Public Hearing on General Plan Amendment 23-01 and Zone Change 23-01 — Housing Element Rezone Efforts The 2021-2029 Housing Element was adopted by the Rosemead City Council on January 11, 2022, and certified by the California Department of Housing and Community Development on August 1, 2022. The Housing Element sets forth goals, policies and programs that address future housing needs for all income levels over a planning period of 2021-2029 and coincides with the Regional Housing Needs Assessment (RHNA), a unit count established by State Housing Law. During the Housing Element process, the City assessed a number of sites in its Sites Inventory that would be able to accommodate the City's allocated RHNA of 4,612 units. With units entitled and under review, as well as anticipated ADUs, the City has adequate capacity for its RHNA units. However, to further accommodate for the City's RHNA numbers and to comply with SB 166 (no net loss), the City identified ten candidate sites to be rezoned (Housing Element Rezoning Efforts). The rezoned sites will meet the requirements of Government Code §65583.2, including but not limited to a minimum density of 20 units per acre, minimum site size to permit at least 16 units on site, and zoned to allow ownership and rental housing by -right in which at least 20 percent of the units are affordable to lower income households. 2 Rosemead City Council& Successor Agency to the Community Development Commission Regular Joint Meeting Agenda December 10, 2024 General Plan Amendment 23-01 and Zone Change 23-01 include changes to the City's General Plan and Zoning Map to implement the City's certified Housing Element, which is a policy decision and administrative in nature. No development projects are proposed on any of the ten candidate sites as partofthe Housing Element Rezoning Efforts. Recommendation: That the City Council take the following actions: 1. Conduct a public hearing and receive public testimony; and 2. Adopt City Council Resolution No. 2024-65, entitled: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ROSEMEAD, COUNTY OF LOS ANGELES, STATE OF CALIFORNIA, APPROVING GENERAL PLAN AMENDMENT 23-01, AMENDING THE GENERAL PLAN LAND USE DESIGNATION MAP (FIGURE 2-1) TO IMPLEMENT THE HOUSING ELEMENT REZONING EFFORTS FOR THE 2021- 2029 PLANNING PERIOD, and 3. B. Minutes Recommendation: That the City Council approve the special meeting minutes of November 12, 2024. C. Extension of Additional Operational Funding Support to the Volunteers in Defense of Animals (VIDA) for Animal Shelter and Care Services Volunteers in Defense of Animals (VIDA) plays a critical role in ensuring the well- being of abandoned, stray, and surrendered animals, providing animals with shelter, medical care, and adoption services. hi the past few years, VIDA has experienced a significant increase in costs associated with animal care, staffing, and facility maintenance and decrease in pet adoptions. The proposed extension of operational funding support for the calendar year 2025 would enable VIDA to avoid closure. The Public Safety Department continues to be pleased with the services that VIDA provides. Therefore, staff is recommending that the City Council approve the extension of the additional operational funding support totaling $3,000 per month and not -to -exceed $36,000 for calendar year from January 1, 2025 — December 31, 2025, to ensure the shelter's continued operation and quality care to animals. Recommendation: That the City Council authorize the City Manager to execute the Second Amendment to the Agreement with Volunteers in Defense of Animals on behalf of the City for the additional operational funding support totaling $3,000 per month and not -to -exceed $36,000 for calendar year from January 1, 2025 — December 31, 2025. D. 2025 City Council Meeting Schedule City Council meetings are scheduled for the second and fourth Tuesday of each month at 7:00 p.m. In the past, the City Council has canceled the second meetings in August (for summer break), November (for Thanksgiving), and December (for Christmas). Attached is the proposed meeting schedule for the 2025 calendar year. Adopting this schedule will help the City Council, staff, and the community plan their schedules in advance. The City Council has the discretion to add, modify, or cancel meetings as needed. 