LAZZARETTO, CITY MANAGE DATE: May 8, 2007 SUBJECT: CASA LATINA BUSINESS LICENSE CONDITIONS —STATUS UPDATE SUMMARY On September 12, 2006, the City Council granted approval of a Dance & Entertainment License for the Casa Latina Restaurant business (Attachment B). As a condition of that approval, the City Council also requested that this item be brought back for Council review after a six -month period to report staff observations of compliance with City codes and conditions of approval of their permits and licenses. Staff Recommendation Staff recommends that the City Council take the following action: 1) Grant Casa Latina a "last chance" ninety (90) day extension of the Dance & Entertainment License contingent upon conditions of approval being adhered to. 2) Direct staff to monitor and periodically inspect Casa Latina during the ninety (90) day extension. 3) Direct staff to bring back for City Council review a report detailing staff observations of compliance with the conditions of approval for the Dance & Entertainment License in ninety (90) days. ANALYSIS Between 1979 and 2003, Casa Latina was owned and operated by a single proprietor. However, the business has changed ownership three times over the last three and one half years, with each new business owner struggling to operate the facility under the approved conditions of the Conditional Use Permit and the Dance & Entertainment License (Attachment C). One of the core issues is whether or not the business operates as a viable sit -down restaurant as required by the type of alcohol license that has been issued by the State Department of Alcoholic Beverage Control. The license type issued is a "Type 47' which is issued to restaurants that operate as a bona fide eating place and allows for the sale of beer, wine, and distilled spirits. This license type mandates that the business owner make actual and substantial sales of meals during the normal "meal hours" that they are open at least five days a week. Normal meal times are 6 -9 am, 11 -2 pm, and 6 -9 pm. APPROVED FOR CITY COUNCIL AGENDA: A, ". 0 0 City Council Report May 8, 2007 Page 2 of 3 During the monitoring period over the past six months, the City has received numerous noise related complaints from one family located in the residential neighborhood south of the restaurant property. Recently, that family submitted a petition which was signed by seven neighbors for City review complaining about the noise issue at Casa Latina (Attachment A). The Los Angeles County Sheriff Department has been monitoring the business since September. The business license investigators have had continued problems with the owner's management of the business with regards to licensing entertainment managers, exterior noise levels, interior lighting levels, proof of service of meals, underage patrons during entertainment hours and general cooperation of the owner's on -site manager. Sheriff personnel have warned the on -site manager that any amount of noise level disturbance beyond the property line is unacceptable. There has been intermittent compliance with the requirement that all doors remain closed at all times, with the exception of the front door for patrons entering and exiting. There is also a tendency for patrons to also utilize outdoor areas in front of and behind the business for smoking areas, creating additional outdoor noise. The problems that have occurred at the facility are typically magnified when outside promoters are allowed to operate at Casa Latina. Outside vendors are generally not familiar with the conditions of approval on all of the different types of licenses that the owner holds with the City. When major events are advertised, patrons from outside communities travel to Rosemead and events can become large and difficult to manage. It is important that the owner allow the Sheriff Department to pre- approve any promoters before they begin advertising special events at the restaurant. The calls for service since September include six calls, five of which were calls which were related to false alarms being triggered at the building (Attachment D). The sixth call, however was on March 18, 2007 and included an assault with a deadly weapon (handgun) related to a fight at the business. Recent night inspections by the Sheriff personnel revealed that exterior noise is audible several properties south of the business. Also, one family which resides in the neighborhood to the south calls each week with continuing complaints that the noise levels are disturbing their sleeping habits until 1:30 am, generally Thursdays through Sundays. City staff from the Community Development Department and the Public Safety Services Department met with the business owner and his manager after City Council approval in September and outlined all of the issues related to the conditions of approval and the neighborhood complaints. The owner assured City staff that they would work hard to alleviate any noise or other problems with the business. City staff along with the City Attorney and members of the Los Angeles County Sheriff Department met again with the business owner and his attorney on April 25, 2007 to outline the conditions of approval that are not being adhered to. Staff also informed the business owner and his attorney that the complaints related to the noise disturbance continue on a weekly basis. Due to continued nuisance noise complaints from the neighbors and lack of cooperation with the Sheriff license