CC - Item 3C - No Trucks Over 3 Tons Signs on Delta Ave11 ~J TO: HONORABLE MAYOR AND MEMBERS ROSEMEAD CITY COUNCIL FROM: ANDY LAZZARETTO, CITY MANAGVR~ DATE: APRIL 19, 2006 RE: REQUEST TO INSTALL "NO TRUCKS OVER 3 TONS" SIGNS ON DELTA AVENUE Los Angeles Department of Public Works, on behalf of local residents, requested that both the County and City post "No Trucks Over 3 Tons" signs on Delta Avenue between Rush Street and San Gabriel Boulevard. Section 10.08.010 of the City of Rosemead's Municipal Code currently prohibits any vehicle exceeding 3 tons on Delta Street as it does on all streets within the City, except for those specifically listed in the Code. Code Section 10.08.010 also provides exceptions to the weight restriction, allowing for the delivery of material and goods to any building or street on any restricted street. This exception is consistent with and required by Section 35701 of the California Vehicle Code. Weight restriction signs are not generally installed on the City's streets; otherwise nearly every street within the City would be posted. However, after taking pubic comment on this matter, the Traffic Commission recommended that the signs be installed on Delta Avenue south of Rush Street. If it is the City Council's choice to install "No Trucks Over 3 Tons" signs on Delta Avenue, one sign will be placed on southbound Delta Avenue at Rush Street and one on northbound Delta Avenue at the City boundary (at Amber Rose Lane). The City's sign maintenance contractor will install the signs. RECOMMENDATION It is recommended that the City Council approve the Traffic Commission's recommendation to install "No Trucks Over 3 Tons" signs on Delta Avenue south of Rush Street. Attachment T~ OS t l.r1 l G 1p'x G 10.0.010 Chapter 10.08 WEIGHT LIMITS AND TRUCK ROUTES Sections: 10.08.010 Maximum gross weight limit. 10.08.020 Maximum gross weight limit on Rosemead Place, Whitmore Street and Driggs Avenue during certain hours. 10.08.010 Maximum gross weight limit. A. Pursuant to the provisions of Section 35701 of the Vehicle Code, no person, corpo- ration or any other organization shall use or operate any commercial vehicle or any vehicle exceeding six thousand (6,000) pounds on or over any street, road or public right-of-way within the city except the following streets which are designated as truck routes: 1. Lower Azusa Road from Rosemead Boulevard to Southern Pacific Railroad right- of-way; 2. Mission Drive from Valley Boulevard to the westerly city boundary; 3. Valley Boulevard from the easterly to the westerly city boundary; 4. Garvey Avenue from the easterly to the westerly city boundary; 5. Temple City Boulevard from the north- erly city boundary (Southern Pacific Railroad) to the San Bernardino Freeway; 6. Walnut Grove Avenue from the norther- ly city boundary (Southern Pacific Railroad) to San Gabriel Boulevard; 7. San Gabriel Boulevard from the Pomona Freeway to Delta Avenue; 8. San Gabriel Boulevard from Hellman Avenue to Potrero Grande Boulevard; 9. Rush Street from San Gabriel Boulevard to Walnut Grove Avenue; 10. Del Mar Avenue between Hellman Avenue and Garvey Avenue. B. The provisions of this section are not applicable with respect to any vehicle which is subject to the provisions of Sections 1031 through 1036 inclusive of the Public Utilities Code. C. This section shall not become effective until signs are erected indicating those streets which are affected by the provisions of this section. D. This section shall not prohibit any com- mercial vehicle coming from an unrestricted street for egress or ingress by truck route to and from the restricted streets as set forth in this section when necessary for the purpose of making pick-ups or delivery of goods, wares or merchandise from and to any building or street located on any restricted street or for the purpose of delivering materials to be used in the actual or bona fide repair, alteration or construction of any building or structure upon a public restricted street for which a building permit has previously been obtained therefore. E. This section shall not apply to any vehi- cle owned by a public utility while necessarily in use in the construction, installation, or repair of any public utilities. F. The provisions of subsection A of this section shall not apply to any state highway. (Prior code § 3305) 194 • • 10.08.020 10.08.020 Maximum gross weight limit on Rosemead Place, Whitmore Street and Driggs Avenue during certain hours. A. The City Council finds and determines that the use of Rosemead Place, Whitmore Street and Driggs Avenue, during the evening and early morning hours by vehicles having a gross weight in excess of six thousand (6,000) pounds impairs the quiet enjoyment of the residential area fronting