4 Rosemead City Council& Successor Agency to the Community Development Commission Regular Joint Meeting Agenda December 10, 2024 In addition, Veterans Day falls on Tuesday, November 11, 2025, which coincides with a regular City Council meeting day. As Veterans Day is a recognized holiday, the City Council has the option to either reschedule the meeting as a special meeting on a different day or cancel it altogether. The proposed options will be presented to the City Council for consideration at a later date. Recommendation: That City Council adopt a City Council meeting schedule for the 2025 calendar year. E. Approval of List of Proclamations for Calendar Year 2025 At the end of the calendar year, a list of proclamations is approved for the following year. For the City Council's consideration in the staff report is the proposed list of proclamations. Recommendation: That the City Council approve the 2025 List of Proclamations. F. Adopt Resolution No. 2024-66 to Receive and File the Annual Report on Development Impact Fees for Fiscal Year Ended June 30, 2024 In accordance with Section 66006 of California Government Code, the City is required to annually report on the status of Development Impact Fees, including the collection of revenue and expenditure of these funds, within 180 days after the end of the fiscal year. This report summarizes the required financial information for Fiscal Year 2023-24. Recommendation: That the City Council receive and file the Annual Report of Development Impact Fees for FY 2023-24 and adopt Resolution No. 2024-66, entitled: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ROSEMEAD, CALIFORNIA, REGARDING THE ANNUAL REPORT ON DEVELOPMENT IMPACT FEES AS OF JUNE 30, 2024 G. ROPS SUBMITTAL — JULY 2025 THROUGH JUNE 2026 The Department of Finance (DOE) requires the Recognized Obligation Payment Schedule (ROPS) for the period July 1, 2025 through June 30, 2026 be submitted to the DOE by February 1, 2025. Prior to that, the ROPS must be reviewed and approved by the Los Angeles County Consolidated Oversight Board. The deadline to submit the ROPS to the Oversight Board is December 13, 2024. Recommendation: That the Rosemead Successor Agency Board direct staff to submit the ROPS to the Los Angeles County Consolidated Oversight Board and approve and adopt Successor Agency Resolution No. 2024-01 SA, entitled: 5 Rosemead City Council& Successor Agency to the Community Development Commission Regular Joint Meeting Agenda December 10, 2024 A RESOLUTION OF THE SUCCESSOR AGENCY TO THE ROSEMEAD COMMUNITY DEVELOPMENT COMMISSION APPROVING THE RECOGNIZED OBLIGATION PAYMENT SCHEDULES FOR THE PERIOD OF JULY 1, 2025 THROUGH JUNE 30, 2026 H. Proposed 2025 State and Federal Legislative Platform In recent years, a Legislative Platform ("Platform") was developed to provide a streamlined process for responding to legislative proposals that may impact the City. The proposed Platform identifies the fundamental legislative issues deemed critical to the City, and upon Council approval, would allow Staff to efficiently respond to legislative items. Staff will utilize the Platform as a guideline for requests in support, against, or neutral positions of a legislative proposal. However, legislative support requiring Resolutions or important and unique issues would continue to be taken to the Council for formal consideration and adoption. At the Legislative Committee meeting held on Monday, November 18, 2024, Staff received direction to prepare and present a 2025 Platform to the City Council. The content in the proposed Platform has significant revisions from previous years. The changes are based on efforts from the legislative committee and the City's Strategic Plan. The City Council may add, remove, or modify items within the adopted Platform throughout the year. The Legislative Platform will also provide staff with the ability to proactively manage the City's legislative positions and respond to issues that may significantly impact the City and are within the City's purview. Recommendation: That the City Council adopt the proposed 2025 State and Federal Legislative Platform. L Citywide Striping Maintenance Services - Award of Professional Service Agreement The City of Rosemead currently has a need to address the maintenance of roadway striping throughoutthe City. Roadway striping deteriorates overtime due to wear and tear from motorist traffic and adverse weather conditions, causing it to fade and become difficult to see, especially at night, as it loses its luminosity. To address the issue, staff has solicited proposals from contractors to perform annual citywide roadway striping maintenance services. The selected contractor will work closely with Public Services staff to develop a comprehensive schedule for citywide striping. To ensure the visual integrity of pavement markings throughout the City, staff recommends entering into a maintenance agreement covering annual citywide roadway striping services for a 3 -year term. A Request for Proposals (RFPs) was released on August 27th, 2024. Staff has conducted a comprehensive review of the three