LAZZARETTO, CITY MANAGER DATE: SEPTEMBER 12, 2006 SUBJECT: APPROVAL OF CASA LATINA ENTERTAINMENT & DANCE LICENSE SUMMARY At the August 22, 2006 City Council meeting, staff was directed to conduct additional research related to the potential approval of an entertainment and dance license for Casa Latina, located at 8800 Garvey Avenue. The new property owners are currently operating the business as a restaurant and would like to expand their operation to include dancing and live entertainment in a nightclub-type atmosphere seven days a week from 11:00 a.m. until 2:00 a.m. Staff Recommendation Staff recommends that the City Council take the following action: Grant an entertainment and dance license to Casa Latina contingent on the owner complying with conditions recommended by the Planning Commission, the Sheriff's Department, and staff. Direct staff to monitor and periodically inspect Casa Latina for a period of six months to ensure compliance with all City codes and regulations. In six months, bring back for City Council review a report detailing staff observations of compliance with City codes and regulations at Casa Latina. ANALYSIS Entertainment & Dance License Overview In order to better understand the issues related to approval of an entertainment and dance license for Casa Latina, staff conducted further review of the application, including an analysis of law enforcement activity at the site over the past two years. It appears that between January 1, 2004 and August 11, 2006, there were 46 recorded calls for service at Casa Latina (Attachment A), the vast majority of which were for nuisance-type issues. The Sheriffs Department has noted on numerous occasions that the environment surrounding a facility, in addition to the type of use at a location, contributes greatly to the level of need for public safety services. APPROVED FOR CITY COUNCIL AGENDA: W"d~' • 0 City Council Meeting September 12, 2006 Page 2 of 3 Based on their review of the proposed new use, the Sheriff's Department has recommended that the City Council approve an entertainment and dance license for Casa Latina only if the owners abide by a list of 27 conditions (Attachment B), institute a security & video taping plan (Attachment C), and put in place an interior & exterior lighting plan (Attachment D). The business owner has gone on the record in writing by accepting the proposed conditions and stating his intent to follow each of the prescribed measures. It should also be noted that the City Council has in the past granted previous owners of the property in discussion an entertainment and dance license contingent on the business operator abiding by a number of public safety mitigation conditions. Property History Casa Latina is a 5,307 square foot facility located on the southeast corner of Garvey and Muscatel and has been operating as a restaurant and nightclub in the City since 1979. Originally, the eating establishment was called "California West," and the Planning Commission approved a CUP on October 1, 1979 permitting the sale of alcoholic beverages at the restaurant. At that time, the City Council also approved an entertainment and dance license for the property. Later, during a second review of the CUP on April 21, 1998 by the Planning Commission, the restaurant name was changed to Casa Latina. The property was sold several years later to another individual, who obtained a CUP transfer from the Planning Commission on December 6, 2004 in order to continuing selling alcoholic beverages. Soon thereafter, the property was sold again. This time, the restaurant name was changed to La Rumba and the Planning Commission approved a transfer of the CUP permitting alcohol sales on May 16, 2005. In addition, the City Council granted an entertainment and dance license for the facility on October 4, 2005. Within a few months, the property was up for sale again, and the current property owner purchased the facility and renamed the restaurant and nightclub Casa Latina. The Planning Commission authorized a transfer of the CUP permitting alcohol sales for the new owner on February 6, 2006, and the owner decided to request from the City Council an entertainment and dance license for the establishment. Administrative Hearing Staff held an administrative hearing to consider the application for an entertainment and dance license for Casa Latina on July 25, 2006 (Attachment E). During the hearing, the owner indicated his desire to operate the facility seven days a week from 11 a.m. until 2 a.m. as a restaurant and nightclub, complete with dancing and live entertainment. • 0 City Council Meeting September 12, 2006 Page 3 of 3 Currently, the owner has authorization to run the establishment as a restaurant and to sell alcohol beverages. However, it was discussed during the hearing that the current State Department of Alcoholic Beverage Control (ABC) license for Casa Latina stipulates that the restaurant must sell more food than alcohol. In addition, staff noted during the hearing proceedings that the kitchen at Casa Latina appears to be too small to effectively serve a 5,307 square foot restaurant, and that upgrades to the kitchen facility may have to be made. COMMISSION REVIEW The Planning Commission approved Conditional Use Permit 06-1047 on February 6, 2006, authorizing the transfer of an existing on-sale Type 47 ABC license in conjunction with a bona fide eating establishment. Na Date j ame Date 9 0 ATTACHMENT E ADMINISTRATIVE HEARING CASA LATINA RESTAURANT 8800 GARVEY AVENUE JULY 25, 2006 The Hearing was opened by the Hearing Officer, Donald J. Wagner, at 10:10 a.m. The Hearing Officer stated that the purpose of the Hearing was to consider an application for an Entertainment License and Dance License for Casa Latina Restaurant. Present were Arlene Cox, Los Angeles County Sheriffs Business License Bureau, Brad Johnson, Planning Director, Lorenzo & Nonna Aviles, business owners, David Zavala; translator for owners, and Tinia Celaya, neighbor of business location. Ms. Cox stated that the background investigation by the Sheriffs Department was completed and they . were recommending approval contingent on the 27 conditions. Brad Johnson stated the Conditional Use Permit was approved at the Planning Commission meeting of February 6, 2006. He stated that he needed a landscaping and irrigation plan from the owner. He also stated that temporary banners were only allowed for a certain amount time and that the owners need to submit a plan for the signage. Mr. Johnson stated that according to the ABC license, this establishment needed to sell more food than alcohol. David Zavala stated that he hoped that the City would be understanding with respect to the food/alcohol sells. He stated that the business was just getting started. Ms. Cox stated that if the alcohol sells was more than the food sells, he would need to adjust the selling of alcohol. Mr. Johnson stated that if the kitchen Nvas too small, the owners would need to improve and expand the kitchen area. Tinia Celaya, 2742 N. Muscatel Avenue, stated that she has been a neighbor of the establishment for years. She stated that the lighting situation was the same. The lights were shining into her house. Mr. Wagner stated that the lighting situation would need to be addressed before approval by the City Council at the August 8, 2006 meeting. He suggested that the owners and Ms. Celaya get together to discuss a remedv to the situation. Lorenzo Aviles stated that he thought the lights were already fixed.
