A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
ROSEMEAD CONDITIONALLY APPROVING TENTATIVE TRACT
NO. 43336 (A ONE-LOT SUBDIVISION OF AN EXISTING
PARCEL OF LAND INTO 13 COMMERCIAL CONDOMINIUMS)
LOCATED ON GARVEY AVENUE, ROSEvEAD, CALIFORNIA
THE CITY COUNCIL OF THE CITY OF ROSEMEAD DOES HEREBY FIND,
DETERMINE AND RESOLVE AS FOLLOWS:
Section 1. The City Council does hereby find and determine
that an application was duly filed by Granco Development Corporation,
requesting a one-lot subdivision creating thirteen separate commercial
condominiums on property located at the south/west corner of Garvey and
River Avenues; or more specifically described in the following:
In the City of Rosemead, County of Los Angeles, State of
California, being a subdivision of a portion of lot 5,
Tract No. 830 as per map recorded in Book 16, page 11 of
maps and a portion of Parcel 1, Parcel Map No. 4615 as
per map recorded in Book 55, page 5 of parcel maps, both
records of said County for condominium purposes,
and that a public hearing was scheduled for September 25, 1984, at
8:00 p.m. in the Council Chambers of Rosemead City Hall, 8838 Valley
Boulevard, Rosemead, California; and that notice of the time, date,
place and purpose of the aforesaid hearing was given according to law;
and that a public hearing was duly conducted at the aforementioned time
and place.
Section 2. The City Council further finds that this sub-
division is in conformance with the Land Use Element of the General Plan;
a. The proposed map is consistent with the General Plan of
the City of Rosemead. There is no specific plan.
b. The design of the proposed subdivision and improvements
are consistent with the applicable General Plan. There
is no specific plan.
C. The site is physically suitable for the type of development.
d. The design of the subdivision will not conflict with
public easements.
e. The design and proposed improvements of the subdivision
will have no adverse effect on fish, wildlife or their
habitat, or cause any public health problems. A Negative
Declaration has been prepared in compliance with Rosemead
Resolution 79-77, CEOA, and the guidelines for the imple-
mentation of CEQA.
f. Discharge of wastes from the proposed subdivision will not
result in violation of existing requirements as prescribed
by the California Regional Water Board.
Section 3. Tentative Tract 43336 is hereby approved subject
to the conditions listed on Exhibit "A", attached hereto and incorporated
herein by this reference.
Section 4. The City Clerk shall certify to the adoption of
this resolution.

EXHIBIT "A"
Tentative Tract 43336
CO:iDITIO\S OF APPROVAL:
1. The project shall be developed substantially in accordance with the Tentative
Tract Map dated June, 1984. _
2. Two copies of the Covenants, Conditions and Restrictions (C.C.& R.'s) containing
language addressing each of the following shall be provided to the City prior
to the recordation of the final map. The C.C.& R.'s shall be subject to the
review and approval of the City Attorney.
a. Language to the effect stating, "The condominium association shall
be responsible for the enforcement of the C.C. & R.'s.
b. That only retail or office uses shall be permitted as described within
the City of Rosemead's current C-3, or equivalent zoning designation,
in effect at the time of any new occupancy request.
c. Provisions assuring the continued maintenance and/or operation of
common open space and facilities.
d. Authorization for the City to enforce C.C.S R.'s in areas of land use
and safety in the event the condominium association fails to do so.
e. That a master sign plan be provided to the City Planning Department
for review and approval. Each business occupancy shall be subject to_
the sign limitations imposed by said approved plan. _
3. All utilities shall be placed underground.
4. The driveway fartherst east,fronting on Garvey Avenue, shall be restricted to
right-hand turns only (i.e. going east-bound only).
5. The applicant shall sign an affidavit of agreement of conditions and return it
to the Planning Department within ten (10) davs after approval of this request.