proposals received. Based on the evaluation of the proposals, staff is recommending Superior Pavement Markings, Inc. as the selected contractor. If approved, the city will enter into a Professional Services Agreement (PSA) for a not - 6 Rosemead City Council& Successor Agency to the Community Development Commission Regular Joint Meeting Agenda December 10, 2024 to -exceed contract amount of $75,000 per fiscal year through June 30, 2027. Recommendation: That the City Council authorize the City Manager to execute a Professional Service Agreement with Superior Pavement Markings, for a total amount, not -to -exceed $75,000.00 per fiscal year through June 30, 2027. J. Fiscal Year 2024-2025 Concrete Replacement Project No. 24009 — Award of Construction Contract As part of the City's Fiscal Year 2024-2025 Capital Improvement Program, the City Council approved the annual Sidewalk Replacement Project. The Project consists of removal and replacement of existing damaged concrete sidewalk, damaged curb and gutter, noncompliant ADA curb ramps, damaged concrete crosswalk headers and removal and replacement of existing trees that have caused damage to concrete infrastructure within the City's right-of-way. On December 4, 2024, the City received six (6) bids. Based on staffs comprehensive bid analysis, the bid submitted by CT&T Concrete Paving in the amount of $354,988.25, is determined to be the lowest responsive bid. Recommendation: That the City Council take the following actions: 1. Approve the plans and specifications for the FY 24-25 Concrete Replacement Project No. 24009; and 2. Authorize the City Manager to execute a construction contract with CT&T Concrete Paving, Inc. in the amount of $354,988.25. In addition, authorize an amount of $35,498.83 (10%) as a contingency to cover the cost of unforeseen construction expenses, for atotal construction budget of $390,487.08 K. Strathmore Avenue and Virginia Street Roadway Rehabilitation —Project No. 21851 Award of Construction Contract In April 2024 roadway depressions along Strathmore Avenue and Virginia Street were reported to the Public Works Engineering Division. Staff conducted a comprehensive review of nearby utilities with the aim of determining the cause of the roadway depressions. The utility agencies conducted reviews of their underground utilities and confirmed that there were no water leaks, sewer leaks, or storm drain deficiencies that could be causing the roadway depressions. Staff then initiated a Geotechnical review of the roadway at the intersection of Strathmore Avenue and Virginia Street to fully understand the cause of the depressions. The result of the Geotechnical report concluded that the roadway depressions can be attributed to poor trench compaction when a storm drain was installed along Virginia Street onto Strathmore Avenue in 2007. Based on the recommendations provided in the Geotechnical report, Staff prepared construction bid documents that specify the removal of loose backfill material to a depth of 4 feet, this repair is crucial to ensure proper soil compaction along the roadway segment to prevent the development of 7 Rosemead City Council& Successor Agency to the Community Development Commission Regular Joint Meeting Agenda December 10, 2024 roadway depressions that may occur once repairs are completed. The project was not included as a part of the City's Fiscal Year 2024-25 Capital Improvement Program, however, due to the nature of the roadway conditions potentially becoming worse during the upcoming wet season, Staff is recommending a new appropriation for the project in the amount of $273,480.00 for this critical roadway repair. On December 4, 2024, the City received five (5) bids. Based on staff's comprehensive bid analysis, the bid submitted by Terra Pave, Inc. in the amount of $ 227,900.00, is determined to be the lowest responsive bid. Recommendation: That the City Council take the following actions: 1. Approve the plans and specifications for the Strathmore Avenue and Virginia Street Roadway Rehabilitation - Project No. 21851; and 2. Authorize the City Manager to execute a construction contract with Terra Pave, Inc. in the amount of $227,900.00. In addition, authorize an amount of $45,580.00 (20% of base bid) to include contingency to cover the cost of unforeseen construction expenses and project management for a total construction budget of $273,480.00 and adopt Resolution No. 2024-70, entitled: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ROSEMEAD, CALIFORNIA, TO AMEND THE FISCAL YEAR 2024-25 CAPITAL IMPROVEMENT PROGRAM BUDGET AND APPROPRIATE NEW FUNDS FOR THE STRATHMORE AVENUE AND VIRGINIA STREET ROADWAY REHABILITATION (PROJECT NO. 2185 1) L. Approval of Traffic Improvements