A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF ROSEMEAD DENYING CONDITIONAL USE
PERMIT 88-413 FOR THE CONDUCT OF A GARMENT
MANUFACTURING BUSINESS AT 8909 E. GARVEY
AVENUE #B-4
THE CITY COUNCIL OF THE CITY OF ROSEMEAD DOES HEREBY
RESOLVE AS FOLLOWS:
Section 1. The City Council finds, determines and declares as follows:
A. An application authorizing the operation of a garment manufacturing business
in the M-1 Zone, at 8909 E. Garvey Avenue, #13-4, was duly filed by Nga Giang Lam;
and
B. The Planning Commission conducted a duly noticed public hearing on said
application on June 20, 1988; and
C. The Planning Commission denied the application, by a unanimous vote, by the
adoption of its Resolution No. 88-47; and
D. The applicant, through legal counsel Robert Leff, filed a timely appeal to the
decision of the Planning Commission; and
E. The City Council conducted a duly noticed public hearing on said application
on July 26, 1988.
Section 2. Concerning the merits of the application, the City Council finds:
A. That the establishment, maintenance, or operation of the use applied for will,
under the circumstances of the particular case, be detrimental to the health, safety,
peace, morals, comfort or general welfare of persons residing or working in the
neighborhood thereof and will also be detrimental or injurious to the property and
improvements in the neighborhood or to the general welfare of the city. This finding is
made specifically on the basis that the applicant did not demonstrate compliance with
the parking requirements for such a business.
B. That the applicant has failed to sustain his burden of proof as to compliance
with the City's parking requirements for garment manufacturing uses. Further, that the
applicant has not requested a variance from the City's parking requirements for garment
manufacturing businesses.
C. That the establishment of additional garment manufacturing businesses, at this
site, without compliance with the parking requirements, would be detrimental or
injurious to the property and improvements in the neighborhood or to the general
welfare of the City.

Section 3. Based upon the foregoing findings, the City Council hereby denies the
application for Conditional Use Permit 88-413.
Section 4. The City Clerk shall certify to the adoption of this Resolution and
shall transmit a copy thereof to the applicant and his attorney of record.