inspectors, it is recommended that the City Council grant a last chance ninety (90) day extension of the Dance & Entertainment License. This shorter time extension will allow further monitoring and compliance checks by City staff and Sheriff Department personnel. If progress is not made with adherence to the conditions at the conclusion of the 0 0 City Council Report May 8, 2007 Page 3 of 3 ninety (90) day period (or earlier if warranted), staff would recommend that the City Council begin revocation proceedings for Casa Latina's Conditional Use Permit. The following are the date of the complaints and complaints made: • 10130/06 — Lieutenant Wayne Wallace notified the Planning Department that Mr. Ratterree had made complaints to the Sheriffs Department over the extremely loud music from Casa Latina at 11:20pm on both Friday (10/27/06) and Saturday (10/28/06). • 11/08/06 — Lieutenant Wayne Wallace notified the Planning Department that Mr. Ratterree had made complaints to the Sheriffs Department over the noise level at Casa Latina from Thursday (11/2/06) to Saturday (11/4/06). ■ 11/13/06 — Lieutenant Wayne Wallace notified the Planning Department that Mr. Ratterree had made complaints to the Sheriffs Department over the noise level at Casa Latina from Thursday (11/10/06) to Saturday (11/12/06). He said it was loud on Thursday, and then it lightened for a bit, but got louder thereafter. • 11/27/06 — Lieutenant Wayne Wallace notified the Planning Department that Mr. Ratterree had made complaints to the Sheriff's Department over the noise level at Casa Latina on November 17tH 18tH 23re 24tH and 25tH. EXHIBIT A • 12111/06 — Lieutenant Wayne Wallace notified the Planning Department that Mr. Ratterree had made complaints to the Sheriffs Department over the noise level at Casa Latina on November 30th, December 15t 2nd 5 t and 9th. • 12/19/06 — Lieutenant Wayne Wallace notified the Planning Department that Mr. Ratterree had made complaints to the Sheriffs Department over the noise level at Casa Latina on December 15th, 16th, and 17th. Here are the complaints that I personally received: • October 2006 — I was informed by Lieutenant Wayne Wallace that Mr. Ratterree has been calling the Sheriffs Department to complain about the noise level at Casa Latina. • November 2006 — I was informed by Lieutenant Wayne Wallace that Mr. Ratterree has been calling the Sheriffs Department to complain about the noise level at Casa Latina. Response: I asked Lieutenant Wallace to do regular patrol check late at night and on weekends and to have the deputies keep records of the activity and to keep he business under control. • January 2007 — Mr. Ratterree contacted me to complain about the problems that he is encountering with Casa Latina. I informed him of the upcoming hearing at the City Council Meeting in March and asked him to continue to work with the Sherrifs Department, since the problems occur late at night. • January 2007 (3.d week) — Ruby Ratterree, Mr. Charles Ratterree's wife, called and complained of problems that she and her husband are encountering with the noise level at Casa Latina. I informed her of the upcoming hearing at the City Council Meeting in March. She stated that she will not wait until March and is going to gather a petition from all the neighbors. I told her that it would help her case and the City if Casa Latina is causing a problem to the neighborhood. She said she would bring the petition in immediately. Jan Saavedra, received a letter from Mrs. Ratterree in February, dated January 31, 2007 and addressed to the Rosemead City Council, regarding the loud music that is coming from Casa Latina. She also attached a list of the dates when the music was loud. • February 12 & 21, 2007 — Terri McLaughlin came into City Hall and informed me that Casa Latina has multiple violations, including an unpermitted outdoor patio, unlicensed entertainment managers running 18 and over nights, and other events that are not approved, due to unlicensed managers. Attached are copies of the flyers. a • Casa Latina Feb. 7, 2007 - 1500 - Inspection done. No business license or conditions were posted. No one was there who could communicate with Investigators Cox and McLaughlin. Business cards were picked up from the restaurant, advertising it as a night club. Neither manager nor owner was present at that time. Graffiti on a front canopy. No person was `in charge', the front door was propped open, lights weren't on inside. Found advertising card showing 18 +, outside patio and name "Club Meneo ". Violations: Condition #3 - business license and conditions not posted. Condition #5 - Not complying with conditions. Condition #6 - No person in charge. Condition #6c - Unable to communicate with regulatory officials. Condition #20 - violation of the approved lighting Plan. Condition #25 - Graffiti. Feb. 21, 2007 - 1330 Picked up receipts for sales of food and alcohol. March 5, 2007 - 1900 Met with both owners and Court- Certified Translator. Each condition on business, lighting, and security was reviewed, one by one, with Lorenzo. After the reading of each item, Lorenzo was asked for his interpretation of the particular condition, to see if he did understand each condition. Employees are paid in cash, but no deductions are being taken. He didn't know about 1099 forms. No tax ID numbers for Federal or State for deductions. Pays manager Francisco 5% of total sales each day in cash. The back door was propped open, Lorenzo left it open, even though it was pointed out to him that it needed to be closed. Lorenzo didn't know he was using a promoter. Lorenzo slited that sometimes when he'd hire a band, a person would collect $ at the door for admission and keep it. He didn't realize that was a promoter. Violation: Condition #3 - Conditions not posted. March 6, 2007 - receipts were totaled for Dec. 2006. $3,024 for food (24 %), $9.675 for alcohol. (76 %). 