LAZZARETTO, CITY MANAGER DATE: FEBRUARY 27, 2007 SUBJECT: CONTRACT AGREEMENT FOR ENVIRONMENTAL CONSULTING SERVICES WITH COMPREHENSIVE PLANNING SERVICES (CPS) SUMMARY The City has received an application from a developer who is proposing to construct an 81,000 square foot mixed use development called Big Island Plaza at 7801-7825 E. Garvey Avenue. This site is located at the northeast corner of Garvey and Del Mar Avenue and includes all of the parcels fronting Garvey Avenue. Given the scope of this proposed project and the planning staffs current work plan, staff worked with the developer to send out requests for proposals (RFP) for environmental planning services to assist with the preparation of required California Environmental Quality Act (CEQA) studies. The cost to hire the consultant will be paid for in full by the developer. Staff Recommendation Staff recommends that the City Council take the following action: 1) Authorize the Mayor to execute the contract agreement. 2) Direct staff to obtain a deposit from the developer to cover the full cost for contract services prior to authorizing the consultant to proceed. ANALYSIS On January 31, 2007, the City sent out a Request For Proposals (RFP) for environmental planning services to a list of qualified consulting firms (Attachment C). The RFP requested consultant services to prepare all of the appropriate California Environmental Quality Act (CEQA) documentation and studies. Thirteen firms were contacted, three responded with letters of non-interest, and four submitted formal bid proposals. APPROVED FOR CITY COUNCIL AGENDA: V`^~~~ • • City Council Report February 27, 2007 Page 2 of 2 The following four firms submitted two separate bid prices each based on whether the project ends up qualifying as a Mitigated Negative Declaration (MND) or a full, project level Environmental Impact Report (EIR). However, this cannot be guaranteed prior to completing the necessary technical studies and analysis. Staff has selected PCS due to the lowest cost associated with completing a MND and the reputation of PCS in the field of environmental consulting. Reference checks were completed on CPS and responses were positive. The approval of this contract will allow staff to manage the environmental review process without overextending staff resources and provide a comprehensive analysis to study the impacts that such a development would have on the surrounding neighborhoods. All associated studies will be completed, prior to conducting the required public hearings before the Planning Commission and City Council. Based on the mutual promises and covenants contained herein, the Parties hereto agree as follows. I . RECITALS. This Agreement is made and entered into with respect to the following facts: A. City is desirous of preparing the appropriate level of Environmental Documentation in compliance with the California Environmental Quality Act (CEQA) in connection with processing a development application filed for the Big Island Plaza. B. Consultant is qualified by virtue of experience, training, education and expertise to accomplish these services. 2. TERM OF AGREEMENT. This Agreement shall commence upon execution and shall continue until completion of the Services, unless earlier terminated as provided below. A. Either party may terminate this Agreement, without cause, by giving thirty days written notice to the other party. B. City may terminate this Agreement for cause by giving five days written notice to Consultant. C. Upon termination, Consultant shall: (1) promptly discontinue all services affected, unless the notice directs otherwise: and (2) promptly deliver to City all data, reports, estimates, summaries, and such other information and materials as may have been accumulated or prepared to date by Consultant in performing the services under this Agreement. whether completed or in progress. Consultant shall be entitled to reasonable compensation for the services it performs up to the date of termination; however, if the Agreement is terminated by City for cause, or by Consultant without cause. City shall be entitled to deduct any costs it incurs in payment to another consultant for Services which duplicate Consultant's Services to date. In the event of termination for other than cause attributable to Consultant. Consultant shall be deemed released for liability for any work assigned but not completed as of the effective date of termination. 3. SERVICES. Consultant agrees to provide the services specified as the "Scope of Work" in Consultant's proposal attached as Exhibit A hereto and incorporated herein by this reference ("Services"). Unless otherwise specified herein. Consultant shall. at its sole cost and expense, furnish all facilities, equipment and personnel which may be required for providing the Services pursuant to this Agreement. ADDITIONAL SERVICES. If City determines that additional services are 0 0 required to be provided by Consultant in addition to the Services set forth above, City shall authorize Consultant to perform such additional services in writing ("Additional Services"). Such Additional Services shall be specifically described and approved by City in writing prior to the performance thereof. Consultant shall be compensated for such Additional Services in accordance with the agreed upon charges therefore as set forth in the written authorization. No compensation shall be paid to Consultant for Additional Services which are not specifically approved by City in writing. 