CC - 1986-54 - Increase in the Transient Occupancy TaxRESOLUTION NO. 86-54 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ROSEMEAD, CALIFORNIA ORDERING THE SUBMISSION TO THE QUALIFIED ELECTORS OF SAID CITY OF A CERTAIN MEASURE RELATING TO THE INCREASE IN THE TRANSIENT OCCUPANCY TAX AT THE SPECIAL ELECTION TO BE HELD ON TUESDAY, MARCH 3, 1987 HERETOFORE CALLED BY RESOLUTION NO. 86-49 WHEREAS, a.Special Municipal Election on March 3, 1987, for the election of one member of the City Council of the City of Rosemead has been heretofore called by Resolution No. 86-49; adopted on November 12, 1986; and WHEREAS, the City Council of the City of Rosemead also desires to submit to the qualified electors of said City.at said election a measure relating to the increase in the Tran- sient Occupancy Tax as stated on Exhibit ;'A" attached hereto:.`: NOW, THEREFORE, the City Council of the City of Rosemead does hereby resolve, determine and order as follows: SECTION 1. That said City Council, pursuant to its right and authority so to do, does hereby determine that there shall be and there is hereby ordered submitted to the qualified elec- tors of said City at ,said election the following question, to wit: "SHALL THE TAX ON OCCUPANCY OF MOTEL YES. . AND HOTEL ROOMS IN THE CITY OF ROSEMEAD BE INCREASED FROM 6% TO 8%?" NO A cross placed in the voting square after the word "YES" in the manner hereinbefore provided shall be counted in ` :favor of the adoption of the measure. A cross placed in the square after the word "NO" in the manner hereinbefore provided shall be counted against the adoption of the measure. SECTION 2. That the City Clerk shall certify to the passage and adoption of this Resolution, shall enter the same in the book of original resolutions of said City, and shall make a minute of the passage and adoption thereof in the records of the proceedings of the City Council of said City in the minutes of the meeting at which the same is adopted and approved. ATTEST: MAYOR City lerk EXHIBIT "A" Text of Proposed Law This amendment was unanimously approved by the Rosemead City Council as Ordinance No. 587 on July 8, 1986. Existing provisions proposed to be deleted are stricken and new provisions proposed to be inserted or added are printed in bold type to indicate they are new. ORDINANCE NO. 587 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ROSEMEAD INCREASING THE TRANSIENT OCCUPANCY TAX THE CITY COUNCIL OF THE CITY OF ROSEMEAD ORDAINS AS FOLLOWS: SECTION 1. Section 6602 of the Rosemead Municipal Code is amended to read as follows: "Tax Imposed. For the privilege of occupancy in any motel, hotel, each transient is subject to and shall pay a tax in the amount of six-percent {6%) eight percent (8%) of the rent charged by the operator. Said tax constitutes a debt owed by the transient to the City which is extinguished only by payment to the operator or to the City. The transient shall pay the tax to operator of the motel or hotel at the time the rent is paid. If the rent is paid in installments, a proportionate share of the tax shall be paid with each install- ment. The unpaid tax'shall be due upon the transient's ceasing to occupy space in the motel or hotel. If for any reason the tax due is not paid to the operator of the motel or hotel, the Tax Administrator may require that such tax shall be paid directly to the Tax Administrator." SECTION 2. If the City of Rosemead and the Rosemead Building Trust Fund, an affiliate of the Rosemead Chamber of Commerce, agree on terms and conditions regarding the construction and operation of the Rosemead Visitor's Center, then the Finance Officer shall earmark twenty-five percent (25%) of the total funds collected hereunder for such project for a period of four (4) years from the effective date hereof. SECTION 3. This Ordinance shall become effective September 1, 1986. PASSED, APPROVED and ADOPTED this 8th day of July, 1986. ATTEST: CITY CLERV MAYOR 2
