CC - 1996-60 - approving Conditional Use Permit 96-668 at 3306 Bartlett AveA RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ROSEMEAD, APPROVING CONDITIONAL USE PERMIT 96-668, ALLOWING DEVELOPMENT OF A 2,950 SQUARE FOOT RESIDENCE AT 3306 BARTLETT AVENUE (APN: 5289-009-030). WHEREAS, Mr. Lian Li, 3306 Bartlett Avenue, Rosemead, California, 91770, filed an application requesting a Conditional Use Permit to develop a single family home with a floor area over 2,500 square feet on March 21, 1996; and WHEREAS, 3306 Bartlett Avenue is located in the R-1; Single Family Residential zoning district; and WHEREAS, Sections 9104.11 and 9181.1(36) of the Rosemead Municipal Code (RMC) permit "Residences over 2,500 square feet" in the R-1 zone upon the granting of a Conditional Use Permit; and WHEREAS, Section 65853 of the California Government Code and Section 9182 of the Rosemead Municipal Code authorize the Planning Commission to approve, conditionally approve or deny conditional use permits; and WHEREAS, Sections 9180 of the Rosemead Municipal Code specifies the criteria by which a conditional use permit may be granted; and WHEREAS, on April 24, 1996, notices were posted in 10 public locations and 61 notices were sent to property owners within a 300-foot radius from the subject property specifying the availability of the environmental analysis, plus the date, time and location of the public hearing for Conditional Use Permit 96-668; and WHEREAS, on May 6, June 3, July 1, August 5, and September 16, 1996, the Planning Commission held public hearings and adopted PC Resolution 96-55, denying Conditional Use Permit 96-668, due to a lack of consensus; and WHEREAS, on October 1, 1996, a written appeal was filed requesting the City Council to reverse the Planning Commission decision and approve Conditional Use Permit 96-668; and WHEREAS, on October 31, 1996, notices were posted in 10 public locations and 61 notices were sent to property owners within a 300-foot radius from the subject property specifying the availability of the environmental analysis, plus the date, time and location of the public hearing for the appeal of Conditional Use Permit 96-668; and WHEREAS, on November 12 and 26, 1996, the Rosemead City Council held duly noticed public hearings and sufficiently considered all testimony presented to them in order to make the following determination. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Rosemead as follows: SECTION 1. The City Council HEREBY DETERMINES that Conditional Use Permit 96-668 is Categorically Exempt from environmental review as a Class 1 Exemption pursuant to Section 15301(a) of the California Environmental Quality Act (CEQA). This project proposes to construct a 2,950 square foot residence. Section 15301 exempts projects that consist of developing less than three residential units in an urban area. SECTION 2. The City Council HEREBY FINDS AND DETERMINES that facts do exist to justify approving Conditional Use Permit 96-668 according to the Criteria of Section 9181.1.36 of the Rosemead Municipal Code as follows: Resolution 96-60 . Conditional Use Permit 96-668, appeal Page 2 of 6 A. That the granting of such conditional use permit will not adversely affect the established character of the surrounding neighborhoods or be injurious to the property or improvements in such vicinity and zone in which the property is located. FINDING: The subject site is a large residential lot measuring over 216-feet deep by 60-feet wide. There is currently a one-story, 1,253 square foot single family home on this 13,000 square foot lot. The applicant proposes to create a new 2,950 square foot home on the front portion of the lot. Most of the homes in this area currently range in size from 1,300 to 1,600 square feet, with a few that are up to 2,800 square feet. Most of them are on lots that are 5,200 to 6,500 square feet in size. The Floor Area Ratio (FAR) for this site will be 32.3% including the existing 1,253 square foot house. The code allows up to 45% FAR. The proposal meets the other development standards. B. Architecture of the dwellings shall be consistent with and/or complementary to the surrounding neighborhood to assure the neighborhood's integrity and the character of the community. FINDING: The size of the proposed home would be compatible with the surrounding neighborhood. This is a larger lot that can support such a larger home. There will be a 25-foot front yard setback with a large existing tree to remain. The house has been designed to step back various parts of the home in order to create architectural relief from the massiveness. No new area may be added to either unit without a modification review of the CUP by the Planning Commission. The existing unit will need to be modified to provide a similar finish to the building. SECTION 3. The City Council HEREBY APPROVES Conditional Use Permit 96-668, allowing development of a 2,950 square foot residence located at 3306 Bartlett Avenue, subject to the conditions listed in Exhibit "A" attached hereto and incorporated herein by reference. SECTION 4. The City Clerk shall certify to the adoption of this Resolution. PASSED AND APPROVED this 10th day of December, 1996.