5. PERSONNEL. City has relied upon the professional training and ability of Consultant to perform the services hereunder as a material inducement to enter into this Agreement. Consultant shall provide properly skilled professional and technical personnel to perform all services under this Agreement. In the event that City, in its sole discretion, at any time during the term of this Agreement, desires the removal of any person or persons assigned by Consultant to perform Services pursuant to this Agreement, Consultant shall remove any such person immediately upon receiving notice from City. 6. PERFORMANCE BY CONSULTANT. Consultant shall maintain or exceed the level of competency presently maintained by other similar practitioners in the State of California, for professional and technical soundness, accuracy and adequacy of all work, advice and material furnished under this Agreement. 7. TIMING OF PERFORMANCE. Time is of the essence with respect to Consultant's performance of the Services required by this Agreement. Consultant shall diligently and timely pursue and complete the performance of the Services required of it by this Agreement. 8. MONITORING OF CONSULTANT. Consultant's performance of this Agreement shall be continuously monitored by the City Planning Director. Consultant shall be notified in writing of any deficiency in the perfonmance of this Agreement in a timely manner by the City Planning Director. Consultant shall promptly cure any deficiency to the reasonable satisfaction of the City Planning Director. All costs for such corrections shall be borne by Consultant and shall not increase Consultant's fees due hereunder. Should the City Planning Director determine that Consultant has not performed its obligation as stated in this Agreement in a satisfactory manner, City may terminate this Agreement for cause as specified in Section 2 above. COMPENSATION. Consultant shall be compensated as follows: A. Amount. City shall compensate Consultant for services rendered pursuant to this Agreement for a not to exceed fee of One Hundred Nine Thousand (5109,000) Dollars. In no event shall compensation under this Agreement exceed that amount without the prior written authorization of the City Council. B. Invoices and Payment. Payment by City to Consultant shall be made upon receipt and approval of monthly invoices for Services rendered based upon percentage of completion. In order for payment to be made. Consultant's invoice must include an itemization as to the services rendered. date(s) of service, direct and/or subcontract costs and be submitted on an official letterhead or invoice with Consultant's name, address, and telephone number referenced. City shall review the invoices to determine whether services performed and documents submitted are consistent with this Agreement. Payment shall be made within thirty (30) days following receipt of the invoice or City shall provide Consultant with a written statement objecting to the charges and stating the reasons therefore. Payment by City under this Agreement shall not be deemed a waiver of defects, even if such defects were known to City at the time of payment. C. Expenses. Consultant shall not be entitled to any additional compensation for expenses. 10. INDEMNIFICATION. Consultant shall defend, indemnify and hold harmless City, its officers, agents, employees and volunteers from any and all claims, liabilities, expenses, or consequential darriages of any nature, including attorney's fees proximately resulting from any act or any omission to act where a duty to act exists on the part of Consultant, its agents, officers, employees, subcontractors, or independent contractors hired by Consultant, in the performance of its obligations pursuant to this Agreement. This indemnity shall apply to all claims and liability regardless of whether any insurance policies are applicable. The policy limits do not act as a limitation upon the amount of indemnification to be provided by Consultant. This indemnity shall not apply if the claim arises out of the sole negligence or wilful misconduct of City, its officers, agents, employees or volunteers. 