Planning Commission considered the subject subdivision on September 20, 2004. A sewer
easement dedication on the site was required to be granted on the map for public sewer
purposes.
Attached for information are the following:

2. Planning Commission's Conditions of Approval.
Pursuant to the Subdivision Map Act, the subject parcel map does not require City Council
approval.
RECOMMENDATION
It is recommended that the City Council accept the street dedication as shown on Parcel
Map 60733 and direct the City Clerk to arrange for the recordation of the map.

Project Description
Steven Van has submitted an application for a Tentative Parcel Map to subdivide one parcel into four
(4) residential lots for the development of four (4) new single-family residences; one of the four
units requires a Conditional Use Permit for having more than 2,500 square feet of living area. The
proposed residences will range from 2,495 - 2,755 square feet of living area.
Public Notice
On September 9, 2004, fifty-five (55) written notices of this public hearing were mailed to property
owners within 300 feet of the subject site. On September 9, 2004, ten (10) notices were posted in
designated public places.
Environmental Analysis
Section 15332(b) of the California Environmental Quality Act (CEQA) and local environmental
guidelines where projects occur within city limits on a project site of no more than five acres
substantially surrounded by urban uses. Accordingly, Tentative Parcel Map 60733 and Conditional
Use Permit 04-978 are classified as a Class 32 Categorical Exemption pursuant to Section 15332(b)
of CEQA.
Municipal Code Requirements
Tentative Tract Map - Section 66474 et seq of the Subdivision Map Act describes the grounds for
approving a subdivision map. In addition, Chapter 16.04 of the Rosemead Municipal Code provides
subdivision regulations, which adopt Los Angeles County subdivision regulations by reference. The
following are findings that must be made in order to approve a tentative tract map:
• The map will not be materially detrimental to the public welfare nor injurious to the
property.
• The proposed division will not be contrary to any official plan.
• Each proposed Tract conforms in area and dimension to the City codes.
• All streets, alleys and driveways proposed to serve the property have been dedicated
and that such streets, alleys and driveways are of sufficient design to provide
adequate access and circulation for vehicular and pedestrian traffic.
• Easements and covenants required for the tentative map have been executed and
recorded.

If the Planning Commission cannot make all of the findings, then it shall deny the map.
Section 17.112.030.026 of the Rosemead Municipal Code (RMC) requires a Conditional Use Permit
for residential dwelling units in the R-1 and R-2 zones that exceed (2,500) square feet of living area.
Section 17.1 12.010 sets the following criteria that must be met:
• That the conditional use permit applied for is authorized by the provisions of this
title.
• That the granting of such conditional use permit will not adversely affect the
established character of the surrounding neighborhood or be injurious to the property
or improvements in such vicinity and zone in which the property is located.
• That the establishment, maintenance or conduct of the use for which the conditional
use pennit is sought will not, under the particular case, be detrimental to the health,
safety, morals, comfort. convenience or welfare of persons residing or working in the
neighborhood.
• That the granting of such conditional use permit will not adversely affect the General
Plan of the city.
Property History & Description
The subject site consists of one 33,062 square-foot parcel. The property is currently developed with
a single-family residential unit. wltich was originally constructed in 1927. Various additions have
been done to the property, including adding additional living area, a swimming pool and a four-car
garage. All existing structures will be demolished upon approval of the proposed project.

The applicant proposes to subdivide the subject property into four (4) lots with acommon driveway.
The proposed lots would range in area from 5,843 square feet to 7,910 square feet (net square
footage), averaging 6,732.25 square feet; and 6,906 square feet to 11,291 square feet (gross square
footage) with the average lot consisting of approximately 8.265.5 square feet. The proposed
residences will have between 2,495 and 2,755 square feet of floor area. There is only one (1)
residential plan with living area exceeding 2,500 square feet. Proposed Floor Area Ratios (FAR) for
the units range between 34.02% and 42.78°/x.
Tentative Tract Map Review - The map was distributed to various agencies for their review on July
8, 2004. Responding agencies have made their comments, which are on file.
The City Engineer has checked the parcel for its accuracy. The City Engineer's conditions of
approval have been added to the attached as Exhibit A.
By subdividing the land, the opportunity for property ownership becomes a possibility thus creating
a higher standard of property maintenance, which is more difficult to achieve if the units were
occupied as rentals. Lastly, the General Plan Land Use element specifies the density for Low
Density Residential properties as 0 - 7 units per acre. This proposed project is developed at 5.3

units per acre.
Zoning Setbacks: This area is zoned for R-1; Single Family Residential and the (tomes are being
built within the property development standards of the R-l: Single-Family Residential zone, as
indicated in the table below:

room, dining room, kitchen. foyer, family room, a bedroom, a bathroom, a powder room and
the 3-car garage with laundry facilities. The second floor consists of a master bedroom suite

