Staff Recommendation Staff recommends that the City Council grant an entertainment and dance license to Casa Latina Restaurant. ANALYSIS This establishment is a restaurant serving food and alcoholic beverages. The owners wish to allow entertainment and dance for their customers. The hours of operation will be Tuesday through Sunday, 8:00 a.m. to 2:00 a.m. PUBLIC NOTICE PROCESS This item has been noticed through the regular agenda notification process. Any Locked or otherwise secured rooms shall be opened upon demand. Storage areas will be kept locked and accessible to employees only. 3. All licenses, permits, and a copy of these conditions shall be posted where they are fully visible and readable by the public. 4. All licenses and permits shall be valid at all times. 5. All conditions imposed by any licensing authority shall be complied with at all times. All CUP conditions shall be complied with at all times. 6. A person in charge shall be on the premises at all times that the business is open. The person in charge shall be familiar with the laws regulating this establishments. The person in charge shall meet the following qualifications: A. Be at least twenty-one (21) years of age. B. Possess, on their person, a valid DMV issued California driver's license or identification card. C. Be able to communicate effectively with regulatory officials. D. Have the ability to immediately contact an owner. 7. The person in charge shall introduce him/herself to any regulatory official (Sheriff, Fire, Code Enforcement, Etc.) at such time as the official's presence is announced to any employee. The person in charge shall fully cooperate with the official's investigation. 8. All employees shall possess, on their person, a valid DMV issued California driver's license or identification card. 9. GARVEY ROSEMEAD, CA 10. The hours of operation shall be Tuesday through Sunday between 8:00 A.M. of one day and 2:00 A.M. of the following day. The business shall not be open to, or used by the public, between the hours of 2:00 A.M. and the approved hour of opening. 11. No person under twenty-one (21) years of age shall be allowed on the premises during the hours of entertainment, unless accompanied by a parent or legal guardian. 12. There shall be no smoking allowed within the premises. "No Smoking" signs shall be posted throughout the business. 13. The latest security plan and video taping plan, as approved by the Sheriffs Department License Detail, shall not change without the prior approval of the Sheriffs Department License Detail. 14_ The security and taping plans may be reviewed and/or revised by the Sheriffs Department License Detail as needed without approval of the License and Permit Hearing Board. 15. Entertainment shall not be audible to the exterior of the building. 16. The doors on the south side of the building shall be equipped with "alarmed panic style" hardware, and shall be used for emergency ingress and egress only. The south doors shall not be propped open at anytime. All customers shall enter and leave through the northwest entry of the business. 17. Patrons of the business shall not be allowed to loiter around the business, in the parking lot, or on the streets in the area of the business. 18. The parking lot and area around the business shall be kept free of litter. 19. No promoter shall work in this business unless they have a valid business license issued by the City of Rosemead. 22. No advertising for this business, or any promoter used by this business, shall be posted on any public right of way within the City of Rosemead. 23. All laws, codes, and Department of Alcoholic Beverage rules and regulations pertaining to the operation of a restaurant shall be adhered to at all times. 24. All receipts for the purchase and sale of alcoholic beverages and food items shall be maintained in an organized manner, and available, at all times, for inspection by the Sheriffs Department License Detail or City of Rosemead Officials. 25. All graffiti in or around the building shall be removed prior to opening each day. 26. It shall be the responsibility of the person in charge to see that all crimes that occur on the premises are reported to the appropriate law enforcement agency in a timely manner. 27. During the hours of entertainment there shall be no less than the following numbers of uniformed security personnel on duty at the establishment: A. Less than fifty (50) patrons: (1) One guard positioned inside of the building. (2) One guard positioned in the parking lot. B. 50-100 patrons: (1) One guard inside of the building (2) One guard in the parking lot (3) One additional guard where needed. C. 101-150 patrons: (1) Two (2) guards inside the building. (2) One guard in the parking lot. (3) One guard where needed. D. 151-200 patrons: (1) Two (2) guards inside the building. (2) One (1) guard in the parking lot. All security guards shall be uniformed and easily identifiable. 3. All security guards shall possess, on their person, a valid State of California Guard Card and either a California Department of Motor Vehicles I.D. card or driver's license. 4. All security guards shall, at all times, have radio contact with each other. 5. All security guards shall, at all times, cooperate with all regulatory officials. 6. A digital video recording device shall record no less than seven (7) security cameras positioned in and around the business. One camera will be positioned on the front northwest entry. That camera shall record a clear picture of each patrons face. 7. The digital recordings shall be maintained on the premises for a minium of thirty (30) days. The light plan represents a minimum lighting requirement. 3. Dimming devices will not be used on the interior or exterior lights. 4. All lights must be on at all times during hours of operation. No lights may be turned off at any time during hours of operation. 5. No colored light bulbs may be used in the business. (Holiday lights may be used during the holidays along with all of the other lights.) 6. Any non-working light shall be replaced immediately. A supply of light bulbs with the appropriate wattage shall me kept on the premise at all times. Na Date ame Date ATPACHMM D ADMINISTRATIVE HEARING CASA LATINA RESTAURANT 8800 GARVEY AVENUE JULY 25, 2006 The Hearing was opened by the Hearing Officer, Donald J. Wagner, at 10:10 a.m. The Hearing Officer stated that the purpose of the Hearing was to consider an application for an Entertainment License and Dance License for Casa Latina Restaurant. Present were Arlene Cox, Los Angeles County Sheriffs Business License Bureau, Brad Johnson, Planning Director, Lorenzo & Norma Aviles, business owners, David Zavala, translator for owners, and Tinia Celaya, neighbor of business location. Ms. Cox stated that the background investigation by the Sheriffs Department was completed and they . were recommending approval contingent on the 27 conditions. Brad Johnson stated the Conditional Use Permit was approved at the Planning Commission meeting of February 6, 2006. He stated that he needed a landscaping and irrigation plan from the owner. He also stated that temporary banners were only allowed for a certain amount time and that the owners need to submit a plan for the signage. Mr. Johnson stated that according to the ABC license, this establishment needed to sell more food than alcohol. David Zavala stated that he hoped that the City would be understanding with respect to the food/alcohol sells. He stated that the business was just getting started. Ms. Cox stated that if the alcohol sells was more than the food sells, he would need to adjust the selling of alcohol. Mr. Johnson stated that if the kitchen was too small, the owners would need to improve and expand the kitchen area. Tinia Celaya, 2742 N. Muscatel Avenue, stated that she has been a neighbor of the establishment for years. She stated that the lighting situation was the same. The lights were shining into her house. Mr. Wagner stated that the lighting situation would need to be addressed before approval by the City Council at the August 8, 2006 meeting. He suggested that the owners and Ms. Celaya get together to discuss a remedy to the situation. Lorenzo Aviles stated that he thought the lights were already fixed. Mr. Wagner stated that the previous owner had a problem with the lighting situation and this needed to be addressed. The Hearing was closed at 10:25 a.m. Jan Saavedra Business License Clerk
