OF THAT CERTAIN PUBLIC RIGHT-OF-WAY KNOWN AS RAMONA
BOULEVARD AND MAKING FINDINGS OF FACT
A request was received from Primestor Development, Inc., owner of the Levitz property
at 8920 Glendon Way, and their title insurer, for the City Council to take formal action to
vacate the property at the rear of the Levitz Furniture Store.
Staff and all parties were under the impression that this property was part of the former
Toys R Us/Levitz parcel. This was supported by the Los Angeles County Assessor's
Maps which shows contiguous ownership directly up to the 1-10 Freeway right-of-way.
However, it was recently discovered that there are no supporting documents regarding
the City Council's vacation of this property that was intended to occur in 1974.
Upon researching this matter, staff determined that the property was relinquished to the
City from the State on June 4, 1963. The right-of-way was excess right-of-way left over
from the building of the 1-10 Freeway, and is formally known as Ramona Boulevard.
In January 1974, it appeared that it was the City Council's intent to formally vacate the
right-of-way. In fact, the City Council adopted Resolution No. 74-4 on January 8, 1974,
declaring its intent to vacate the subject right-of-way and setting a public hearing to be
held on January 22, 1974, at which time the right-of-way would be ordered vacated.

January 22, 1974 City Council meeting. However, the January 22, 1974 City Council
meeting was adjourned to January 28, 1974, due to lack of a quorum. It is evident that
the January 28, 1974 meeting was held, as minutes for this meeting were approved
during the meeting of February 12, 1974. Unfortunately, approved minutes for the
January 28, 1974 meeting are missing, and therefore, there are no official records of the
City Council's action relative to the vacation proceeding. Attached are copies of the
above-mentioned resolutions and meeting minutes.
The attached resolution ordering the summary vacation of the Ramona Boulevard right-
of-way is now being presented to the City Council in order to finalize actions that
appeared to be the intent of the City Council in 1974.
Pursuant to Section 8334 of the Streets and Highways Code, a legislative body may
summarily vacate a street or highway if the area is excess right-of-way of a street or
highway not required for street or highway purposes. In this case, the subject right-of-
way was excess right-of-way for the 1-10 Freeway and is no longer required for street or
highway purposes.
Also attached is a Quitclaim Deed required to transfer title of the right-of-way to the
adjacent property owner upon its vacation. This is required as the right-of-way was
transferred in fee to the City when relinquished by the State.
Recommendation:
It is recommended that the City Council adopt Resolution No. 2005-11 ordering the
Summary Vacation of that certain public right-of-way known as Ramona Boulevard and
authorize the Mayor to sign the Quitclaim Deed.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
ROSEMEAD ORDERING THE SUMMARY VACATION OF THAT
CERTAIN PUBLIC RIGHT-OF-WAY KNOWN RAMONA BOULEVARD
AND MAKING FINDINGS OF FACT
WHEREAS, the City of Rosemead has received a request from Primestor Development,
Inc. to vacate Ramona Boulevard right-of-way adjacent to their property at 8920
Glendon Way, as legally described in attached Exhibits "A" and "B" and made a part
hereof; and
WHEREAS, City staff has researched the past and current usage of the subject road
right-of-way and has found that the Ramona Boulevard right-of-way is excess right-of-
way of a street or highway not required for street or highway purposes; and
WHEREAS, the vacation of the public easement is undertaken pursuant to the
provisions of the California Streets and Highways Code, Commencing with Section
8300 et sec, which authorizes the City to summarily vacate unused and unnecessary
easements and excess right-of-way; and
WHEREAS, utilities and storm drain facilities lie within the Ramona Boulevard right-of-
way considered for vacation, it is necessary for the City Council to reserve easements
for public and non-public utilities and incidental purposes thereto, ingress and egress,
future easements and drainage purposes; and
WHEREAS, as required by Section 8334 of the Streets and Highways Code, the City
Council finds that the right-of-way identified above is excess right-of-way of a street or
highway not required for street or highway purposes.

NOW, THEREFORE, the City Council hereby resolves as follows:
Section 1: The City Council does hereby elect to proceed in summarily vacating a
portion of Ramona Boulevard right-of-way in the manner as prescribed in Section 8334
of the Streets and Highway Code and that the Ramona Boulevard right-of-way
described in attached Exhibits "A" and "B" is hereby summarily vacated
Section 2. The City Council hereby reserves easements for public and non-public
utilities and incidental purposes thereto, ingress and egress, future easements and
drainage purposes over the vacated area.
Section 3: The Mayor is hereby authorized to execute this Resolution on behalf of the
City Council of the City of Rosemead and the City Clerk is authorized to attest thereto.
Section 4: That the City Clerk is authorized to record a certified copy of this resolution
with the Los Angeles County Recorder's Office.
Section 5: That upon recordation, the vacation is complete.

This is to request formal consideration before the City Council to rectify a street
228 vacation error of City-controlled property at 8920 Glendon Way.

At issue is the relinquishment from the City to the owner of the former state highway
beverly hills right-of-way along the above referenced property. It was intended, at the time, that
the City of Rosemead deed the former State right-of-way to the owner to allow for
development of the site. Steps to allow for relinquishment of the parcel by the City
c a I i f n r n i e were taken in the 1970's but the process was never completed for undocumented
reasons. The intent of that action is evidenced in that Los Angeles County Assessor's
90212-3805 data and records show the area as private land.