Along Fern Avenue, between Del Mar Avenue and New Avenue At the November 7, 2024, Traffic Commission Meeting, staff presented recommendations and options for traffic improvements along Fern Avenue between Del Mar Avenue and New Avenue. After a thorough review of existing field and traffic conditions and per the guidelines in the California Manual on Uniform Traffic Control Devices, California Vehicle Code, it was determined that the segment of Fern Avenue adjacent to the school frontage of Arlene Bitely Elementary does not meet the minimum requirements for the installation of a midblock crosswalk. While it was observed that some pedestrians are crossing in the area, there were not enough student age pedestrians crossing Fern Avenue midblock to warrant the installation of a crosswalk at this time. However, it was determined that Fern Avenue, from New Avenue to Del Mar Avenue would benefit from the installation of various traffic calming measures around Arlene Bitely Elementary school such as new signage and striping. It was also determined that the segment of Fern Avenue between New Avenue and Jackson Avenue may qualify for speed humps, but it was not considered in the recommendations as there is not an official speed hump policy for the City. The Traffic Commission approved the staff recommendations for the area as shown on the "Installation Exhibit" in Attachment B. Public Works Field Services staff will complete all the recommended items. 8 Rosemead City Council& Successor Agency to the Community Development Commission Regular Joint Meeting Agenda December 10, 2024 Recommendation: That the City Council authorize the approval of the Traffic Commission recommendations for traffic calming measures along Fern Avenue between Del Mar Avenue and New Avenue. M. Approval of Undertaking Agreement for Tract Map No. 63609 For 8440-8446 Dorothy Street Tract Map No. 63609 is being submitted for consideration and approval along with an Undertaking Agreement to guarantee construction of public improvements subsequent to the recordation of the tract map. Recommendation: That the City Council approve Tract Map No. 63609 and the Undertaking Agreement and direct the City Clerk to arrange for the recordation of the map. 5. MATTERS FROM CITY MANAGER & STAFF A. Ordinance Amending Chapter 3.24 (Purchasing System) And Amending Chapter 3.28 (Public Works Bidding Procedure) to the Rosemead Municipal Code, and Approve Resolution No. 2024-67, Adopting the California Uniform Public Contracting Cost Accounting Act Staff is recommending the City Council adopt an ordinance amending and restating both Chapter 3.24 (Purchasing System) and Chapter 3.28 (Public Works Bidding Procedure) and adopting other conforming resolutions. Recommendation: That the City Council take the following actions: 1. Move to waive further reading and Introduce Ordinance No. 1025, entitled; AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ROSEMEAD, CALIFORNIA, AMENDING ROSEMEAD MUNICIPAL CHAPTER 3.24 (PURCHASING SYSTEM), AMENDING CHAPTER 3.28 (PUBLIC PROJECT BIDDING PROCEDURES) TO PROVIDE INFORMAL BIDDING PROCEDURES UNDER THE UNIFORM PUBLIC CONSTRUCTION COST ACCOUNTING ACT (SECTION 22000, ET SEQ. OF THE PUBLIC CONTRACT CODE) AND OTHER RELATED ACTIONS; 2. Set a date for a second reading and adoption of Ordinance No. 1025; and 9 Rosemead City Council& Successor Agency to the Community Development Commission Regular Joint Meeting Agenda December 10, 2024 3. Approve Resolution No. 2024-67, entitled: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ROSEMEAD ADOPTING UNIFORM PUBLIC CONSTRUCTION COST ACCOUNTING ACT PROCEDURES; and 4. Receive and file Administrative Policy 20-01 Purchasing Policy and Procedures Manual. B. Award of Contract for Professional Information Technology Management Services The City of Rosemead contracted information technology ("IT") services with Max Power Technology, LLC ("Max Power") in December 2019. Their contract is set to expire on December 10, 2024. A competitive bid process was conducted, and eleven (11) qualified proposals were received. Based on a review of all proposals, staff is recommending the City Council authorize the City Manager to execute aProfessional Services Agreement ("Agreement') with Acorn Technology Services ("Acorn Technology") for a 3 -year contract in the amount of $431,820 through November 22, 2027, with the option for up to two one-year extensions. Recommendation: That the City Council authorize the City Manager to execute a 3 -year Professional Services Agreement in the amount of $431,820 through November 12, 2027, with Acorn Technology Services for Information Technology Management Services, including an option to renew for two one-year extensions. 6.
