San Gabriel BlvdA RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ROSEMEAD, APPROVING CONDITIONAL USE PERMIT 96-678, FOR THE CONSTRUCTION AND OPERATION OF A RELIGIOUS FACILITY WITH OFF-SITE PARKING LOCATED AT 2518 & 2530 N. SAN GABRIEL BOULEVARD (APN: 5283-013-018 & 020). WHEREAS, Mr. Peter Ngai c/o The Christ Chinese Alliance Church, Post Office Box 661841, Arcadia, California 91066, filed an application requesting a Conditional Use Permit for the construction and operation of a religious facility with off-site parking at 2518 & 2530 N. San Gabriel Boulevard on May 23, 1996; and WHEREAS, 2518 & 2530 N. San Gabriel Boulevard is located in the M-1; Light Industrial/ Manufacturing zoning district; and WHEREAS, Section 9181.3 of the Rosemead Municipal Code (RMC) permits "Churches and other places used exclusively for religious worship" in any zone upon the granting of a Conditional Use Permit; and WHEREAS, Section 65853 of the California Government Code and Section 9182 of the Rosemead Municipal Code authorize the Planning Commission to approve, conditionally approve or deny conditional use permits; and WHEREAS, Sections 9180 of the Rosemead Municipal Code specifies the criteria by which a conditional use permit may be granted; and WHEREAS, on July 3, 1996, notices were posted in 10 public locations and 29 notices were sent to property owners within a 300-foot radius from the subject property specifying the availability of the environmental analysis, plus the date, time and location of the public hearing for Conditional Use Permit 96-678; and WHEREAS, on July 15 and August 5, 1996, the Planning Commission held public hearings and adopted PC Resolution 96-42, approving Conditional Use Permit 96-678, subject to conditions of approval; and WHEREAS, on August 13, 1996, a written appeal was filed requesting the City Council to reverse the Planning Commission decision and deny Conditional Use Permit 96-678; and WHEREAS, on August 29, 1996, notices were posted in 10 public locations and 47 notices were sent to property owners within a 300-foot radius from the subject property specifying the availability of the environmental analysis, plus the date, time and location of the public hearing for the appeal of Conditional Use Permit 96-678; and WHEREAS, on September 10 and 24, 1996, the Rosemead City Council held duly noticed public hearings and sufficiently considered all testimony presented to them in order to make the following determination. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Rosemead as follows: SECTION 1. The City Council HEREBY DETERMINES that Conditional Use Permit 96-678 is Categorically Exempt from environmental review as a Class I Exemption pursuant to Section 15301(e) of the California Environmental Quality Act (CEQA). This project proposes to construct a 2,770 square foot multi-purpose auditorium facility. Section 15301 exempts projects where additions to existing structure are less than 10,000 square feet where all public facilities are available. • • Resolution 96-51 Conditional Use Permit 96-678, appeal Page 2 of 6 SECTION 2. The City Council HEREBY FINDS AND DETERMINES that facts do exist to justify approving Conditional Use Permit 96-678 according to the Criteria of Section 9180 of the Rosemead Municipal Code as follows: A. The project is essential and desirable to the public convenience or welfare. FINDING: A church is proposed to be developed on two properties that are part of an old contractor yard. This project will remove unpermitted, unattractive buildings and construct new buildings that will improve the area. Landscaping will be installed to soften the hardscape. B. The project is in harmony with the elements and objectives of the General Plan and Zoning Codes. FINDING: Churches are allowed in any zone with a conditional use permit. The site has been designed to meet the parking requirements for assembly and office uses. This redevelopment will clean up a blighted site. The off-site parking lot at 2530 is less than 500-feet from the subject site which is within reasonable limits. C. The project will not be detrimental to the surrounding properties. FINDING: Adequate access will still be available for the property between these sites after the development is complete. The project is surrounded by industrial uses, so there would be no impact to residents. The applicant has agreed to conditions of approval that will improve both sites and create a nice development for the area. SECTION 3. The City Council HEREBY APPROVES Conditional Use Permit 96-678, for the construction and operation of a religious facility with off-site parking located at 2518 & 2530 N. San Gabriel Boulevard, subject to the conditions listed in Exhibit "A" attached hereto and incorporated herein by reference. SUCTION 4. San Gabriel Boulevard (Christ Chinese Alliance Church) CONDITIONS OF APPROVAL September 24, 1996 1 Conditional Use Permit 96-678 is approved for one (1) year from the date of these conditions. At least 30 days prior to the end of this one (1) year period, the applicant shall file a written extension request to the Planning Department. This approval shall expire after one (1) year without progress towards completion of the use authorized by this permit. 2 All conditions listed on this Exhibit "A" shall be copied directly onto any development plans subsequently submitted to the Planning department for review. 3 Conditional Use Permit 96-678 shall not become effective until the applicant has submitted a signed and notarized affidavit agreeing to these, conditions. 4 Conditional Use Permit 96-678 is approved to operate with a maximum of 60 people. These limits are based on 20 available parking spaces. The parking ratio used is one parking space per three (3) people. Any amendment of this schedule shall change the occupancy limit subject to the review and approval of the Director of Planning. 5 The property shall be developed in accordance with the plans marked Exhibit "B" except where otherwise noted and based on these conditions. Any modification shall require Planning Department approval. 6 The property shall comply with all appropriate building, fire, and health department regulations. 