RESOLUTION NO. 88-44
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
ROSEMEAD AMENDING THE GENERAL PLAN FROM MEDIUM
DENSITY RESIDENTIAL TO INDUSTRIAL/COMMERCIAL FOR
PROPERTY LOCATED AT 2746 MUSCATEL AVENUE.
THE CITY COUNCIL OF THE CITY OF ROSEMEAD DOES HEREBY RESOLVE AS
FOLLOWS:
Section 1. The City Council hereby finds and determines that a
general plan amendment was duly filed by Dah-Jin Huang, requesting an amendment
to the General Plan from Medium Density Residential to Industrial/Commercial,
for property located at 2746 Muscatel Avenue; or more specifically identified
within Exhibit "A", attached hereto; and that a public hearing was duly
scheduled for August 9, 1988, at 8:00 p.m., in the Council Chambers of Rosemead
City Hall, 8838 Valley Boulevard, Rosemead, California; and that notice of
time, date, place and purpose of the aforesaid hearing was duly given according
to law; and that a public hearing was duly conducted at the aforementioned time
and place.
Section 2. The Planning Commission of the City of Rosemead
conducted a duly noticed public hearing on July 18, 1988 to consider the
subject General Plan Amendment; and after consideration of public testimony did
reach findings and resolved to recommend approval of the General Plan Amendment
to the City Council as contained in Planning Commission Resolution 88-60.
Section 3. The City Council further finds that the General Plan
calls for this area to be Medium Density Residential; however, the existing
development of the property is a parking lot which serves the commercial
establishments on Garvey Avenue. This causes an inconsistency between the
General Plan designation and the existing use. Therefore, it appears
reasonable to recommend that the Land Use Element of the General Plan be
amended to Industrial/Commercial.
Section 4. The City Council hereby finds that amending the Land
Use Element of the General Plan from Medium Density Residential to
Industrial/Commercial, as outlined above, will not have a significant adverse
effect on the environment.
Section 5. The City Council further finds that a Negative
Declaration was prepared in compliance with the California Environmental
Quality Act (CEQA), the guidelines for the implementation of CEQA, and Rosemead
Resolution 75-28.
NOW, THEREFORE, BE IT RESOLVED that the City Council hereby
adopted the aforementioned amendments to the General Plan and the City Clerk
shall certify to the adoption of this Resolution.
Section '6. That certain property located in the City of Rosemead
and more particularly described on Exhibit "A" attached hereto and incorporated
herein by this reference is hereby designated as Industrial/Commercial within
the General Plan.
Section 7. The General Plan of the City of Rosemead is hereby
amended by adding the additional General Plan designation described in Section
1 hereof, and said map shall have noted thereon, "Amended on August 23, 1988."
Section 8. The City Clerk is directed to enter the date of
adoption of this Resolution in the appropriate space of Section 7 hereinabove.
Section 9. The City Clerk shall certify to the adoption of this
Resolution and shall transmit a copy of said R olution to the Planning
Department to allow for changing of the official map as descr~ileed in,Se~ction 2.

LEGAL DESCRIPTION
The property commencing with SO 21'E 130 feet from the
intersection of the southerly line of Garvey Avenue, with the
westerly line of lot 5, tract no. 830, then SO 211E 50 feet with
a uniform depth of 269.41 feet, which is part of the North 1/2,
of the Northwest 1/4, of Section 30, Township 1 south, Range 11
west, Rancho Potrero Grande, City of Rosemead, County of Los
Angeles, and commonly known as 2746 Muscatel Avenue.