The applicant has proposed earthtone exterior color combinations for each unit in the following:
Lots 1 & 3: The color and material of the main body of the units will be La Habra Stucco X-50 in
"Crystal White." The roofing material will be Mission "S" Eagle Tiles in the red range (93695).
These units will also have exposed rafters and wooden shutters in dark brown to complement the
Spanish style. Many of the windows and doors will be recessed from 6 inches to 12 inches along the
main elevations, as well as real clay pipe accents and metal rails to accent the windows.
Lots 2 & 4: The color and material of the main body of the units will be La Habra Stucco X-72 in
"Adobe." The roofing material will be Mission "S" Eagle Tiles in the sunrise blend (93645). These
units will also have exposed rafters and wooden shutters in dark brown to complement the Spanish
style. Many of the windows and doors will be recessed from 6 inches to 12 inches along the main
Residential Floor Plans - Four single-family residences are proposed with this development. Floor
plan sizes range from 2,240 - 2,755 square feet of living area with attached 2 and 3-car garages and
two stories. There are two different architectural plans detailed by the following:
Architecture - There are two (2) di fferent residential designs for the proposed project. The applicant
has taken the character of the existing house into consideration in the design of the proposed homes.
The existing house has distinctively Spanish style architecture. Each of the proposed exteriors has
light eatlhtone and whites that are characteristic of Spanish style homes.

Meeting.
Landscaping and Fencing - Each residence will include new landscaping with a combination of
trees, shrubs, lo%v growing flowers and sod. Although the rear yard areas will be individually
landscaped by the property owner, the land will be prepared for landscaping by tine developer. Each
parcel will be equipped with an irrigation system including automatic timers and moisture sensors.
There are currently two coast live oak trees (Quercus agrifolia) on the site. One of the trees has a 26-
inch diameter trunk, a height of 35'-0" and is in excellent health, with no pests or diseases noted.
The second tree is also in excellent health, and has a trunk with a 45-inch diameter and a height of
55'-0". The applicant hired a registered arborist to survey the property, in her report she states, "i
have rated both of the trees "A". The City ofRosemead's designation for an outstanding specinnen-
one that is healthy and vigorous archetype of its species and free of any visible signs of pests or
disease infestation. The trees are magnificent specimens and the larger tree on the north side of the
property may well predate the existing home." The original proposal called for the removal of both
trees, but staff recommended that the development be redesigned to preserve the two mature trees.
A 6-foot high decorative concrete block wall will surround the entire length of the proposed
subdivision. Areas along Earle Avenue and within the required front yard setbacks will be reduced
to a 3-foot high decorative concrete block wall, with 12" square smooth concrete masonry unit
(CMU) pilasters with stucco to match the house spaced at 10'-0" on center, black wrought iron
fencing and smooth concrete cap stones for the pilasters. All existing chain link fencing will be
removed and all existing block walls will be stuccoed to match the new block walls to provide a
consistent look throughout the development. All individual walls separating each unit will also
have a stucco exterior. Another design used to break up the driveway expanse is the stamped
concrete placed at the entryways to all driveways and spaced out to the end of the common driveway.
Neighborhood Character- In comparison to surrounding residences, development on the subject site
would be greater. However, the proposed homes are consistent with the trend in new housing
development in constructing larger homes that maximize lot areas. A similar project consisting of
three units was recently finaled by the Planning Department across the street at 3377 Earle Avenue.
Staff has worked with the developer in designing a project that will create new single-fannily housing
in the City without detracting from the character of the existing surrounding neighborhood. In
addition, adverse impacts to the character of the surrounding neighborhood will be mitigated and
architectural interest is added to the project by varying roof ridgelines, setting the second story
further back than the first, tile roofing and other aesthetically pleasing elements. Overall, staff feels
that the addition of this residential development will increase property values and the general
aesthetics of the neighborhood.

Staffreconunends that the Planning Commission recommend APPROVAL of Tentative Parcel Map
60733 and Conditional Use Permit 04-978 subject to the conditions outlined in Exhibit "A".