on those streets at a time when the residents thereof are most in need of peace and quiet. Therefore, the use of vehicles having a gross weight in excess of six thousand (6,000) pounds on Rosemead Place, Whitmore Street and Driggs Avenue during the evening and early morning hours is injuri- ous to the health and welfare of the residents of said streets. B. Pursuant to the provisions of Section 35701 of the Vehicle Code, no person, corpo- ration or any other organization shall use or operate any commercial vehicle or any vehicle exceeding six thousand (6,000) pounds on or over Rosemead Place, Whitmore Street, or Driggs Avenue between the hours of nine p.m. and seven a.m. (Prior code § 3305.1) 195 e,LLLIF'e*kDfA VE4IGI..E LWE §35701 -586- Div. 15 the Terminal Island Freeway, between Willow Street in the City of Long Beach and Terminal Island in the City of Long Beach and the City of Los Angeles, and on the 2.1-mile portion of State Highway Route 1 that is between Blinn Avenue in the City of Los Angeles and Harbor Avenue in the City of Long Beach, if the vehicle, combination, or equipment meets all of the following criteria: (1) The vehicle, combination of vehicles, or mobile equipment is used to transport intermodal cargo containers that are moving in international commerce. (2) The vehicle, combination of vehicles, or mobile equipment, in combination with its load, has a maximum gross weight in excess of the maximum gross weight limit of vehicles and loads specified in this chapter, but does not exceed 95,000 pounds gross vehicle weight. (3) (A) The vehicle, combination of vehicles, or mobile equipment conforms to the axle weight limits specified in Section 35550. (B) The vehicle, combination of vehicles, or mobile equipment conforms to the axle weight limits in Section 36551, except as specified in subparagraph (C). (C) Vehicles, combinations of vehicles, or mobile equipment that impose more than 80,000 pounds total gross weight on the highway by any group of two or more consecutive axles, exceed 60 feet in length between the extremes of any group of two or more consecutive axles, or have more than six axles shall conform to weight limits that shall be determined by the Department of Transportation. (b) The permit issued by the Department of Transportation shall be required to authorize the operation or movement of a vehicle, combination of vehicles, or mobile equipment described in subdivision (a). The permit shall not authorize the movement of hazardous materials or hazardous wastes, as those terms are defined by local, state, and federal law. The following criteria shall be included in the application for the permit: (1) A description of the loads and vehicles to be operated under the permit. (2) An agreement wherein each applicant agrees to be responsible for all injuries to persons and for all damage to real or personal property of the state and others directly caused by or resulting from the operation of the applicant's vehicles or combination of vehicles under the conditions of the permit. The applicant shall agree to hold harmless and indemnify the state and all its agents for all costs or claims arising out of or caused by the movement of vehicles or combination of vehicles under the conditions of the permit. (3) The applicant shall provide proof of financial responsibility that covers the movement of the shipment as described in subdivision (a). The insurance shall meet the minimum requirements established by law. (4) An agreement to carry a copy of the permit in the vehicle at all times and furnish the copy upon request of an employee of the Department of the California Highway Patrol or the Department of Transportation. (5) An agreement to place an indicia, developed by the Department of Transportation, in consultation with the Department of the California Highway Patrol, upon the vehicle identifying it as a vehicle possibly operating under this section. The indicia shall be displayed in the lower right area of the front windshield of the power unit. The Department of Transportation may charge a fee to cover the cost of producing and issuing this indicia. (c) The permit issued pursuant to subdivision (a) shall be valid for one year. The permit may be canceled by the Department of Transportation for any of the following reasons: (1) The failure of the applicant to maintain any of the conditions required pursuant to subdivision (b). (2) The failure of the applicant to maintain a satisfactory rating, as required by Section 34501.12. (3) A determination by the Department of Transportation that there is sufficient cause to cancel the permit because the continued movement of the applicant's vehicles under the permit would jeopardize the safety of the motorists on the roadway or