11. INSURANCE. Except as otherwise provided in the Agreement, Consultant shall at all times during the term of this Agreement carry, maintain, and keep in full force and effect, with an insurance company admitted to do business in California and approved by the City (1) a policy or policies of broad-form comprehensive general liability insurance with minimum limits of $1,000,000.00 combined single limit coverage against any injury, death, loss or damage as a result of wrongful or negligent acts by Consultant, its officers, employees, agents, and independent contractors in performance of services under this Agreement; (2) automotive liability insurance, with minimum combined single limits coverage of $1,000,000.00; and (3) worker's compensation insurance with a minimum employer's liability limit of $1,000,000.00. City, its officers, employees. attorneys, and volunteers shall be named as additional insureds on the policy (ies) as to comprehensive general liability, property damage, and automotive liability. A. All insurance policies shall provide that the insurance coverage shall not be non-renewed, canceled, reduced, or otherwise modified (except through the addition of additional insureds to the policy) by the insurance carrier without the insurance carrier giving City thirty (30) day's prior written notice thereof. Consultant agrees that it will not cancel, reduce or otherwise modify said insurance coverage. B. Consultant agrees that if it does not keep the aforesaid insurance in full force and effect, and such insurance is available at a reasonable cost, City may take out the necessary insurance and pay the premium thereon. and the repayment thereof shall be deemed an obligation of Consultant and the cost of such insurance may be deducted. at the option of City, from payments due Consultant. C. Consultant shall submit to City (1) insurance certificates indicating compliance with the minimum worker's compensation insurance requirements above, and (2) insurance policy endorsements indicating compliance with all other minimum insurance requirements above, not less than one (1) day prior to beginning of performance under this Agreement. 12. NON-LIABILITY OF CITY. No official, employee, agent or volunteer of Cin, shall be personally liable for any default or liability under this Agreement. 13. OWNERSHIP OF WORK PRODUCT. All documents or other information created, developed, or received by Consultant shall, for purposes of copyright law, be deemed works made for hire for City by Consultant as City employee(s) for hire and shall be the sole property of City. Consultant shall provide City with copies of these items upon demand, and in any event, upon termination or expiration of this Agreement. 14. WAIVER OR BREACH. No waiver of any provision of this Agreement shall be deemed, or shall constitute, a waiver of any other provision, whether or not similar, nor shall any such waiver constitute a continuing or subsequent waiver of the same provision. No waiver shall be binding, unless executed in writing by the part making the waiver. 15. INDEPENDENT CONTRACTOR. Consultant is and shall at all times remain as to City a wholly independent contractor and shall not obtain rights to any benefits which accrue to City employees. Neither City nor its officers, employees or agents shall have control over the conduct of Consultant or any of its officers. employees or agents, except as expressly set forth herein. Consultant shall not at any time or in any manner represent that it or any of its officers, employees or agents are in any manner officers, employees or agents of City. 16. COMPLIANCE WITH LAWS. Consultant shall comply with all applicable laws, ordinances, codes and regulations of the federal, state, and local government. 17. CONFLICT OF INTEREST AND REPORTING. Consultant shall at all times avoid conflicts of interest or the appearance of a conflict of interest in the performance of this Agreement. If required, Consultant shall comply with the City's Conflict of Interest reporting requirements. 18. EMPLOYMENT OF ALIENS. Consultant warrants it fully complies with all laws regarding employment of aliens and others, and that all of its employees performing services hereunder meet the citizenship or alien status requirements contained in federal and state statutes and regulations. 19. NON-DISCRIMINATION. Consultant covenants there shall be no discrimination based upon race. color, creed, religion, sex. marital status. age. handicap. national • • origin, or ancestry, in activity pursuant to this Agreement. 20. FORCE MAJEURE. Consultant shall not be in default for failing to perform in accordance with the terms of this Agreement if such failure arises out of causes beyond the control and without the fault or negligence of Consultant. 21. ASSIGNMENT. Consultant shall not assign or subcontract any of its obligations pursuant to this Agreement, nor any part thereof, except for any monies due the Consultant, without the prior written consent of City. Such consent by City shall not be unreasonably withheld. Consultant shall be fully responsible to City for all work performed by assignees or subcontractors. 