A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
ROSEMEAD ESTABLISHING UNDERGROUND UTILITY DISTRICT #3
BE IT RESOLVED, By the City Council of the City of Rosemead
as follows:
WHEREAS, the City Council called fora public hearing on
July 9, 1985, at the hour of 8:00 o'clock p.m., in the Council
Chambers in.the City Hail, 8838 Valley Boulevard, Rosemead,
California, to ascertain whether the public necessity, health,
safety or welfare requires the removal of poles, overhead wires
and associated overhead structures, and the underground installation
of wires and facilities for supplying electric, communication, or
similar or associated service, within that certain area of the City
described as follows:
Garvey Avenue, from 130 feet east of Burton.Avenue, to the
easterly City boundaries; and from 57 feet west of Pine Street
to the westerly City boundaries. The boundary will.encompass the
designated portions of Garvey Avenue from the center line to the
right-of-way line on both sides of said streets.
WHEREAS, notice of such hearing has been given to all affected
property owners as such are shown on the last equalized assessment
roll and to all utilities concerned in the manner and within the
time required by law; and
WHEREAS, such hearing has been duly and regularly held, and
all persons interested have been given an opportunity to be heard
NOW, THEREFORE, the City Council.does hereby find that the
health, safety and welfare of the public requires the removal of
overhead utility_fixtures, poles and wires within the proposed
district and the undergrounding of same.
NOW, THEREFORE, be it further resolved by the City Council
of the City of Rosemead, that pursuant to Article XI, Chapter 1,
of the Rosemead Municipal Code, the above described area is hereby
declared an Underground Utility District, and is designated as
Underground Utility District No. 3 of the City of Rosemead. Attached
hereto, marked Exhibit "A" and hereby incorporated as part of this
resolution, is a map of such described area;
RESOLVED FURTHER, that the City Clerk is hereby instructed to
notify all affected utilities and all persons owning real property
within Underground Utility District No. 3 of the adoption of this
Resolution within 10 days after the date of such adoption. Said
City Clerk shall further notify said property that although the
City is funding the installation of the facilities, they are required
to allow the City's Contractor access to their property for this
purpose.
RESOLVED FURTHER, that the Council hereby finds and determines
as follows:
The Underground Utility District herein created is in the
general public interest for the following reasons:
1. The undergrounding to be accomplished will avoid
or eliminate an unusually heavy concentration of
overhead distribution facilities.
2. The streets, roads or rights-of-way in the District
are extensively used by the general public and carry
a heavy volume of pedestrian and vehicular traffic..