result in undue damage to the highways listed in this section. (d) The Department of Transportation may charge a fee to cover the cost of issuing a permit pursuant to subdivision (a). Amended Sec. 1, Ch. 368, States 1997. Effective January 1, 1998. (a) Any city, or county for a residence district, may, by ordinance, prohibit the use of a street by any commercial vehicle or by any vehicle exceeding a maximum gross weight limit, except with respect to any vehicle which is subject to Sections 1031 to 1036, inclusive, of the Public Utilities Code, and except with respect to vehicles used for the collection and transportation of garbage, rubbish, or refuse using traditionally used routes in San Diego County when the solid waste management plan prepared under Section 66780.1 of the Government Code is amended to designate each traditionally used route used for the purpose of transporting garbage, rubbish, or refuse which intersects with a local or regional arterial circulation route contained within a city or county's traffic circulation element and which provides access to a solid waste disposal site. (b) The ordinance shall not be effective until appropriate signs are erected indicating either the streets affected by the ordinance or the streets not affected, as the local authority determines will best serve to give notice of the ordinance. (c) No ordinance adopted pursuant to this section after November 10, 1969, shall apply to any state highway which is included in the National System of Interstate and Defense Highways, except an ordinance which has been approved by a two-thirds vote of the California Transportation Commission. (d) The solid waste management plan prepared under Section 66780.1 of the Government Code by San Diego County may designate the traditionally used routes. (e) "Traditionally used route," for purposes of this section, means any street used for a period of one year or more as access to or from a solid waste disposal site. Amended Ch. 616, Stats. 1987. The residents, some in the County unincorporated areas and in the City of Rosemead, have requested both the County and City to post truck travel restrictions on Delta Avenue. The request is for "No Trucks Over 3 Tons" on Delta Avenue between San Gabriel Avenue to Rush Street. This covers both unincorporated areas and City areas of Rosemead. Delta Avenue is a 40 bot wide northIsouth roadway with one lane of traffic in each direction. Opposing lanes of traffic are separated by a single yellow skip stripe. There are street sweeping parking restrictions on Delta Avenue. The east side of Delta Avenue is commercial/industrial development and generally multi- family residential on the west side in the City. The prima facie speed limit is 25 mph on Deity Avenue in the City of Rosemead. Pictures of Delta Avenue will be available at the Traffic Commission meeting. Field observation of the intersection was done during the morning hours. During this time, there were no trucks observed traveling on Delta Avenue. Also, there were no trucks parked on the street. The County has indicated that residents are concerned with an increase in truck traffic with the development of Wal-Mart. There are no access driveways to the Wal-Mart development on Delta Avenue. However, there is an access driveway to the Panda Express Corporate offices, which also has access on Walnut Grove Avenue. The installation of "No Trucks Over 3 Tons" on Delta Avenue will require enforcement. APPROVAL OF MINUTES - Tanuary 12, 2006 It was moved by Commissioner Matsdorf, seconded by Commissioner Knapp, and carried unanimously to approve the minutes for January 12, 2006. II. ORAL COMMUNICATIONS FROM THE AUDIENCE - NONE III. OLD BUSINESS - NONE IV. NEW BUSINESS D. REQUEST FOR TRUCK TRAVEL RESTRICTIONS ON DELTA AVENUE SOUTH OF RUSH STREET Deputy Traffic Engineer Itagaki presented the staff report. RECOMMENDATION: Staff had no objection to the installation of "No Trucks Over 3 Tons" on Delta Avenue south of Rush Street to the south City limits. Staff will also contact Panda Express Corporate offices to discuss the possibility of directing truck deliveries to access their site from Walnut Grove Avenue. • • Assistant City Manager Wagner read two letters that were faxed by residents, voicing their opinions regarding this matter. Assistant City Manager Wagner went on to say that Lordon Management contacted the City asking us to notify all the residents in their complex. This was done by the Parking Control Officers on Tuesday and Wednesday. Speaking before the Commission was: Councilman John Tran 2712 N. Del Mar Avenue Rosemead, California 91770 Councilman Tran asked several questions regarding the signs being posted, and recommended that the Rosemead Traffic Commission