22. NOTICES. Consultant warrants that: (1) it has investigated the work to be performed; (2) it has investigated the site of the work and is aware of all conditions there; and (3) it understands the difficulties and restrictions of the work under this Agreement. Should Consultant discover and, conditions materially differing from those inherent in the work or as represented by City, it shall immediately inform City and shall not proceed. except at Consultant's own risk. until written 0 0 instructions are received from City. 25. PUBLIC RECORD. This Agreement is a public record of the City. 26. MAINTENANCE OF RECORDS. Consultant shall maintain for a minimum of three (3) years from the completion date of the Services under this Agreement, the following records: A. All accounts and records, including personnel, property and financial, adequate to identify and account for all costs pertaining to this Agreement and assume proper accounting for all funds: B. Records which establish that Consultant and all subcontractors who render Services under this Agreement are in full compliance with the requirements of this Agreement and all federal. state and local laws and regulations; C. Any additional records deemed necessary by City to assume verification of full compliance with this Agreement. D. The aforementioned records shall be made available to City or any authorized representative thereof upon request for audit. 27. BINDING EFFECT. This Agreement shall be binding upon the heirs, executors, administrators, successors and assigns of the parties hereto. 28. GOVERNING LAW. This Agreement shall be interpreted and construed according to the laws of the State of California. Any action commenced about this Agreement shall be filed in the appropriate branch of the Los Angeles County Municipal or Superior Court. 29. SECTION HEADINGS. The Section headings used in this Agreement are for reference purposes only and shall have no binding effect. 30. AUTHORITY TO EXECUTE. The persons executing this Agreement on behalf of the parties warrant that they are duly authorized to execute this Agreement. 31. ATTORNEY'S FEES. In the event that legal action is necessary to enforce the provisions of this Agreement, or to declare the rights of the parties hereunder, the parties agree that the prevailing party in the legal action shall be entitled to recover attorney's fees and court costs from the opposing party. 32. PREPARATION OF AGREEMENT. Should interpretation of this Agreement, or any portion thereof, be necessary, it is deemed that this Agreement was prepared by the parties jointly and equally and shall not be interpreted against either party on the ground that one party prepared the Agreement or caused it to be prepared. 6 0 0 33. SEVERABILITY. If any term or portion of this Agreement is held to be invalid, illegal, or otherwise unenforceable by a court of competent jurisdiction. the remaining provisions of this Agreement shall continue in full force and effect. 34. ENTIRE AGREEMENT. This Agreement contains the entire understanding between City and Consultant. Any prior agreement, promises, negotiations or representations not expressly set forth herein are of no force or effect. Subsequent modifications to this Agreement shall be effective only if in writing and signed by both parties. If any term, condition or covenant of this Agreement is held by a court of competent jurisdiction to be invalid, void or unenforceable, the remaining provisions of this Agreement shall be valid and binding. The Gables at Whittier MND(on-going): The Gables at Whittier is an infill project located on Whittier Boulevard, an aging commercial corridor that had recently been rezoned to allow mixed use. This project is the first condominium project to be proposed on the Boulevard. It proposes a 96-unit attached residential development on an approximately 4.91-acre site. The draft MND found that the proposed project could have significant adverse impacts relative to hazards/hazardous materials, noise and transportation/traffic. However, with the imposition of mitigation measures delineated, all potentially significant impacts are reduced to less than significant levels. Documentation of Recent Projects: Program EIR for the City of Napa Proposed Soscol Gateway Redevelopment Project Area and Specific General Plan, Zoning and Design Guidelines Policy Changes (on-going): The Project involves the proposed adoption of a new 376 acre Soscol Gateway Redevelopment Project Area, and related General Plan, zoning and design guideline policy changes recommended by the Soscol Gateway Vision Implementation Plan Recommendations report, endorsed by the City Council in February 2006. The Project is intended to stimulate mixed use development in the Soscol Gateway and adjacent downtown area. Major issues include development within the City Rural Urban Limit line, housing, traffic and hydrology. CPS was the prime environmental consultant for this assignment, responsible for the EIR analysis, preparation, distribution, and public presentations. Project Environmental Impact Report for the Elmwood Residential and Commercial Development Project (September 2004): This project was initiated by the Milpitas Redevelopment Agency, jointly with the County of Santa Clara. The Project Site comprised 59 acres of surplus lands previously belonging to the Elmwood Correctional Facility. The development included 683 residential units, approximately 180,000 square feet of auto sales uses, approximately 6.0 acres in public park area (including trails) and another 8.4 acres of