RESOLUTION NO. 96-19
A RESOLUTION OF THE CITY COUNCIL OF
THE CITY OF ROSEMEAD DENYING A
PUBLIC EATING ESTABLISHMENT LICENSE
AND AN ENTERTAINMENT LICENSE'AT
9016 MISSION DRIVE, ROSEMEAD
(DIAMOND RESTAURANT)
THE CITY COUNCIL OF THE CITY OF ROSEMEAD DOES HEREBY RESOLVE
AS FOLLOWS:
Section 1. The City Council finds, determines and declares:
1. In June, 1995 the owners of the business known as
Diamond Restaurant applied for a public eating establishment
license and an entertainment license to allow a restaurant and
karacke entertainment at their restaurant located at 9016 Mission
Drive, Rosemead, California.
2. An administrative hearing on the request was conducted
by the Assistant City Manager on May 2, 1996.
3. At the administrative hearing, the Los Angeles County
Sheriff's Department recommended denial of the licenses based
upon the results of a surprise inspection of the establishment on
January 28, 1996.
4. On May 14, 1996, at a regular City Council meeting, the
Rosemead City Council considered the request for issuance of the
public eating establishment and entertainment permit. After
reviewing the previous record regarding this application and
hearing all interested persons who wished to speak, the Council
voted unanimously to deny the request for issuance of the public
eating establishment and entertainment permit for Diamond
Restaurant, 9016 Mission Drive.
Section 2. The Council further finds determines and
declares:
1. The premises of Diamond Restaurant were found to
operating, on January 28, 1996, with locked or inoperable fire
doors in violation of the fire code.

2. The.City Council finds that on January 28, 1996, based
upon a preponderance of the evidence, that minors were allowed to
remain on the premises while smoking and drinking Budweiser
beer. The guest check for the party, indicating a charge of
$170.00 for "Bud" indicates that the owners either served the
alcohol in violation of state law or failed to control their
patrons by refusing to allow them to remain on the premises.
Instead, the owners chose to profit by the violation of law,
charging $170.00 for "Bud".
3. Patrons were allowed to perform "karaoke" singing
without the proper license.
4. The demonstrated violations are ample evidence that the
owners/applicants do not possess the management skills necessary
to operate this business in a responsible and safe manner.
Section 3. The request for issuance of a public eating
establishment license and entertainment license for Diamond
Restaurant, 9016 Mission Drive, Rosemead, is hereby denied for
the reasons herein stated.
Section 4. The City Clerk shall certify to the adoption of
this Resolution.
