A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ROSEMEAD APPROVING PARCEL MAP NO. 17240
AND UPHOLDING THE DECISION OF THE PLANNING
COMMISSION (3037 PROSPECT AVENUE)
THE CITY COUNCIL OF THE CITY OF ROSEMEAD RESOLVES AS
FOLLOWS:
SECTION 1. The City Council finds, determines and declares:
a. An application for a parcel map requesting a one-
lot subdivision into three separate.parcels for
property located at 3037 Prospect Avenue and more
specifically described as:
City of Rosemead, County of Los Angeles, State of
California, being "a subdivision of a portion of
lot 8, block 2 of subdivision of the Garvey Ranch
as per map recorded in book 52, pages.43 and 44 of
miscellaneous records of said County.
b. That the Planning Commission by its Resolution 85-37
approved Parcel Map No. 17240; and
c. That LeRoy F. Young and Cleo D. Young duly filed
an appeal to the Planning Commission's approval;
and
d. That on November 26, 1985 the City Council conducted
a_duly_noticed Public Hearing on the appeal.
SECTION 2. The City Council hereby denies the appeal and
approves Parcel Map No. 17240 based upon the following findings:
a. The proposed map is consistent with the applicable
General Plan of the City of Rosemead.
b. The design of the proposed subdivision and improve-
ments are consistent with the applicable General
Plan. There is no specific plan.
C. The site is physically suitable for the type of
development.
d. The site is suited for the proposed density of
development.
e. The design of the subdivision will not conflict
with public easements.
f. The design and proposed improvements of the sub-
division will have no adverse environmental effects
on fish, wildlife or their habitat, or cause any
public health problems. A Negative Declaration
was prepared and adopted in compliance with Resolu-
tion 79-77, CEQA, and guidelines for the implemen-
tation of CEQA.
g. Discharge of wastes from the proposed subdivision
will not result in the violation of existing re-
quirements as prescribed by the California Regional
Water Board.
SECTION 3. Parcel Map No. 17240 is hereby approved subject
to the conditions contained in Exhibit "A" attached hereto and
incorporated herein by this reference.
SECTION 4. The City Clerk shall certify to the adoption of
this Resolution.

CONDITIONS OF APPROVAL:
1. Apolicant shall comply with all conditions as set forth in the
Citv Engineer's Report dated 9-13-85, and L.A. County Fire Department
Report dated 8-20-95.
2. A covenant shall be prepared and approved by the City Attorney
assuring that the private, common driveway shall be continually
maintained and that cost associated with such maintenance shall
be equally shared by lots 2 and 3 in accordance ✓ith Section
9104.21 I, 5(q). This covenant shall be recorded with the final
parcel mao.
3. The driveway to serve lots 2 & 3 shall be constructed of 2" AC
over 3" base.
4. The driveway for lot 1 shall take access from Prospect.
5. All garage setbacks shall be 25' from the property line.
6. All utilities shall be underground.
7. The interior oroperty line of the newly created lots, and where
designated by the Director of Planning, the perimeter property
line, shall be fenced with a six foot (6') high masonry or wooden
fence. If a wooden fence is installed the fence shall be supported
by steel posts set in concrete. .
8. A sidewalk shall be installed along lot 1.
9. Conditions 3,7,& 8 referencing on site improvements shall be noticed
on the covenant and recorded concurrently.
10. All drainage shall be natural and to Prospect Street.
11. A covenant restricting all future land owners to only a one single
family dwelling unit per lot shall be recorded concurrently with

12. That the driveway for parcel 1 shall be separated by at least 20
feet from the driveway for parcel 2 & 3.
13. That all existing structures shall be removed before construction.
14. The applicants shall sign a notarized affidavit agreeing to the
above conditions.