open space; and required an amendment to the Milpitas General Plan, Midtown Specific Plan, and Zoning Map, Tentative Map, Planned Unit Development, Site and Architectural Approval, and a Use Permit for various exceptions to the Project The EIR focused on those environmental factors that would be potentially affected by the Project, including: land use; traffic and circulation; air quality; noise; biological resources; geology and seismicity; flooding, drainage, and water quality; cultural resources; hazardous materials; aesthetics; utilities; and public services. Major issues related to the EIR included: development of mitigation measures relative to sensitive wildlife species, cultural internment sites, and drainage. A Statement of Overriding Considerations was required. This project EIR was fast tracked to allow required biological field surveys to proceed. CPS was the prime environmental consultant for this assignment, responsible for the EIR analysis and preparation. C r. It would replace a current mix of vacant land, commercial, a single-family residence and a twenty-foot wide public alley with • approximately 20,000 square feet of retail/restaurant space and 50 residential condominium • units. The CEQA analysis for this project will focus on the net change from existing to • proposed land uses, as well as the proposed change in land use designations from commercial to mixed use. • • To satisfy the requirements of the California Environmental Quality Act (CEQA) relative to the • project's development and operation, an Initial Study is required. Various technical studies are • required to complete the Initial Study. These are expected to include: • Traffic Study • • Air Quality Study • Noise Study 0 Shade and Shadow Analysis • Phase I Environmental Analysis • • • Geology Study • • Hydrology Study / Concept Drainage Plan. • An infill project the size of the Big Island Plaza could require a Mitigated Negative Declaration • (MND) or a project level Environmental Impact Report (EIR). Applying the findings of the . above-listed technical studies, the Initial Study will determine whether potential adverse impacts • associated with the project will occur, and if so, whether mitigation can be applied which would reduce the potential impacts to less than significant levels. If the potential impacts can be • reduced, a MND would be the appropriate CEQA documentation. From this point (Task 8), a determination is made as to whether a MND or EIR is required. Regardless of whether a MND or EIR is prepared, major issues to be addressed through the environmental review process will include: LAND USE Development of the proposed mixed-use project will initiate a change along Garvey Avenue, bringing multifamily residential into a primarily commercial area. This change is anticipated in the City's proposed General Plan amendment. If this project precedes the General Plan Amendment, it will require a General Plan Amendment and Zone Change. Other required entitlements are expected to include a Planned Development application, tract map, alley vacation. AESTHETICS As the first mixed use development along the Avenue, Big Island Plaza could be a prototype for subsequent mixed-use developments. Height, setbacks, materials, massing, open space and parking are key issues that will determine the project's compatibility with existing commercial uses and adjacent residences. The aesthetics discussion will evaluate whether this change will substantially degrade the existing visual character and quality of the site and its surroundings. The aesthetics section also will address whether light and glare from the proposed development will substantially and adversely impact day or nighttime views in the area. These aesthetics impacts will be evaluated graphically with AutoCAD produced shade and shadow diagrams. AutoCAD will create dimensionally accurate diagrams, illustrating in plan view the extent of shade and shadow from the proposed four-story structure on adjacent land uses. The diagrams will be overlaid on an aerial base. Both winter and summer analyses of shade and shadow will be created. Special attention will be given to visual impacts of the proposed project on adjacent residential uses. TRAFFIC AND PARKING Peak hour traffic generated by a four-story mixed use development will be different from a traditional single-story commercial structure with surface parking. Requirements for parking also will be different Appropriate parking ratios must consider guest parking needs, shared parking from joint uses, and available street parking that could accommodate spillover parking. Six to ten other mixed use projects are likely to develop in the vicinity of Big Island Plaza. The cumulative impacts of these developments on traffic and parking will need to be assessed. Craig Neustaedter, registered traffic engineer with Transportation Engineering and Planning, Inc. (TEP), Inc., will prepare a traffic impact report that will assess impacts from the project on local and regional traffic. If appropriate, traffic mitigation and calming strategies to minimize