OF ROSEMEAD DECLARING ITS INTENTION TO VACATE
A PORTION OF RAMONA BLVD. IN TRACT NO. 2277
IN THE CITY OF ROSEMEAD.
THE CITY COUNCIL OF THE CITY OF ROSEMEAD DOES HEREBY RESOLVE
AS FOLLOWS:
SECTION 1. The City Council of the City of Rosemead
hereby dec ares its intention to vacate the following public
street
Those Portions of Lots 33, 34, 35, and 36,
Tract No. 2277 as shown on map recorded in
Book 31, page 56, of Maps in the office of the
Recorder of the County of Los Angeles described
as follows: Beginning at the intersection of
the westerly line of the east half of said Lot
36 and the northerly line of the southerly 71
feet, measured at right angles, of said Lot;

SECTION 3. The City Council elects to proceed with said
vacation under the provisions of the Street Vacation Act of 1941.
SECTION 4. The City Council has determined that the public
convenience and require the reservation of easements and
rights of way for all existing franchises and renewals thereof
pursuant to Streets and Highways Code Section 8330 and 8331; speci-
fically reserving to the City of Rosemead an easement for sanitary
sewer purposes in, upon, over, and across that portion of above
described Ramona Boulevard herein being vacated, which lies with
the northerly 10 feet of the southerly 41.50 of said lots.
SECTION 5. A public hearing shall be held on Tuesday,
January 22, 1974 at the hour of 8:00 p.m, in the Council Chambers
in the Rosemead City Hall, 8838 E. Valley Boulevard, Rosemead,
California, at which time and place any and all persons interested
in or objecting to said proposed vacation may appear and be heard.
SECTION 6. The City Clerk shall have posted this Resolution
in three (3 public places in the manner prescribed for posting
ordinances of the City. Notices of the proposed vacation shall be
posted along the line of the portion of said street proposed to be
vacated not more than 300 feet apart, with a minimum of three notices
to be so posted in the manner and in the form required by Section
8322 of the Streets and Hi hways Code. Such notices shall be
so posted at least ten (10}3 days before the day set for hearing.

NOW, THEREFORE, BE IT RESOLVED AND ORDERED BY THE CITY
COUNCIL OFTHE CITY OF ROSEMEAD AS FOLLOWS:
SECTION 1. That certain portion of Ramona Boulevard
described as follows shall be and is hereby vacated, subject to
the reservations and exceptions provided in Section 2 hereof.
Those portions of Lots 33, 34, 35, and 36,
Tract No. 2277 as shown on map recorded in
Book 31, page 56, of Maps in the office of the
Recorder of the County of Los Angeles described
as follows: Beginning at the intersection of
the westerly line of the east half of said Lot
36 and the northerly line of the southerly 71
feet, meas8red at right angles, of said Lot;
thence N89 10'10"E along said northerl'y line 406.06
feet to a point 10 feet westerly along said
northerly line from the easterly line of said
Lot 33; thence N44005'58"E 14.13 feet.to the
easterly line of said Lot 33; thence SO058'07"E
al ong9 said easterly line 29.20 feet; thence
S580 4108"W 59.85 feet; thence S83018'57"W 119.94
feet; thence S89032'34"W to said westerly line
of the east half of Lot 36; thence northerly in
a direct line to the point of beginning. Reserving
therefrom an easement for sanitary sewer purposes
in, upon, over, and across that portion thereof
lying within the northerly 10 feet of the southerly
41.50 feet of said Lots.
SECTION 2. The City Council has determined that the
public convenience and necessity require the reservation of ease-
ments and rights of way for all existing franchises and renewals
thereof pursuant to Streets and Highways Code Sections 8330 and
8331; specifically reserving to the City of Rosemead an easement
for sanitary sewer purposes in, upon, over, and across that
portion ofabove described Ramona Boulevard herein being vacated,
which lies with the northerly 10 feet of the southerly 41.50 of
said lots.
SECTION 3. That the City Clerk shall cause a certified
copy of this'- ResoTtion and order to be recorded in the office
of the Recorder of the County of Los Angeles.

A regular meeting of the Rosemead City Council was held in the
Council Chambers of City Hall, 8838 East Valley Boulevard and
called to order by Mayor Pike at 8:00 p.m.
1. The Pledge of Allegiance was led by Councilman Taylor.
The Invocation was delivered by Reverend Kenneth Mathis of the
Rosemead Church of Christ.

It was moved by Councilman Hunter, second by Councilman Maude
and unanimously carried that the minutes of January 22, 197 and
January 28, 1974 be approved as printed.
PUBLIC HEARINGS
4. CONTINUATION OF PUBLIC HEARING HELD JANUARY 8, 1974.
APPEAL TO PLANNING COMMISSION DECISION - CUP # 59 - 3P's
Mayor Pike requested anyone wishing to speak to please stand and
be sworn in.
City Clerk Davenport administered the oath.
Planning Director Miller presented a summary and factual data report.
The hearing was continued at 8:03 p.m.
Robert C. Procter, Jr. - Attorney representing the Appellants
stated that he has been in contact with the City Attorney and there
is a pending question now as to non-conforming use.
Attorney Watson explained that although section 9181.1 (20) requires
a conditional use permit for the sale of any alcoholic beverages
for consumption on the premises in the C-3 or M zones if any portion
of that property is located within 200 feet of residential property,
section 9121.4 (H) states that every non-conforming use of a
conforming building or structure existing at the time the chapter
became effective OP's includdeedI from this category) shall be dis-
continued within three (3) years Attorney Watson agreed to look into the matter as it could also
apply to many other establishments in the City.
It was moved by Councilman Taylor, second by Councilman Maude and
unanimously carried that the applicants be allowed to withdraw this
appeal without prejudice and that the matter be returned to the
Planning Commission after research by the City Attorney.
The Appellants, Mr. & Mrs. Phillips, agreed to this withdrawal.
The hearing closed at 8:16 p.m.