CONDITIONS OF APPROVAL

l . TENTATIVE PARCEL MAP 60733 and Conditional Use Permit 04-973 are approved for a
4-lot single-family residential development, to be developed in accordance with the Tentative
Parcel Map marked Exhibit "B" dated September 14, 2004, and the architectural plans
marked Exhibit'B" dated August 19, 2004, and submitted colored elevations and color and
material sample boards. Any revisions to the approved plans must be resubmitted for review
and approval by the Planning Department.
2. Approval of Tentative Parcel Map 60733 and Conditional Use Permit 04-978 shall not take
effect for any purpose until the applicant has filed with the City of Rosemead an affidavit
stating that they are aware of and accept all of the conditions set forth in the letter of
approval and this list of conditions.
3. Tentative Parcel Map 60733 and Conditional Use Permit 04-978 are approved for a two-year
period. Applicant shall make progress towards initiation of proposed use or request an
extension 30 days prior to expiration from the Planning Commission. Otherwise Tentative
Parcel Map 60733 and Conditional Use Permit 04-978 shall become null and void.
4. The applicant shall comply with all Federal, State and local laws relative to the approved use
including the requirements of the Planning, Building, Fire, Sheriff and Health Departments.
5. Building permits will not be issued in connection with any project until such time as all plan
check fees, and all other applicable fees are paid in full.
6. Prior to issuance of building permits, all school fees shall be paid. The applicant shall
provide the City with written verification of compliance from the Unified School District.
7. The hours of construction shall be limited from 7 a.m. to 8 p.m. Monday - Saturday. No
construction shall take place on Sundays or on any legal holidays without prior approval by
the City.
8. Planning staff shall have access to the subject property at any time during construction to
monitor progress.
9. The conditions listed on this Exhibit "A" shall be copied directly onto development
plans submitted to the Planning and Building Departments for review.
10. Occupancy will not be granted until all improvements required by this approval have been
completed, inspected, and approved by the appropriate department(s).
H. Driveways and parking areas shall be surfaced and improved with Portland concrete cement
as shown on Exhibit "B"; and thereafter maintained in good serviceable condition.
12. A wall and fence plan will be required if any perimeter fencing or walls are proposed. The
colors and materials of the proposed fence shall be consistent or compliment the submitted
color and material board and first be approved by the Planning Department prior to
installation (on file as Exhibit B).
13. Prior to issuance of Building permits, a landscape and irrigation plan shall be

submitted to the Planning Department for review, reflecting preliminary approval of
landscape/site plan. commonly referred to as Exhibit B. Irrigation plan shall include
automatic timers and moisture sensors. All landscaping and irrigation shall be
installed and completed prior to final Planning Department approval.
14. A minimum of one coast live oak (Quercus agrifolia) shall be planted on both Lots 3
and 4.
15. A decorative low wall shall be constructed around the existing oak tree on Lot 2 to
prevent any damage from automotive travel.
16. A registered arborist shall be on site for construction monitoring to ensure that no
portion of the tree or its root system is damaged during construction.
17. Any person desiring to remove, cut down, destroy, relocate, prune and/or trim, or
otherwise undertake activities which could inflict damage to an oak tree, as defined in
Section 17.100.030, shall first obtain a tree permit from the city. The pruning and/or
trimming of limbs or branches less than twenty-eight (28) inches in circumference (nine
inches in diameter) shall be exempt from the requirements of this section. (Prior code §
9130.3(A))
18. All ground level mechanical/utility equipment (including meters, back flow preservation
devices, fire valves, A/C condensers, furnaces and other equipment') shall be located away
from public view or adequately screened by landscaping or screening walls so as not to be
seen from the public right-of-way. Said screening shall be approved by the Director of
Planning before installation.
19. No portion of any required front and/or side yards shall be used for storage of any type.
20. There shall be no outside storage of vehicles, vehicle parts, equipment or trailers. All wash
and debris shall be contained within a trash enclosure.
21. All roof top appurtenances and equipment shall adequately be screened from view to the
satisfaction of the Planning Department.
22. The property shall be graded to drain to the street, but in no case shall such drainage be
allowed to sheet flow across public sidewalk. A grading and/or drainage plan shall be
prepared, submitted to and approved by the Building Official, and such grading and drainage
shall take place in accordance with such approved plan.
23. The numbers of the address signs shall be at least 6" tall with a minimum character width of
1/4", contrasting in color and easily visible at driver's level from the street. Materials, colors,
location and size of such address numbers shall be approved by the Director of Planning
prior to installation.
24. Applicant shall obtain a public works permit for all work in or adjacent to the public
right-of-way.
25. Applicant shall install and complete all necessary public improvements, including but not
limited to street, curbs, gutters, sidewalks, handicap ramps, and storm drains, along the entire
street frontage of the development site as required by the Director of Planning.
26. All ground level mechanical/utility equipment (including meters, back flow preservation
devices, fire valves and other equipment) shall be screened by screening walls and/or
landscaping to the satisfaction of the Planning Department.
27. All utilities shall be placed underground includin: faciIIties and wires for the supply and

distribution of electrical energy, telephone, cable television etc. The underground conversion
of these utilities shall consider all future connections to the satisfaction of the Director of
Planning.
28. The dwelling unit shall be provided with water conservation fixtures such as low-flush toilets
and low-flow faucets. The hot water heater and lines shall be insulated. Landscaping
irrigation systems shall be designed for high efficiency and irrigation timers programmed for
maximized water usage.
29. All requirements of the Building and Safety Department and Planning Department shall be
complied with prior to the final approval of the proposed construction.
30. Violation of the conditions of approval may result in citation and/or initiation of revocation
proceedings.
31. Stamped concrete proposed for driveways shall be a medium to dark tone of gray.
32. All 6'-0" block walls that encroach into any required front yard setback shall be
reduced to 4'-0" in height.
33. The Rosemead Planning Commission must approve any changes to the approved plans.
34. Each unit shall be constructed exactly as approved; no as-built plans will be accepted.

