THE AGUILAS RESTAURANT & NIGHT CLUB, 8800 GARVEY AVENUE
Pursuant to the Rosemead Municipal Code, an Administrative Hearing was held on January 31,
2005 regarding the approval of an Entertainment License and Dance License for the Aguilas
Restaurant & Night Club, (formerly known as Casa Latina), 8800 Garvey Avenue. Attached is a
list of the residents and business owners notified of the Administrative Hearing. A
Neighborhood Meeting was also conducted on February 9, 2005 to afford the residents and
business owners who signed a letter against the issuance of these licenses the opportunity to have
their concerns addressed. It should be noted that no one was present for this meeting.
This establishment is a restaurant serving food and alcoholic beverages. The owner wishes to
allow dance and entertainment for his customers. The hours of operation will be 10:00 a.m. to
2:00 a.m., seven days a week.
Staff is recommending approval of the Dance License and Entertainment License contingent
upon the attached conditions and after the lighting system in the rear parking lot is completed
and operational. Attached for your information are the following items:
1. List of Conditions.
2. Security & Video Taping Plan.
3. Interior & Exterior Lighting Plan.
4. Copy of the minutes of the Administrative Hearing on January 31, 2005.
5. Copy of the minutes of the Neighborhood Meeting on February 9, 2005.
RECOMMENDATION
It is recommended that the Rosemead City Council grant a Dance License and an Entertainment
License to the Aguilas Restaurant & Night Club, 8800 Garvey Avenue.

The entire premises is subject to inspection by the Sheriffs Department at anytime.
2. Any Locked or otherwise secured rooms shall be opened upon demand. Storage
areas will be kept locked and accessible to employees only.
3. All licenses, permits, and a copy of these conditions shall be posted where they are
fully visible and readable by the pub!ilc.
4. All licenses and permits shall be valid at all times.
5. All conditions imposed by any licensing authority shall be complied with at all times.
All CUP conditions shall be complied with at all times.
A person in charge shall be on the premises at all times that the business is open.
The person in charge shall be familiar with the laws regulating this establishments.
The person in charge shall meet the following qualifications:
A. Be at least twenty-one (21) years of age.
B. Possess, on their person, a valid DMV issued California driver's license or
identification card.
C. Be able to communicate effectively with regulatory officials.
D. Have the ability to immediately contact an owner.
The person in charge shall introduce him/herself to any regulatory official (Sheriff,
Fire, Code Enforcement, Etc.) at such time as the official's presence Is announced
to any employee. The person in charge shall fully cooperate with the official's
investigation.
8. All employees shall possess, on their person, a valid DMV issued California driver's
license or identification card.
9. The approved floor plan shall not be changed without prior approval of the Sheriffs
Department License Detail.

10. The hours of operation shall be Monday through Friday between 10:00 A.M. of one
day and 2:00 A.M. of the following day. Saturday and Sunday between 9:00 A.M.
of one day and 2:00 A.M. of the following day. The business shall not be open to,
or used by the public, between the hours of 2:00 A.M. and the approved hour of
opening.
11. No person under twenty-one (21) years of age shall be allowed on the premises
during the hours of entertainment, unless accompanied by a parent or legal
guardian.
12. There shall be no smoking allowed within the premises. "No Smoking" signs shall
be posted throughout the business.
13. The latest security plan and video taping plan, as approved by the Sheriff's
Department License Detail, shall not change without the prior approval of the
Sheriffs Department License Detail.
14. The security and taping plans may be reviewed and/or revised by the Sheriff's
Department License Detail as needed without approval of the License and Permit
Hearing Board.
15. Entertainment shall not be audible to the exterior of the building.
16. The doors on the south side of the b4.,Iding shall be equipped with "alarmed panic
style" hardware, and shall be used for emergency Ingress and egress only. The
south doors shall not be propped open at anytime. All customers shall enter and
leave through the northwest entry of the business.
17. Patrons of the business shall not be allowed to loiter around the business, in the
parking lot, or on the streets in the area of the business.
18. The parking lot and area around the business shall be kept free of litter.
19. The interior lighting plan, as approved by the Sheriffs Department License Detail,
shall not change without the prior approval of the Sheriffs Department License
Detail.

20. The exterior fighting plan, as approved by the Sheriffs Department License Detail,
shall not change without the prior approval of the Sheriffs Department License

21. No promoter shall work in this business unless they have a valid business license
issued by the City of Rosemead.
22. No advertising for this business, or any Promoter used by this posted on any public right of way within the City of Rosemead.

on the premises are report to the appropriate law enforcement agency in a timely
manner.
27. Any violations of any applicable laws and/or these conditions shall be grounds for
suspension or revocation of this license.

days. All recordings shall be made available for viewing when ever a request is
made by any regulatory official. The records shall be turned over to the Sheriff's
Department upon demand.

change without the prior approval of the Los Angeles County Sheriffs Department
License Detail.
The light plan represents a minimun lighting requirement.
Dimming devices will not be used on the interior or exterior lights.
4. Any non-working light shall be repaired within 48 hours. Any burned out light bulbs
shall be replace prior to the opening of business each day.

