A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
ROSEMEAD APPROVING CONDITIONAL USE PERM'I'T 85-334
FOR THE SALE OF BEER AND WINE AT 9019 GARVEY AVE.
THE CITY COUNCIL OF THE CITY OF ROSEMEAD RESOLVES AS
FOLLOWS:
SECTION 1. The City Council finds, determines, and declares:
a. That an application for a conditional use permit
to allow the sale of beer and wine at 9019 Garvey
was filed by Judi Ann Hutton; and
b. That the Planning Commission, after a duly noticed,.'.
public hearing, denied the permit for the grounds
set forth in its Resolution No. 85-38;and
c. That the applicant timely filed an appeal to the
Planning Commission's decision denying the condi-
tional use permit; and
d. That the City Council conducted a public hearing
on the appeal on November 26, 1985.
SECTION 2. The City Council hereby upholds the appeal and
grants the conditional use permit subject to the conditions con-
tained herein.
SECTION 3. The City Council hereby finds that pursuant to
Section 9180 of the Rosemead Zoning Code the following findings
are present thereby justifying the granting of a conditional use
permit.
1. The project is in harmony with the elements and
objectives of the General Plan.
2. The project will not be detrimental to the surrounding
properties.
3. The project is desirable to the public convenience.
SECTION 4. On the basis of evaluation, this project has
been determined to be subject to a class 9 categorical exemption
under the provisions of the California Environmental Quality Act.
SECTION 5. The conditional use permit is granted subject
to the following conditions:
a. That the sale of beer and wine be limited to the
hours of 9:00 a.m. through 10:00 p.m., Monday thru
Thursday and 9:00 a.m. to 12:00 p.m.,.Friday'& Saturday.
b.' That the,permit is not transferable 'to future owners
or occupants:
c. That the permit is granted for a period of one year
from the date of the delivery of the affidavit of
acceptance of conditions to the Planning Director.
A public hearing will be set before the Planning
Commission to consider renewal of the permit, if
requested by the applicant.
d. That the property be maintained in accordance with
Section 5405-5415 of the Rosemead Municipal Code
relative to trash, litter and debris, which includes
a trash enclosure with prior approval of the Planning
Director.
e. All signs shall be in accordance with Section
9900-9907 of the Rosemead Municipal Code.
f. That the parking lot and driveway entry and
exits= be painted per City standards.
g. The applicant shall sign a notarized affidavit
agreeing to these conditions within ten (10)
days of this Resolution.
SECTION 6. The City Clerk shall certify to the adoption
of this Resolution.
