RESOLUTION NO. 91-58
A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF ROSEMEAD AFFIRMING THE DENIAL OF
CONDITIONAL USE PERMIT 91-529 TO
ESTABLISH AND OPERATE A PRIVATE PARKING
LOT AT 9203 STEELE.STREET, ROSEMEAD.
THE CITY COUNCIL OF THE CITY OF ROSEMEAD DOES HEREBY
RESOLVE AS FOLLOWS:
Section 1. The City Council finds, determines and
declares as follows:
a. An application to establish and operate a private parking
lot in the CBD zone at 9203 Steele Street for a future new
restaurant conversion located in Valley Hart Plaza was duly
filed by Intertrust Development; and
b. A public hearing was duly noticed and conducted before the
Planning Commission on July 1, 1991, and continued to July
15, 1991 and August 19, 1991. ,
C. The Planning Commission denied the application, by a split
vote, by the adoption of its Resolution No. 91-40; and
c. The applicant filed a timely appeal to the decision of the
Planning Commission; and
e. The City Council conducted a duly noticed public hearing on
said application on October 8, 1991.
Section 2. Concerning the merits of the application,
the City Council finds:
a. That the establishment, maintenance, or operation of the use
so applied for will, under the circumstances of the
particular case, be detrimental to the health, safety,
peace, morals, or comfort or general welfare of persons
residing or working in the neighborhood thereof and be
detrimental or injurious to the property and improvements in
the neighborhood or to the general welfare of the City.
b. That the applicant has not sustained the burden of proof
based upon a demonstrated need for the request.
C. That the establishment will be detrimental or injurious to
the property and improvements in the neighborhood or to the
general welfare of the City.
d. That the applicant has not sustained the burden of proof
that nearby residential zones will not be detrimentally
affected.
Section 3. Based on the aforementioned findings, the
City Council hereby denies the application for Conditional Use Permit
91-529.
Section 4. The City Council finds that based upon the
significant adverse effect, identified herein, the City Council
denies Conditional Use Permit No. 91-529 pursuant to Section 9181.1
of the Rosemead Municipal Code.

Section 5. The City Clerk shall certify to the
adoption of this resolution.and shall transmit a copy thereof to the
appellant applicant.