The Hearing was opened by the Hearing Officer, Donald Wagner, at 10:23 a.m. The
Hearing Officer stated that the purpose of the Hearing was to consider an application for
an Entertainment License and Dance License for Aguilas Restaurant and Night Club.
Present was Terri McLaughlin and Arlene Cox from the Los Angeles County Sheriff's
Business License Bureau, Wayne Wallace, Lt. from the Los Angeles County Sheriff's
Department, Temple Station, Brad Johnson, Planning Director, Arnoldo Adame, business
owner, Jose Miranda, previous owner, Bill Wong, property owner and Jenny Cuellar,
resident.
Ms. McLaughlin stated that the background investigation by the Sheriffs Department was
95% completed and an appointment has been scheduled to review the lighting situation
inside and outside of the business on Wednesday, February 2, 2005. She also stated that
the Sheriffs Department is recommending approval with conditions.
Mr. Wagner stated that the City had received a letter signed by 10 residents against the
granting of these licenses and a meeting should be set up with these residents and the
business owner to discuss any concerns that they may have with the business. A call was
made to the Garvey Community Center to determine an available date. The meting was set
for Wednesday, February 91h at 6:30 p.m.
Mr. Miranda stated that the neighbor next to the business always parks a large truck there.
He also stated that he thinks only one person gathered all the signatures.
Ms. Cuellar stated that she had a complaint regarding the resident at 2629 Muscatel
Avenue. They always park a semi-truck near the restaurant and that it blocks the visibility
going onto Muscatel Avenue and that the truck sometimes blocks driveways. She wanted
to know if a red curb could be painted there?
Lt. Wallace stated that Ms. Cuellar needs to call the Sheriffs Department when the semi-
truck is park on Muscatel Avenue. The City has weight restrictions and the Sheriffs can
have the truck towed.
Mr. Johnson said if she wanted a red curb at the location, she would need to write a letter
to the Traffic Commission.
The Hearing was then closed at 10:54 a.m.

Dear Sir,
We are writing hereby to oppose the issue of having an Entertainment and Night Club on
Garvey Ave in the City of Rosemead. Through the years, we are constantly having Graffiti on our
properties. We believe the City of Rosemead has been working so hard to remove the graffiti. All
the graffiti have obviously indicated that there are Gangs activities going on.
We strongly oppose of having an Entertainment and Night Club in our area, for it attracts more
Gangs activities and creates violence or even gun fights, especially after alcoholic consumptions.
As a matter of fact, as the blooming of the Real Estate market today, we need some types of
business establishments to improve and upgrade but not to worsen our city streets.
We urge the City of Rosemead to take deep consideration of this issue, in order to upkeep the
peace and protect the safety of Rosemead City as well as property, residents and business owners.

The neighborhood meeting was held on February 9, 2005 at 6:30 p.m. at the
Garvey Community Center, 9108 Garvey Avenue. In attendance was Donald
Wagner, Assistant City Manager, Terri McLaughlin and Arlene Cox from the
Los Angeles County Sheriffs Business License Bureau, Brian Briscoe,
owner's translator, Arnoldo Adame, business owner, Jose, Maria and Diana
Miranda, previous owners and Jennie Cuellar, resident.
It should be noted that the 10 residents against the granting of these licenses
were notified by mail of the scheduled meeting and no one showed.

ducted for which this chapter requires a license except a theater, concert hall or
similar establishment which is primarily devoted to theatrical performances, as
those words are used in Sections 318.5 and 318.6 of the Penal Code, and a theater
license issued pursuant to Part 2 of Chapter 7.82 is in full force and effect, a license

736130 Fees - Exemptions. The fee required for a license for an entertain-
ment at which no alcoholic beverage is sold or consumed, where such entertain-
ment is conducted by a bona fide charitable religious, benevolent, patriotic or
educational organization, or by the United Service Organization, is in the amount
set forth in Section 7.14.0 10 of this title, under the appropriate heading. (Ord. 11209

736140 Application - Public hearing - Notice requirements. When
application is filed for a new license under this chapter, the commission shall fix a
time and place for a public hearing thereon. Not less than 10 days before the date of
such hearing, the commission shall cause to be posted a notice of such hearing in a
conspicuous place on the property in which or on which the proposed entertain-
ment is to be conducted Such notice shall set forth the specific type of entertain-
ment which the applicant intends to conduct, as well as the type of entertainment
license for which the applicant is applying. Such posting of notice will be caused to
be carried out by the tax collector upon the written request of the business license

736150 Application - Public hearing - Held when. Except as otherwise
provided in this chapter, and except licenses for male manager and for individuals
personally participating in entertainment as defined in former Section 2803 of
Ordinance 5860, which licenses are required by Section 7.36.270 and former
Section 3008 of Ordinance 5860, respectively, the commission shall hold a public
hearing on all original applications for licenses required under this chapter. In