0 0 March 23, 2007 - Evening inspection at 2100, noise was audible from south of (2739 N. Muscatel) and from north of the business. A male was seen drinking what appeared to be a beer in a can in front of the business while conversing with the security guards, and then went back into the business. A male was observed coming out of the rear door and then going back in via the rear door. Our inspection at that time was mainly limited to the `noise' issue. April 7, 2007 - This inspection was limited to lights and music. Evening inspection around 2230. Noise from the band was clearly audible from 2739 N. Muscatel and north of Garvey. We announced ourselves at the door and entered the location. There were only a few lights on in the business, it was dark inside, as one would expect a nightclub to be. Investigator Cox instructed the manager Francis Zelaya to turn on the lights and told him that all lights inside the location are to be on when the business is open. In the far east side of the business, there was a row of three indoor fan/lights that were not able to be turned on. Francis told the investigator that the switches for these lights were disabled, and showed the investigator the switch plate on the wall that had black tape over the switches. They could not be turned on or off. Francis said he didn't see anything in the conditions that said anything about lighting requirements. He was told that if he had become familiar with all the conditions for the business, he would have seen that they were on a separate sheet of paper, along with the owners' signatures. Zelaya told Dep. Beals that "it's not a club if the lights are on." Zelaya was extremely uncooperative and told Inv. McLaughlin that he had an entertainment manager's license. Since McLaughlin is doing the background for Zelaya's application, she was aware that this was Lorenzo told McLaughlin that Brad Johnson told him it was okay to turn the lights down. (On April 16, 2007, McLaughlin spoke to Johnson about the lighting issues. Johnson told McLaughlin that he did not tell Lorenzo it was okay to turn the lights down. Johnson had told Lorenzo that he would talk to McLaughlin about it.) A female was inside the location, selling roses and taking photos in the business without the proper City license. The door at the front of the building was closed during the inspection. It was then noted that persons on the outside of the door had to knock to be admitted inside the location. Recommendation: That the City Council approve the request from the Garvey School District to hang one banner on Garvey Avenue from August 19 through September 23, 2006 congratulating students and staff for outstanding achievements. Authorization to Attend California JPIA 11th Annual Risk Management Conference The California JPIA 11th Annual Risk Management Conference is set to take place November 15 -17, 2006 in San Francisco, California. Conference sessions will include ADA, Ethics, Worker's Compensation, Public Works, Ergonomics, Law Enforcement, and Human Resources. Recommendation: That the City Council authorize any Council Member, the City Attorney, the City Manager, the Traffic Commission Chairman, or staff designee to attend the California JPIA 11th Annual Risk Management Conference at City expense. K. AB 1234 Meeting Reports AB 1234 requires that the City Councilmembers and staff provide a brief report on meetings attended at City expenses at the next regular City Council meeting. The City Clerk has received a written report filed by Mayor Pro Tern Nunez, Councilmember Clark, City Manager and staff. Recommendation: That the City Council receive and file said reports. Approval of Entertainment & Dance License Casa Latina Restaurant, located at 8800 Garvey Avenue, has apt entertainment and dance license. CC Minutes — August 8, 2006 Page 8of13 EXHIBIT B 0 0 Councilmember Clark asked if the lighting issue had been addressed with the business owner. Assistant City Manager Wagner indicated that the matter had been addressed. Councilmember Clark made a motion to approve the Casa Latina Entertainment and Dance license with a second by Councilmember Imperial. Councilmember Tran asked why staff made the recommendation to approve the license. Mr. Wagner answered that the business: 1) met all of the conditions of approval put forth by the city and 2) had prior success with dance and entertainment permits. Arlene Coxx from the LA Sheriff Department indicated that 27 conditions of approval were stipulated and that in accordance with this permit, 51% of sales coming in would be from food sales meaning the establishment would not be a nightclub. Assistant City Manager Wagner clarified references to the restaurant on pages 2 and 3 of the Staff Report as the La Rumba Night Club was a mistake; that name was used by the previous owner. Councilmember Tran requested information regarding law enforcement activity that occurred during the current ownership. Lt. Wallace indicated that the establishment has been very quiet without law enforcement problems. Ms. Cox