CC - 1985-04 - Granting Conditional Approval of Tract map 43396 located at 7559 GarvaliaRESOLUTION 85-4 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ROSEMEAD GRANTING CONDITIONAL APPROVAL OF TENTATIVE TRACT MAP 43396 (A SUBDIVISION OF TWO EXISTING PARCELS OF LAND INTO 5 LOTS FOR SINGLE FAMILY USE) LOCATED AT 7559 GARVALIA AVENUE. THE CITY COUNCIL OF THE CITY OF ROSEMEAD DOES HEREBY RESOLVE AS FOLLOWS: Section 1. The City Council of the City of Rosemead does hereby find and determine that an application was duly filed by Owen Development Co. requesting subdivision of an existing parcel into five separate parcels for property located at 7559 Garvalia Avenue, or more specifically described as: In the City of Rosemead, County of Los Angeles, State of California being a subdivision of lot 9, Tract no. 1985 per map recorded in Book 22, page 159 of maps recorded in the office of the County Recorder of said county, and that a public hearing 8:00 p.m., in the Council Boulevard, Rosemead, Cali place, and purpose of the to law; and that a public mentioned time and place. Section 2. The City Council further finds and determines that this request is in conformance with the Land Use Element of the General Plan, and; 1. The proposed map is consistent with the applicable General Plan of the City of Rosemead. There is no specific plan. 2. The design of the proposed subdivision and improvements are consistent with the applicable General Plan. There is no specific plan. 3. The site is physically suitable for the type of development. 4. The site is suited for the proposed density of development. 5. The design of the subdivision will not conflict with public easements. 6. The design and proposed improvements of the sub- division will have no adverse environmental effects on fish, wildlife or their habitat, or cause any public health problems. A Negative Declaration was prepared and adopted in compliance with Rosemead Resolution 79-77, CEQA, and the guidelines for the implementation of CEQA. 7. Discharge of wastes from the proposed subdivision will not result in the violation of existing requirements as prescribed by the California Regional Water Board. Section 3. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Rosemead does approve the request for subdivision of that parcel of land described in Section 1, subject to the conditions contained within Exhibit "A" attached hereto. Section 4. The City Clerk shall certify to the adoption of this resolution. ATTEST: City Cle MAYOR Attachment • EXHIBIT. "A" TENTATIVE TRACT +3396 CONDITIONS OF APPROVAL: 1. Applicant shall comply with all conditions as set forth in the City Engineer's Report dated 7-12-84 and L.A. County Fire Department Report dated 9-11-34. 2. A covenant shall be prepared and approved by the Citv Attorney assuring that the private, common street shall be continually maintained and that cost associated with such maintenance shall be equally shared by lots 1-5 in accordance with Section 9104.21 I, 5(g). This covenant shall be noted on the final tract man and recorded concurrently through separate instrument. 3. The driveway shall be constructed of 4" AC over 4" base with cement curb and curb gutter, or 6" concrete with drainage contour. 4. The development of the property shall be in accordance with the submitted maps. 5. Conditions 3, 6 and 7 referencing on-site improvements shall be noticed on the parcel map, and concurrently recorded through a separate instrument. 6. The interior property line of the newly created lots, and where designated by the Director of Planning, the perimeter property line, shall be fenced with a six foot (6') high masonry or wooden fence. If a wooden fence is installed the fence shall be supported by steel posts set in concrete. 7. All utilities shall be underground. 8. The applicant shall sign an affidavit of agreement of conditions, and return it to the Planning Department within ten (10) days after approval of this request. 9. A covenant restricting all future land owners to only a one single family dcaellin- unit per lot shall berrecorded concurrently with the final map. The covenant shall contain a provision which requires a release from the Cites oT Rosemead prior to any disolvement or modification of the covenant as recorded.
