CC - Item 2A - Declaring the Results for the Special Election of September 19 2006RESOLUTION NO. 2006-28 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ROSEMEAD, CALIFORNIA, RECITING THE FACT OF THE SPECIAL MUNICIPAL ELECTION HELD ON SEPTEMBER 19, 2006, DECLARING THE RESULT AND SUCH OTHER MATTERS AS PROVIDED BY LAW WHEREAS, a Special Municipal Election was held and conducted in the City of Rosemead, California, on Tuesday, September 19, 2006, as required by law; and WHEREAS, notice of the election was given in time, form and manner as provided by law; that voting precincts were properly established; that election officers were appointed and that in all respects the election was held and conducted and the votes were cast, received and canvassed and the returns made and declared in time, form and manner as required by the provisions of the Elections Code of the State of California for the holding of elections in general law cities; and WHEREAS, the City Clerk canvassed the returns of the election and has certified the results to this City Council, the results are received, attached and made a part hereof as "Exhibit A". NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ROSEMEAD, CALIFORNIA, DOES RESOLVE, DECLARE, DETERMINE AND ORDER AS FOLLOWS: SECTION 1. The whole number of ballots cast in the precincts, except absent voter ballots and provisional ballots, was 2,485. The whole number of absent voter ballots cast in the City was 2,020; the whole number of provisional ballots cast in the City was 205, making a combined total of 4,710 ballots cast in the City. SECTION 2. The voters of the City of Rosemead voted on the following matters: 1. Shall Jay Imperial be recalled (removed) from the office of City Councilmember? 2. For City Councilmember to succeed Jay Imperial if he is recalled Term Ending: March 2007 Polly Low • 3. Shall Gary Taylor be recalled (removed) from the office of City Councilmember? 4. For City Councilmember to succeed Gary Taylor if he is recalled Term Ending: March 2007 Victor Ruiz Jim Clouet SECTION 3. That the number of votes given at each precinct and the number of votes given in the City for and against the measures and for the persons seeking to replace the councilmembers if the measure had been successful were as listed in Exhibit "A" attached hereto. SECTION 4. The City Council does declare and determine that, as a result of the election, a majority of the voters voting on the measures relating to the recall of Councilmember Jay Imperial and Councilmember Gary Taylor did not vote in favor of it, and that the measures were not carried, and shall not be deemed adopted and ratified. SECTION 5. The City Clerk shall enter on the records of the City Council of the City, a statement of the result of the election, showing: (1) The whole number of votes cast in the City; (2) The measures voted upon; (3) The names of the persons voted for to replace the councilmembers if the measures had been successful; (4) For which council seat each person was voted for; (5) The number of votes given at each precinct for and against each measure and for each person seeking to replace the councilmember if that measure had been successful; and (6) The total number of votes for and against each measure and for each person seeking to replace the councilmember if that measure had been successful. SECTION 6. The City Clerk shall immediately make and deliver the necessary certifications of the results of this election and shall deliver such certifications in the manner required by law. SECTION 7. That the City Clerk shall certify to the passage and adoption of this resolution and enter it into the book of original resolutions. PASSED, APPROVED AND ADOPTED ON OCTOBER 10, 2006.