clarified that problems in the past that occurred were with the original owners who managed the establishment several years ago. Councilmember Tran indicated he was not comfortable approving the license and requested the item be deferred. Director of Planning Brad Johnson explained the history of the establishment and reasons for staff recommendation. Councilmember Imperial expressed concern about the lighting, the back gate and the 2nd floor of the building. Lt. Wallace interjected that the location has been free from law enforcement problems for the past 4 -5 years. Councilmember Clark added a condition of a 6 month review to her motion for approval. Councilmember Imperial suggested temporary approval is given with final approval in 6 months. Councilmember Tran asked how the 2nd story is being used. Director of Planning Brad Johnson explained that the business in question tonight is a single story building and that in the past, a previous owner had an annex across the street which was a two story building. Approval of Casa Latina Entertainment & Dance License At the August 22, 2006 City Council meeting, staff was directed to conduct additional research related to the potential approval of an entertainment and dance license for Casa Latina, located at 8800 Garvey Avenue. The new business owners are currently operating the business as a restaurant and would like to expand their operation to include dancing and live entertainment seven days a week from 11:00 a.m. until 2:00 a.m. Recommendation: That the City Council take the following action: 1. Grant an entertainment and dance license to Casa Latina contingent on the business owner complying with conditions recommended by the Planning Commission, the Sheriff's Department, and staff. 2. Direct staff to monitor and periodically inspect Casa Latina for a period of six months to ensure compliance with all City codes and regulations. In six months, bring back for City Council review a report detailing staff observations of compliance with City codes and regulations at Casa Latina. Motion by Councilmember Tran; second by Mayor Pro Tern Nunez that the Council accept staff recommendations and approve the Casa Latina Entertainment & Dance License. Bus Stop Improvements Plans and specifications have been prepared for the replacement of all existing - bus stop furnishings with new bus shelters, benches and trash receptacles City- wide, except for those on Valley and San Gabriel Boulevards, unless damaged. Recommendation: That the City Council approve the plans and specifications for the installation of new bus shelters, benches and trash receptacles City-wide and authorize advertisement for bids by the City Clerk. Juan Nunez, residing at, expressed reservations regarding bus stop improvements. CCMIN: 9 -12 -06 Page 12 of 22 0 Councilmember Tran recommended deferral until a review of the last 18 months of activity takes place. Mayor Pro Tern Nunez expressed concern over the kitchen size and also recommended deferral until further information is received. Director Johnson explained that ABC has put a freeze on their application to serve alcohol pending a decision on the license. Councilmember Clark made a motion to approve the license, with a six month review, with a second by Councilmember Imperial. Award of Street Sweeping Contract The City's contract with CleanStreet to provide street sweeping services expired June 30, 2006. Bid proposals have been received from four street sweeping providers. Staff has reviewed the bid proposals. Recommendation: That the City Council award the street sweeping contract to CleanStreet and authorize the Mayor to sign the contract on behalf of the City. Councilmember Clark made a motion to approve the Street Sweeping Contract. The motion died for a lack of a second approver. F. Award of Annual Street Tree Contract Our current Street Tree Contractor, Evan's Tree Service, went out of business at the end of July 2006. Staff prepared bid specifications and the Notice Inviting Bids was published. In total, three bids were received on July 17, 2006. During the interim, between Evan's Tree Service and the new contractor starting, we have made arrangements for Mariposa Horticultural, Inc. to handle tree requests. Recommendation: That the City Council award the street tree contract to Great Scott Tree Service, Inc. Councilmember Clark made a motion to approve the Street Tree Contract with a second by Councilmember Imperial. Councilmember Tran expressed concern and asked why such a big gap in bids occurred between Mariposa and Great Scott. Director of Parks and Recreation Michael Burbank surmised that Great Scott perhaps better scrutinized city trees and pointed out that their unit prices are very similar to Evan's Tree Service; in speaking with the owner of Mariposa, Mr. Burbank stated that Mariposa's CC Minutes — August 8, 2006 Page 10 of 13 0 LOS ANGELES COUNTY SHERIFF'S DEPARTMENT ENTERTAINMENT PERMIT CONDITIONS PAGE 1 of 3 CASA LATINA RESTAURANT 8800 E. Storage areas will be kept locked and accessible to employees only. All licenses, permits, and a copy of these conditions shall be posted where they are fully visible and readable by the public. 4. All licenses and permits shall be valid at all times. 5. All conditions imposed by any licensing authority shall be complied with at all times. All CUP conditions shall be complied with at all times. 