neighborhood intrusion will be recommended. TEP also will evaluate on-site circulation and the P Project Approach & Scope BIG ISLAND PLAZA Page 2 r 0 0 proposed parking layout and determine whether the proposed layout satisfies requirements of codes and regulations, specifically shared parking provisions. NOISE Potential nuisance noise sources associated with the development include on-site traffic/parking, neighborhood traffic, and commercial operations, especially late evening music and restaurant activity. Potential impacts to project residents and adjacent residents will be of particular concern. Todd Brody of Synectecology will prepare a noise impact report that will assess the project noise impacts, relate project noise impacts to the City Noise Element noise/land use compatibility guidelines and other applicable noise exposure regulations, and recommend measures to mitigate noise impacts as appropriate. AIR QUALITY The proposed project could increase traffic levels. This, in turn, may increase air pollutants from vehicular traffic. In addition, the proposed development of the site including excavation of basement parking could contribute to short-term air pollutant levels associated with construction. Todd Brody of Synectecology will prepare an air quality impact report that will provide an analysis of air quality impacts using computer modeling approved by the Southern California Air Quality Management District (SCAQMD) and the California Air Resources Board (ARB). Potential for any microscale air pollution "hotspot" formation will be evaluated using the CALINE4 line source dispersion model. The analysis will include potential for nuisance impacts on the nearest neighbors from construction dust, parking structure exhaust odor, cookingirefuse odors from the restaurant, or other impacts due to close residential proximity. OTHER TECHNICAL ISSUES The environmental documentation will include discussions and analyses of Geology and Soils, Hydrology and Drainage, and Hazardous Materials. To prepare these discussions, technical information will be garnered from project specific technical documents provided by the applicant, including a preliminary geotechnical report and concept grading plan, a hydrology report and drainage plan, and a Phase I Environmental Assessment. To ensure the information contained in these documents is accurate, City engineering staff review and concurrence will be requested. Project Background and Orientation The objectives of this task are to facilitate the Initial Study preparation by obtaining all the necessary documents and background materials, to obtain a clear understanding of schedule commitments and the City of Rosemead expectations. This task includes: Attend a Project Initiation meeting with the City and applicant (if invited by City). Air Quality Study The air quality study will be prepared by Synectecology. Potential impacts will be determined based on significance criteria provided by the SCAQMD as presented in the SCAQMD CEQA Air Quality Handbook as well as the provisions set forth in the federal and State Ambient Air Quality Standards. Primary tasks related to the air quality study are as follow: • Describe Existing Setting • Determine Construction Impacts - The proposed project includes demolition, grading and construction ultimately resulting in the addition of new land uses. Based on the proposed changes, emissions will be calculated based on methodology provided with the V Project Approach & Scope BIG ISLAND PLAZA Page 5 • • URBEMIS2002 air quality model. These emissions will be assessed for their potential to exceed the Localized Significance Threshold values recently instituted by the SCAQMD either using literature values, or using the USEPA SCREEN3 dispersion model. • Operational Impacts - Operational emissions generated by project implementation and its land use revisions center on mobile sources. Using data generated in the provided traffic analysis, project-associated emissions for the proposed land use revisions will be quantified using the URBEMIS2002 vehicle emissions model. Other emissions are associated with the use of natural gas for space and water heating, landscape and structural maintenance equipment, and consumer aerosol products. A review of the project's consistency with the SCAQMD Air Quality Management Plan would be included. To determine roadway intersections prone to increases in CO concentrations, select intersections will be modeled for exceedance of State and federal Ambient Air Quality Standards for CO using the CALINE4 Air Distribution Model. • Identify mitigations, if needed • Prepare draft and final reports. Task S. Noise Study The noise study will be prepared by Synectecology. Potential impacts will be related to the City of Rosemead Noise Element land use compatibility guidelines and local ordinance and appropriate mitigation measures will be developed as necessary. Primary tasks related to the noise study are as follow: • Describe Existing Setting - A field visit shall be performed and existing noise level measurements will be obtained within