send a letter to Wal-Mart informing them that the City will be installing these signs and will be strictly enforced. Assistant City Manager Wagner stated that during the mitigation plan and while Wal-Mart is being built, trucks are to avoid using Delta if at all possible. When Wal-Mart is in operation they cannot use Delta to make deliveries, and must use the most direct route or they will be cited. Speaking before the Commission was: Larry Bevington (Saving Our Community) 8372 Rush Street Rosemead, California 91770 Mr. Bevington expressed his disappointment that the residents in the complex were not notified. Mr. Bevington argued that the trucks traveling on Delta was not one of the conditions set in the mitigation plan. He was also upset with the wording of the recommendation by staff. • ! Speaking before the Commission was: Victor Ruiz 9703 Olney Street Rosemead, California 91770 Mr. Ruiz stated that during his term as a Traffic Commissioner, he asked for a study to be done and signs be posted on all residential streets throughout the City regarding no trucks over 3 tons. That study was never done. Mr. Ruiz also stated that he has spoken to a motorcycle officer that has indicated that trucks are not being cited because the judge is dismissing the ticket once it appears in court. Speaking before the Commission was: Yuki Fukumoto 1807 Delta Avenue Rosemead, California 91770 . Ms. Fukumoto was dissatisfied with the way the residents in the complex were contacted for tonight's meeting. Ms. Fukumoto asked where does it say that the trucks can travel on Delta "if necessary". Assistant City Manager Wagner stated that it is part of the mitigation/ monitoring plan during the construction phase of the project. Mr. Bevington requested a copy of the mitigation/ monitoring plan that states these conditions. Speaking before the Commission was: Edward Stepanian 1813 Delta Avenue Rosemead, California 91770 Mr. Stepanian stated that he has encountered two dangerous situations with trucks on Delta in the past two weeks. He also stated that the truck drivers are not good neighbors and have no regard for the residents in the vicinity, and feels that an emergency council meeting should be conducted in order to get these signs installed as soon as possible. • Speaking before the Commission was: Marlene Shinen 8447 Drayer Lane South San Gabriel, California 91770 Ms. Shinen thanked staff for getting the information to her in a timely manner. She went on to inform the Commission of an accident that occurred on Delta, in which the police report states that Delta is considered a highway and does not feel that the City monitors the streets in Rosemead. Ms. Shinen informed the Commission of an incident that she encountered with a truck driver making a delivery on Delta, and is in favor of the signs being installed. Speaking before the Commission was: Jim Clouet 3719 Ivar Avenue Rosemead, California 91770 Mr. Clouet expressed his appreciation to the Commission for allowing this item to be addressed first and for agreeing to write a letter to Wal-Mart regarding the signage being posted and enforced. Mr. Clouet asked if the City has a launch date for the City's website. He feels that this is an excellent form of communication between the City and its residents, by posting "all" agendas on the website. Assistant City Manager Wagner stated that we're hoping to get the website up and running in the next 30 days. Speaking before the Commission was: Caroline Kunioka 8400 Wells Street Rosemead, California 91770 Ms. Kunioka informed the Commission of a man that was killed on a couple of weeks ago on Walnut Grove and Rush. Ms. Kunioka wanted to know if perhaps a certain type of device or trap could be used for truck drivers that continue to use Delta after the signs have been installed, in the event that an officer is not present. • 0 It was moved by Commissioner Knapp, seconded by Commissioner Matsdorf, and carried unanimously to approve the installation of the "No Trucks Over 3 Tons" on Delta Avenue, south of Rush Street to south of City limits. In addition, a letter will be sent to Wal-Mart informing them of the City Council's action and enforcement. Assistant City Manager Wagner informed the audience that this item will go before the City Council on Tuesday, April 25th. Commissioner Matsdorf thanked everyone for coming to the meeting. A. REQUEST FOR LOADING ZONE AT 3301 SAN GABRIEL BOULEVARD Deputy Traffic Engineer Itagaki presented the staff report. RECOMMENDATION: Based on the field review of the location, the available on-street parking in the area and the parking lot for 3301 San Gabriel Boulevard, a white loading/ unloading zone was recommended with a sign identifying a "Loading Zone, Monday - Saturday, 12:00 