FOLLOWS:
A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF ROSEMEAD DENYING AN APPEAL AND
APPROVING A CONDITIONAL USE PERMIT FOR
THE SALE OF BEER AT 8742 GARVEY AVENUE
(C.U.P. 84-294).
THE CITY COUNCIL OF THE CITY OF ROSEMEAD RESOLVES AS
Section 1. The City Council of the City of Rosemead finds,
determines and declares as follows:
a. That an,application for a Conditional Use Permit to
permit the on-site sale of beer in conjunction with
a restaurant at 8742 Garvey Avenue was duly filed by
Mercedez Gomez for the business known as "El Yaki"
restaurant;
b. That after a duly noticed public hearing, the Planning
Commission resolved to conditionally approve said
application (PC Resolution 84-21); and
c. That an appeal by an opponent of the application was
duly filed and set for public hearing before the
City Council.
Section 2. After conducting a duly noticed public hearing
on June 12, 1984, the City Council hereby upholds the decision of the
Planning Commission and denies the appeal based on the following findings:
a. That the sale of beer is an incidental use to the
primary restaurant business use and, as such, is
desirable to the public convenience; and
b. That the sale of beer in conjunction with the
restaurant is in character with the immediate area
and will not be detrimental to the surrounding
area; and
c. That with the inclusion of amended conditions of
approval, as contained in the attached Exhibit "A",
the property improvements for the specific restaurant
business are sufficient to support the request.
Section 3. The City Council hereby approves Conditional
Use Permit 84-294 subject to the conditions contained in Exhibit "A"
attached hereto.
Section 4. The City Clerk shall certify to the adoption
of this Resolution and shall cause a copy thereof to be transmitted
to the applicant.

EXHIBIT "A"

Conditions:
0
1. That the sale of beer be limited to.the hours of 11:00 a.m.
through 11:00 p.m., and must be served with meals.
2. That the permit is not transferable to future owners or occupants
of the building.
3. That the permit is granted for.a period of one (1) year from the
date of delivery of the affidavit of conditions to the Planning
Director. A public hearing will be set before the Planning
Commission to consider renewal of the permit, if requested by
the applicant.
4. That the available parking spaces be re-striped and wheel stops
placed.
5. Directional arrows should be painted on the pavement showing the
entrance and exit to the parking lot.
6. That the property be maintained in accordance with Section 5405-
5415 of the Rosemead Municipal Code relative to trash, litter and
debris.
7. That a trash enclosure be built to the satisfaction of the Planning
Director.
8. All signs shall be in accordance with the Sign Ordinance at all
times.
9. That all conditions shall be met within 90 days.
10. The applicant shall sign a notarized affidavit of agreement to
the above conditions within 10 days of approval.
