CC - 1984-30 - Vacating Newmark Aves RESOLUTION NO. 84-30 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ROSEMEAD VACATING A PORTION OF A PUBLIC STREET (NEWMARK AVENUE) THE CITY COUNCIL OF THE CITY OF ROSEMEAD RESOLVES AS FOLLOWS: Section 1. The City Council finds, determines and declares.as follows: a. On May 8,1984 the City Council adopted Resolution No. 84-25, A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ROSEMEAD EXPRESSING ITS INTENTION TO VACATE A PUBLIC STREET (NEWMARK AVENUE); and b. A public hearing was set and duly noticed for June 12, 1984; and c. The legal description and a map depicting the street to be vacated has been on file in the City Clerk's office during the notice period. Section 2. Based upon the recommendation of staff, evidence presented at the public hearing, and the Planning Commission's report, the City Council hereby finds that the portion of the public street depicted on Exhibit "A", attached hereto and incorporated herein by this reference, is unnecessary for present or prospective public use. Section 3. The City Council.hereby orders vacation of a portion of the public street known as "Newmark Avenue" and depicted on Exhibit "A". The vacation shall become effective when the applicant Garvey School District ("District") enters into an agreement with the City of Rosemead with the following terms: 1. District shall offer sufficient dedication, currently estimated to be sixteen (16) feet, to allow for construction of a two lane collector street with six (6) foot parkways on both sides of the street and parking permitted only on the north side. 2. District shall agree to pay its prorata portion of the costs of the improvement of Egley Street, said costs to include engineering, grading, paving, curbs, gutters, sidewalks, survey and inspection. 3. District shall be responsible for the right of way dedication and the full cost of the Newmark cul-de-sac which fronts off of New Avenue. Said cul-de-sac shall be developed in accordance with the standards of the City of Rosemead. s, ^ • . 4. District shall construct a new public sewer line within the Newmark Avenue cul-de-sac connected to New Avenue. 5. District shall post a.$5,000 bond, or equiva- lent security acceptable to City, to defray the cost'of the installation of certain traffic control devices at the following locations: Jackson Avenue, (New to Fern), Fern (possible 4-way fix control), parking controls (Fern to Egley), and various signing and red curbing. City shall determine as soon as practicable whether such devices are required due to the school operations. In the event the devices are not required, District's security shall be returned. 6. A drainage study of the area north of the school property shall be completed by District and sub- mitted to the City Engineer for review and comment. 7. District shall comply with those conditions imposed by the Rosemead Planning Commission as part of the granting of the conditional use permit for the school. 8. In the event the District does not construct Newmark School within three (3) years of the date hereof, District shall offer the portion of public street vacated hereby to the City. In the event of such re-dedication to City, District shall restore the street to its present state of improvement. Section 4. The City Clerk is instructed to record a certified copy of this Resolution with the Los Angeles County Recorder. Avenue, 50 feet in width, as shown on the map of Tract No. 7061 in the City of Rosemead, County of Los Angeles, State of California per map recorded in Book 89, Pages 38 and 39 of map books, in the office of the County Recorder of said County. Also that a portion of Newmark Avenue, 50 feet in width, as shown on the maps of Tract No. 6276 in the City of Rosemead, County of Los Angeles, State of California per map recorded in Book 97, Pages 80 and 81 of map books, in the office of the County Recorders of said County, lying between the northerly prolongation of the westerly right-of-way line of Jackson Avenue, 50 feet in width, as shown on said Tract No. 7061 and the northerly prolongation of the westerly line of Lot 13 of said Tract No. 6276.