p.m. to 7:00 p.m." The removal of some existing red curb and the installation of additional red curb is also recommended. It was moved by Commissioner Knapp, seconded by Commissioner Matsdorf, and carried unanimously to approve the Traffic Engineer's recommendation. B. REQUEST FOR ADDITIONAL CROSSING GUARD AT IVAR AVENUE AND NEWBY STREET Deputy Traffic Engineer Itagaki presented the staff report. RECOMMENDATION: The placement of an additional crossing guard at the intersection of Ivar Avenue and Newby Street was not recommended at this time. However, staff will contact the crossing guard to assist them in communicating with the school pedestrians. Speaking before the Commission was: Charles Lyons 4222 Arica Avenue Rosemead, CA 91770 Mr. Lyons was present on behalf of the students and parents of Ivar and Newby Streets and proceeded to use the white board to illustrate his point. The school continues to educate the students and the parents, however, the number of students has increased from 300 to 750, and when the crossing guard is absent, it is a very dangerous situation. If the Commission chooses not to place an additional crossing guard, then perhaps the City could obtain an on-call crossing guard. It was moved by Commissioner Knapp, seconded by Commissioner Quintanilla to approve the Traffic Engineer's recommendation, and to communicate with the current crossing guard and look into other possibilities, such as, temporary signs. Commissioner Matsdorf agrees with the recommendation, but had to abstain her vote because she is an employee of the School District. C. REQUEST FOR ADDITIONAL CROSSING GUARD AT ENCINITA AVENUE AND PITKIN STREET Deputy Traffic Engineer Itagaki presented the staff report. RECOMMENDATION: The placement of an additional crossing guard at the intersection of Encinita Avenue and Pitkin Street was not recommended at this time. However, staff will contact the crossing guard to assist them in communicating with the school pedestrians. Speaking before the Commission was: Charles Lyons 4222 Arica Avenue Rosemead, CA 91770 Mr. Lyons was present on behalf of the students and parents of Encinita Avenue and Pitkin Streets, and proceeded to use the white board to illustrate his point. Mr. Lyons stated that parents are parking over the crosswalk line and the buttons need to be repaired. Mr. Lyons feels that with some enforcement of the red and white areas, this situation could be rectified. It was moved by Commissioner Knapp, seconded by Commissioner Quintanilla to approve the Traffic Engineer's recommendation. In addition, staff will communicate with the current crossing guard, replace the buttons, and have selective enforcement at this location. Commissioner Matsdorf agrees with the recommendation, but had to abstain her vote because she is an employee of the School District. D. REQUEST FOR RED CURB AT 8749 VALLEY BOULEVARD - JIM'S BURGERS Deputy Traffic Engineer Itagaki presented the staff report. RECOMMENDATION: Final recommendation by staff will be made at the Traffic Commission meeting after complete review of the reported accidents is made. Deputy Traffic Engineer Itagaki stated that this is not any different from other locations in the City. Assistant City Manager Wagner stated that he has spoken to the owner of Jim's Burgers and he would not be opposed to the installation of 15 feet of red curb. It was moved by Commissioner Knapp, seconded by Commissioner Matsdorf, and carried unanimously to install 15 feet of red curb, and re-visit this at a later date, sometime in September or October. w 0 V. STAFF REPORTS - NONE VI. COMMISSIONER REPORTS Commissioner Knapp asked the Sheriff's representative if it is standard policy that at a D.U.I. Checkpoint, the female officer speaks to a female driver. The Sheriff's representative said "no", it was pure coincidence. Commissioner Matsdorf asked why the trains are stopping for hours at a time. Mr. Jim Clouet stated that this is a beginning of a pattern, as these trains become 1 - 2 miles long and begin backing up in the East Los Angeles Yard, they're going to sit and idle. Commissioner Knapp asked if the City has received any bids for the construction of the off-ramp at Hellman and Walnut Grove. Assistant City Manager stated that the project has been awarded, and they are awaiting materials. Speaking before the Commission was: Brian Lewin 9442 E. Ralph Street Rosemead, California 91770 Mr. Lewin recommended that the City send the PCO Officers on an unofficial schedule to the various schools that are having problems. Once the message is sent, they will discontinue parking there. VII. ADJOURNMENT There being no further business to come before the Commission, the meeting was adjourned at 9:08 p.m., with 41 people in the audience.