the project area. If reasonably feasible, simultaneous vehicle counts for the roadway shall also be obtained during the measurement(s). These counts may be used to demonstrate compatibility and calibrate the Sound32 Noise Model, as applicable. • Construction Impacts - Construction-generated noise impacts may be produced from the use of heavy equipment, haul trucks, and worker vehicles. Noise-related impacts from project construction will be identified using accepted noise data applicable to construction equipment • Operational Impacts - Two types of operational impacts are possible. The project could create a significant impact if it were to site a sensitive land use in an incompatible area due to excessive noise. Furthermore, the project could create a significant impact if it were to substantially raise the ambient noise levels at any sensitive receptor locations. The analysis shall examine both of these scenarios. Using the provided "with project" or "build out" traffic volumes, traffic noise shall be modeled using the Caltrans Sound32 Noise Model and impacts to the proposed land use will be compared with the goals of the City of Rosemead General Plan Noise Element Noise levels in excess of those specked in the Element shall be considered as potentially significant • Identify mitigations, if needed • Prepare draft and final reports C P. The analysis will be graphically presented in plan view on an aerial of the site and surrounding area. Both summer and winter diagrams will be prepared. Task 7. Initial Study Based on the project description prepared during Task 2 and technical studies prepared during Task 3-6, the Initial Study will be prepared for review by the City. Careful consideration will be given to the development of mitigation measures. Products: (1) Draft Initial Study (5 copies plus digital copy). Task 8. MND vs. EIR At this point, based on the findings of the Initial Study and determination by City Staff, a decision will be made. If the decision is the proceed with a MND, the Initial Study will be finalized; a notice of intent to adopt a mitigated negative declaration will be prepared and issued to the County Clerk and as required by City Staff. This Scope of Work would then jump to Task 15, Public Hearings. If the decision is to prepare an EIR, the Initial Study will be finalized; a notice of preparation will be prepared and issued to the County Clerk and State Clearinghouse and as required by City Staff. It will be prepared in clear, concise language with ample use of exhibits and graphics to illustrate key project issues. Anticipated contents of the SCEIR are identified below: I. SUMMARY - This section includes: Summary Project Description; Areas of Controversy and Issues to be Resolved; Summary of Impacts and Mitigation Measures; Summary of Project Alternatives. The summary will contain a matrix of project impacts, mitigation measures and significance after mitigation by environmental topic. 2. INTRODUCTION - This section includes: Purpose, Intent and Scope; Authority; Project Proponent; Incorporation by Reference from other documents; Relationship of the Project to Other Planning Documents; Effects Found Not to be Significant 3. PROJECT DESCRIPTION - (See Task 2 discussion, above.) 4. ENVIRONMENTAL ANALYSES - This section provides an assessment of each environmental topic identified as potentially significant in the project Initial Study (Task 3, above). This assessment includes: discussions of environmental setting and existing conditions; thresholds of significance (based on CEQA guidelines, City Procedures for the Implementation of CEQA, and direction from City Staff); project impacts; mitigation measures; and impacts after mitigation. Environmental topics expected to be addressed in the EIR include: Land Use, Aesthetics, Population and Housing, Traffic and Parking, Air Quality, Noise, Geology and Soils, Hydrology/Drainage/Stormwater, Hazardous Materials, Public Services and Public Utilities. 5. PROJECT ALTERNATIVES - The EIR will analyze up to three project alternatives: two alternative development scenarios and the mandatory "no project" alternative. Each alternative will be evaluated according to the environmental topics covered by the EIR; quantitative analyses of each alternative for traffic, noise, air quality and shade and shadow will be included. A matrix summarizing the alternatives and their impacts will be prepared; the alternatives will be rated, and the environmentally superior alternative identified. 