause the nature of the
local environment to materially depreciate in appearance and
value;
3. Because the surrounding properties are predominantly detached
single family dwellings, the City Council determined that the
construction of a two-story 13-unit apartment building would
substantially detract from the existing character of the
neighborhood.
4. The City Council determined that a substantial increase in
traffic and congestion would occur with the construction of a
13-unit apartment building in relation to the traffic levels
generated on Marshall Street by the existing homes in the
immediate vicinity.
5. The proposed construction of the 13-unit apartment building would
substantially increase the number of school-age children
attending Savannah Elementary School which is currently impacted
with large classroom sizes.
6. Traffic and circulation impacts at the intersection of Rosemead
Boulevard and Marshall Street may deterioate further from a
current substandard level "D" L.O.S. with the construction of the
apartment complex.

Section 3. The City Council finds that based upon the
significant adverse effects" identified herein, the City Council denies Design
Review 89-46. The City Council further finds that any one of the adverse
conditions identified in Section 2 shall be sufficient grounds for denial of
Design Review Case No. 89-46.
Section 4. , The City Clerk shall certify to the adoption of this
resolution and shall transmit a copy thereof to the applicant and appellant.
