A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ROSEMEAD
REQUESTING THE GOVERNOR AND LEGISLATURE OF THE STATE OF
CALIFORNIA TO REPEAL THE SMOG CHECK H PROGRAM AND
RECOMMENDING CONTINUATION OF PREVIOUS SMOG CERTIFICATION
REQUIREMENTS
WHEREAS, the members of the Rosemead City Council, along with many other cities, public
agencies and private businesses in Southern California have grave concerns about the
potential negative impact of the proposed Smog Check II requirements on most
motorists in the Enhanced Areas; and
WHEREAS, a cap on the repair costs must be included in Smog Check II wherein vehicles
requiring repairs that would exceed a specified dollar limit would receive guaranteed
certification once that cap was met or exceeded; and
WHEREAS, the threat of impounding older vehicles that do not meet stringent Smog Check 11
requirements would likely have a disproportionate share of negative effects on
lower/fixed income persons, many of whom are senior citizens; and
WHEREAS, many substantive questions remain regarding the accuracy of the remote sensing
devices that purport to measure the levels of pollutants emanating from vehicle
tailpipes and take pictures of the license plates of suspected polluting vehicles.; and
WHEREAS, proposed Smog Check II requirements include a disequitable system in which repair
costs are not uniform statewide, thus placing a disproportionate share of the costs on
Southern California drivers; and
WHEREAS, the stated goal of Smog Check II in destroying Gross Polluters will do little in
reducing current levels of air pollution in Southern California; and
WHEREAS, the previous smog check program, implemented by the State of California in 1982,
has proven effective in eliminating air pollution in the Los Angeles basin, as indicated
in reports published nationwide stating that Southern California is making significant
progress in addressing its air pollution problem; and
WHEREAS, it is the conclusion of the Rosemead City Council that it is completely unnecessary to
dismantle the existing smog check program in favor of an unproven and potentially
onerous system that will discriminate unfairly among those who are forced or choose
to drive older vehicles.
NOW, THEREFORE, BE IT RESOLVED THAT THE CITY COUNCIL OF THE CITY OF
ROSEMEAD DOES HEREBY RESOLVE AS FOLLOWS:
SECTION 1. The City Council of the City of Rosemead urges strongly that the Governor
and the Legislature of the State of California repeal the Smog Check II program and reinstate the
previous smog check program.
SECTION 2. The City Clerk shall certify to the passage and adoption of this resolution.