6. A person in charge shall be on the premises at all times that the business is open. The person in charge shall be familiar with the laws regulating this establishments. The person in charge shall meet the following qualifications: A. Be at least twenty -one (21) years of age. B. Possess, on their person, a valid DMV issued California driver's license or identification card. C. Be able to communicate effectively with regulatory officials. D. Have the ability to immediately contact an owner. The person in charge shall introduce him /herself to any regulatory official (Sheriff, Fire, Code Enforcement, Etc.) at such time as the official's presence is announced to any employee. The person in charge shall fully cooperate with the official's investigation. 8. All employees shall possess, on their person, a valid DMV issued California driver's license or identification card. The approved floor plan shall not be changed without prior approval of the Sheriff's Department License Detail. The hours of operation shall be Tuesday through Sunday between 8:00 A.M. of one day and 2:00 A.M. of the following day. The business shall not be open to, or used by the public, between the hours of 2:00 A.M. and the approved hour of opening. 11. No person under twenty -one (21) years of age shall be allowed on the premises during the hours of entertainment, unless accompanied by a parent or legal guardian. 12. There shall be no smoking allowed within the premises. "No Smoking" signs shall be posted throughout the business. 13. The latest security plan and video taping plan, as approved by the Sheriffs Department License Detail, shall not change without the prior approval of the Sheriff's Department License Detail. 14. The security and taping plans may be reviewed and /or revised by the Sheriff's Department License Detail as needed without approval of the License and Permit Hearing Board. 15. Entertainment shall not be audible to the exterior of the building. 16. The doors on the south side of the building shall be equipped with "alarmed panic style" hardware, and shall be used for emergency ingress and egress only. The south doors shall not be propped open at anytime. All customers shall enter and leave through the northwest entry of the business. 17. Patrons of the business shall not be allowed to loiter around the business, in the parking lot, or on the streets in the area of the business. 18. The parking lot and area around the business shall be kept free of litter. 19. Wagner, at 10:10 a.m. The Hearing Officer. stated that the purpose of the Hearin; was to consider an application for an Entertainment License and Dance License for Casa Latina Restaurant Present were Arlene Cox, Los Angeles County Sheriffs Business License Bureau, Brad Johnson, Planting Director, Lorenzo g Norma Aviles, business owners, David Zavala, translator for owners, and Tinia Celaya, neighbor of business location. Ms. Cox stated that the background investigation by the Sheriff s Department was completed and they. were recommending approval contingent on the 27 conditions. Brad Johnson 2006. teHe the stated that helneeded a landscaping and irrigation t Planning Commission ownemeeting . e also February 6, stated that temporary banners were only allowed for a certain amount time and that the owners need to submit a plan for the signage. Mr. Johnson stated that according to the ABC license, this establishment needed to sell more food than alcohol. Any revisions to the approved plans must be resubmitted for review and approval by the Planning Department. 2. Conditional Use Permit 06 -1047 is approved for six (6) months from the date of these conditions. The applicant shall make progress towards initiation of proposed use or request 30 days prior to expiration from the Planning Commission. Otherwise Conditional Use .Permit 06 -1047 shall become null and void. 3. Any changes to the conditions of operation listed in this Exhibit "A" must first be approved by the Planning Commission through a modification application. 4. All signs must comply with Section 17.104.080 regarding identification of the business in English. All illegal signs without permits shall be removed, and all doors and windows shall be kept clear of obstructions. New signs require that plans be submitted to the Planning Department for review and approval. a • 9. The property shall comply with all appropriate Federal, State, and local laws relative to the approved use including the requirements of the Planning, Building, Fire, and Health Department regulations. 10. The site shall be maintained in a clean, weed and litter free state in accordance with Sections 8.32.010, .020, .030 and .04b' of the Rosemead Municipal Code, which pertains to the storage, accumulation, collection, and disposal of garbage, rubbish, trash, and debris. All trash containers shall be stored in the appropriate trash enclosure at all times. All trash, rubbish, and garbage receptacles shall be regularly cleaned, inspected, and maintained in a clean, safe, and sanitary condition. 11. The site shall be maintained in a graffiti -free state. Any new graffiti shall be removed within twenty -four (24) hours. The applicant shall keep the electrical and mechanical equipment and/or emergency exits free of any debris, storage, furniture, etc and maintain a minimum clearance of five (5) feet. 16. The applicant shall comply with Ordinance No. 567, which requires the posting of a sign prohibiting consumption of alcoholic beverages adjacent to the premises within parking lots and public sidewalks.