7 The hours of construction shall be limited from 7 a.m. to 8 p.m. Monday - Saturday. No construction shall take place on Sundays or on any legal holidays without prior approval by the City. 8 Prior to occupancy, the applicant shall obtain a Certificate of Occupancy. 9 All trash, rubbish and garbage receptacles shall be regularly cleaned, and inspected and maintained in a clean, safe and sanitary condition. 10 The site shall be maintained in a clean, weed, litter free state in accordance with Section 5401-5405 of the Rosemead Municipal Code, which pertains to the storage, accumulation, collection, and disposal of garbage, rubbish, trash, and debris. All trash containers shall be stored in the appropriate trash enclosure at all times. Any new litter and graffiti shall be removed within twenty-four (24) hours. 11 Adequate lighting shall be provided in the parking area. Motion-activated lights shall be installed where deemed appropriate by the Director of Planning. All exterior lighting shall be directed away from adjacent properties. 12 All designated parking areas shall be striped in accordance with Chapter 9122 of the Rosemead Municipal Code and the approved plans. Such striping shall be maintained in a clear, visible and orderly manner. A • Resolution 96-51 Conditional Use Permit 96-678, appeal Page 5 of 6 • 13 At least two percent of the required parking shall be designated for handicap space pursuant to California Vehicle Code Section 22511.8. A letter by the property owner shall be given to the City authorizing enforcement. 14 The numbers of the address signs shall be at least 6" tall with a minimum character width of 1/4", contrasting in color and easily visible at driver's level from the street. The location, color and size of such sign shall be subject to the approval of the Planning Director. 15 The parking space markers shall be re-painted periodically to City standards to the satisfaction of the Planning Department, including double-striping, wheel stops and handicapped parking/markings. 16 The applicant shall maintain a minimum clearance of five (5) feet (free of any debris, storage, furniture, etc.) from any electrical/mechanical equipment and/or emergency exits. 17 Driveways and parking areas shall be surfaced and improved with Portland concrete cement or asphaltic concrete, and thereafter maintained in good serviceable condition, subject to the approval of the Director of Planning. 18 Applicant shall install and complete all necessary public improvements, including but not limited to street, curbs, gutters, sidewalks, handicap ramps, and storm drains, along the entire street frontage of the development site as required by the Director of Planning. 19 Prior to occupancy, the applicant shall record a covenant that holds 2518 and 2530 San Gabriel Boulevard together for parking as long as the building at 2518 is maintained, subject to review and approval of the Director of Planning. 20 All ground level mechanical/utility equipment (including meters, back low preservation devices, fire valves and other equipment) shall be screened by screening walls and/or landscaping to the satisfaction of the Planning Department. 21 Prior to occupancy, the applicant shall install; - landscape areas fronting onto 2518 San Gabriel Boulevard, including the area in front of Building "B". This landscaping shall extend back into the lot along the entrance. - a landscape planter, minimum 4-feet wide, between Building C and the parking spaces. This planter will be continued, at least 2-feet wide, along the north property line of 2518 San Gabriel Boulevard. - a chain link fence provided that vines are planted and allowed to grow along the fence. A landscape plan which includes the type, size, and spacing of these vines must be approved by the Planning Director. - a wrought iron type of fence along the frontage of 2518 San Gabriel Boulevard where the steps go down into the new facility. A gate may be placed at the top landing in order to prevent any areas where people could hide. 22 Within one year of receiving occupancy, the applicant shall install the following items to the satisfaction of the Director of Planning; a chain link fence along the south property line of 2530 San Gabriel Boulevard that is similar to Condition #25. a 5-foot wide planter along the area fronting 2530 San Gabriel Boulevard. An ornamental fence/wall may be located in the middle of the planter with a gate for security. Landscaping should be designed on both sides of the wall. 2-foot wide planters along the property lines at 2530 San Gabriel Boulevard. 0 Resolution 96-51 Conditional Use Permit 96-678, appeal Page 6 of 6 These planters will help provide shade and also serve as wheel stops for the vehicles. Create 4-foot wide landscape strips every ten parking spaces for the 90- degree parking. Create planter strips every four (4) spaces for the parallel parking on the south side. This will also allow you to retain the existing tree along the south property line. 23 Prior to issuance of building permits, the applicant shall submit a landscape plan for the review and approval of the Director of Planning. Said plan shall include the species, size, location/spacing, and irrigation for all landscape areas. 24 A permanent maintenance program of all landscaping shall be provided insuring regular irrigation, fertilization and weed abatement. Automated irrigation shall be installed, and approved by the Planning Department. Landscape materials and irrigation systems are to be inspected by a City representative prior to final occupancy. 25 The applicant shall install approved street trees in a location chosen by and to the satisfaction of the Engineering Department. 26 The parking lot at 2530 San Gabriel Boulevard shall be designed with a turn around area towards the rear portion of the property, subject to the approval of the Director of Planning. 27 Prior to occupancy, the applicant shall verify existing permits, or obtain Sanitation District approval and new permits to keep these structures. Otherwise the structures must be demolished. Since they were built without permits, the applicant will need to bring them into conformance with current building codes. Also, they would need to modify the building to match the design of other buildings to the satisfaction of the Director of Planning. 28 Violation of the conditions of approval may result in citation and/or initiation of revocation proceedings.