6. Please Respond Immediately - Deadline February 14, 2007 The City of Rosemead Planning Department seeks a qualified firm to provide environmental consulting services. Each of the firms being contacted has been pre-qualified for this purpose on the basis of extensive reference checks; the City seeks to expedite the selection process. The City may initially select a single firm for each of the projects under consideration, but may also choose to pre-select firms for future projects among the several private party and redevelopment agency projects under active negotiation. To this extent, proposals submitted for this process serve as both specific proposals for the one site under consideration, and Statements of Qualifications for future work within the City of Rosemead. ABOUT THE TASKS The City of Rosemead Community Development Department is working on six development projects along Garvey Avenue and Valley Boulevard. All of the projects involve mixed-use developments consisting of ground floor commercial/restaurant and residential condominiums two to three floors above. These projects currently will need to be entitled using a Planned Development Overlay zone, however a comprehensive general plan update is underway and will completed within the next four to five months. The new general plan land use designations is proposed to allow mixed use projects at higher densities than the existing general plan currently allows for. The environmental review scope of work requested for the first of these projects is outlined in Attachment A -Scope of Work. Site "A" Description The approximately 1.1 acre project site is located on the northeast corner of Garvey and Del Mar Avenues. The site is currently developed with a mix of vacant land, approximately 6,568 square feet of commercial uses, a 1,080 square foot, single-family residence and a twenty foot wide public alley. The project proposes to remove the on-site uses and construct a four story, mixed- use development with approximately 20,000 square feet of retail/restaurant space along the first floor and 50 residential condominium units for the second through fourth floor. Parking is proposed as a combination of surface and 1.5 stories of subterranean basement parking. The city is proposing to participate by vacating the existing public alley that bisects the site. The project has not completed any technical studies to date. Please refer to Attachment B for conceptual project site plans and elevations. 0 0 ABOUT THE CITY OF ROSEMEAD Rosemead, 10 miles northeast of Los Angeles, The community has substantial commercial land, is well connected to transportation, and possesses a richly, diverse demographic base. Strong municipal services and specialized programs distinguish Rosemead as one of the region's leading communities in which to live and work. The Organization Rosemead operates under the Council/Manager form of government. The Council is elected at large to four year, overlapping terms. The Mayor is elected by a majority vote of the City Council and rotates each year. The City Manager is appointed by, and serves at the pleasure of, the Council. Andrew C. Lazzaretto has served as City Manager since March 2006. The Council serves as the City's Community Development Commission (redevelopment agency), with the City Manager acting as the executive director. The Planning Department Under the direction of the Community Development Director, Jesse Duff, the Community Development Department combines the functions of economic development, redevelopment, planning, engineering, public works, building and safety and code enforcement. The Planning Division, managed by Planning Services Administrator, Brad Johnson, has three full-time staff members and one part-time staff. Rosemead Community Development Commission Under its current management, the City has worked aggressively to establish a progressive program of redevelopment and economic development. In 2000, the City established the second Rosemead Redevelopment Project Area (RDA#2) along Valley and Rosemead Boulevards. A second redevelopment project area comprising of two commercial corridors, Garvey Avenue and portions of San Gabriel Boulevard was established in 1972. The Community Development Commission is staffed by the Community Development Department under the direction of the Executive Director (City Manager), Community Development Director, and the Redevelopment/Economic Development Manager. Staffing for the economic development division includes a Redevelopment/Economic Development Manager, Brian Saeki. The Work Program The community has expressed a great need for new commercial developments including mixed- use projects with housing located above ground floor retail/ national/regional retailers; as a result, the City and Agency have a total of at least six different sites under negotiation, most within the redevelopment project area. The Agency proposes in the short term to undertake environmental impact reports or mitigated negative declarations on three specific sites that have reached a phase in the development process where sufficient information exists to prepare a project description; as other sites come to the same point, this selection process will have identified those consultants from which the City/Agency may directly obtain services. • KEY ISSUES • While the range of issues identified for each of those sites which may ultimately require an environmental impact report vary, at a minimum the key issues to be addressed include circulation and traffic impacts, infrastructure (including underground utilities, lighting and sewerage), air quality, noise, aesthetics, geology and soils and land use.