Department to ensure that the windows and doors are recessed sufficiently.

CITY ENGINEER'S CONDITIONS OF APPROVAL
GENERAL
1. Details shown on the tentative map are not necessarily approved. Any details that are
inconsistent with requirements of ordinances, general conditions of approval, or City
Engineer's policies must be specifically approved in the final map or improvement plan
approvals.
2. A final parcel map prepared by, or under the direction of a Registered Civil Engineer
authorized to practice land surveying, or a Licensed Land Surveyor, must be processed
through the City Engineer's office prior to being filed with the County Recorder.
3. A preliminary subdivision guarantee is required showing all fee interest holders and
encumbrances. An updated title report shall be provided before the final tract map is
released for filing with the County Recorder.
4. Monumentation of parcel map boundaries, street centerline and lot boundaries is required for
a map based on a field survey.
5. Final parcel map shall be filed with the County Recorder and one (1) mylar copy of filed
map shall be submitted to the City Engineers office. Prior to the release of the final map by
the City, a refundable deposit in the amount of $ 1,000 shall be submitted by the developer to
the City, which will be refunded upon receipt of the mylar copy of the filed map.
6. Comply with all requirements of the Subdivision Map Act.
7. Approval for filing of this land division is contingent upon approval of plans and
specifications mentioned below. If the improvements are not installed prior to the filing of
this division, the developer must submit an Undertaking Agreement and a Faithful
Performance and Labor and Materials Bond in the amount estimated by the City Engineer
guaranteeing the installation of the improvements.
8. The City reserves the right to impose any new plan check and/or permit fees approved by
Citv Council subsequent to tentative approval of this map.
DRAINAGE AND GRADING
9. Prior to the recordation of the final map, grading and drainage plans must be approved to
provide for contributory drainage from adjoining properties as approved by the City
Engineer, including dedication of the necessary easements.
10. A grading and drainage plan must provide for each lot having an independent drainage
system to the public street, to a public drainage facility, or by means of an approved drainage
easement.
It. Historical or existing storm water flow from adjacent lots must be received and directed by
gravity to the street, a public drainage facility, or an approved drainage easement.
12. Developer must comply with the City's storm water ordinance.
ROAD
13. Developer shall prepare a covenant, subject to City Engineer's approval, for ingress and
egress, utility and drainage easement, fire lane, and maintenance of the driveway for Lots 2,
3 and 4.

the public right-of-way to the top of 'Y' or the obstruction shall be relocated.

SUMMARY
Two mature coast live oak trees are located adjacent to the existing home at 3906 Earle
Avenue in Rosemead, California. The developer is proposing to remove the trees as part of
his design of four new single family homes.
BACKGROUND AND ASSIGNMENT
Kamdat Investment, Inc. is in the design phase for new construction at 3609 Earle Avenue in
Rosemead, California (TPN-1 60732). The existing home will be demolished to make way for
four single family homes. The proposed design requires the removal of two mature coast live
oaks (Quercus agrifolia). There is also a mature California sycamore in the front yard. There
are no other oaks on the properly.
I was retained by the property owner/developer, Kamdat Development, to evaluate the trees
and prepare a report in accordance with guidelines set forth by the City of Rosemead Oak
Tree Preservation Ordinance. 1 used the site plan prepared by Tritech Engineering to identify
the location of the two oak trees and numbered them I and 2 on the plan and by way of
aluminum tags on the north sides of the trunks.
I conducted the inspections from the ground and did not climb into the canopies of the trees
or perform any invasive testing for internal decay. Tree dripli/aesl are graphically represented
on the site plan. Photographs accompanying this report illustrate site context, branch
architecture, and tree vigor.

DISCUSSION
I rated both of the subject trees "A", the City of Rosemead's designation for an outstanding
specimen-one that is a healthy and vigorous archetype of its species and free of any visible
signs of pest or disease infestation. The trees are magnificent specimens and the larger tree
on the north side ofthe property may well predate the existing home.
CONCLUSION
Because the applicant wishes to remove the trees, I cannot comment on the relationship of
the trees to the new buildings or provide guidelines for tree preservation and protection
during the construction process. The trees are, in my professional opinion, too large to be
successfully relocated, either on- or off-site.
The Ordinance states that if removal is approved replacement may occur with a "suitable
type, size, number, location, and date of planting based on a ratio of two new trees for every
one removed." There appears to be adequate room for four trees if removal of existing trees
is granted.
