SUBJECT: AUTHORITY TO ISSUE CITATIONS
SUMMARY
The City Council must reference and authorize the staff members who are able to issue parking and
notice to appear citations per Rosemead Municipal Code Section 1.04.050.
In an effort to enhance the effectiveness of the City's public safety services department staff, it is
being recommended that the City Council acknowledge and authorize the Public Safety Services
Director, Supervisor, Community Service Officers, Parking Control Officers, and Code Enforcement
Officers to issue parking and notice to appear citations
Prior to issuing any Parking or Notice to Appear citations, all employees would be properly
trained and certified with respect to all applicable state laws. This authority to issue citations is
a valuable tool for the Public Safety Department.
Staff Recommendation
Staff recommends that the City Council approve Resolution 2007-35 granting Public Safety
Services Department staff members the authority to issue citations.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
ROSEMEAD, CALIFORNIA, GRANTING AUTHORITY TO ISSUE
CITATIONS TO THE CITY'S PUBLIC SAFETY DEPARTMENT
PERSONNEL
THE CITY COUNTIL OF THE CITY OF ROSEMEAD DOES RESOLVE AS FOLLOWS:
Section 1. Public Safety Department personnel, acting under the direction of the Public
Safety Services Director, pursuant to Rosemead Municipal Code Section 1.04.050 (Acts By
Deputy) are hereby authorized to issue citations (as hereinafter defined) to any persons violating:
(a) Any provisions of the Rosemead Municipal Code; or
(b) Any standing or parking regulations established by the California Vehicle Code.
Section 2. The word "citation" as used in this resolution shall be deemed to be the same
as the "notice to appear" of the Municipal Code and, except as herein provided, the procedures set
forth in said Chapter shall apply to the issuance of citations.
Section 3. Public Safety Department personnel are hereby vested with the authority
contained in California Penal Code Section 834 and 853.8, and in Vehicle Code Sections 41102
and 41103. Public Safety Department personnel shall comply with the provisions of such State
laws.
Section 4. This resolution does not authorize Public Safety Department personnel to arrest
or to take any person into custody, nor to carry or use fire arms, in the performance of their duties.
Section 5. Any reference to "arrest" as applicable to citations issued pursuant to the
authority granted in this resolution, shall be deemed to refer to the issuance of such citation and
the word "arrested" shall be deemed to refer to issuing or receiving a citation, as required by the
context.
