CC - 1979-68 - Disposition and Development Agreement of sale of landRESOLUTION NO. 79-68 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ROSEMEAD APPROVING A DISPOSITION AND DEVELOPMENT AGREEMENT AND SALE OF LAND WHEREAS, the Redevelopment Plan for the Rosemead Redevelopment Project No. 1 has been duly adopted; and WHEREAS, the Disposition and Development Agreement attached hereto as Exhibit "A" has been prepared for purposes of carrying out said Redevelopment Plan; and WHEREAS, a public hearing has been duly held pursuant to Article II; Chapter 4, Part I of the California Health and Safety Code; and WHEREAS, the development pursuant to the Disposition and Development Agreement is consistent with both the City's General Plan_ and the Rosemead Redevelopment Plan for Project Area No. 1; and WHEREAS, an enrivonmental assessment and negative declaration have been prepared on the proposed development pursuant to the California Environmental Quality Act and the State Guidelines. The conclusion of said environmental review is that the project will not have a substantial effect on the environment for the following reasons: A. This project is consistent with policies shown on the General Plan for the City of Rosemead. . B. No unique or significant natural features will be adversely effected. C. The project will not result in a substantial detrimental effect on air or water quality, nor ambient noise levels for adjoining areas. - D. The project will not breach any public, State, or National standards relating to solid waste or litter control. E. The project will not create any hazard in flooding, erosion or siltation. F. The project is not subject to major geologic hazards. G. The project will not result in the need for public services beyond those presently available or proposed in the near future. H. The project is not apparent to generate environmental controversy. NOW, THEREFORE, the City Council of the City of Rosemead does hereby resolve, determine and order as follows: SECTION 1. The City Council hereby finds and determines that the Disposition and Development Agreement attached hereto as Exhibit "A" and incorporated herein by reference and the sale of the land pursuant to said Agreement are in the best interests of the citizens and merchants of the City of Rosemead and are in conformity with the Redevelopment Plan and that the consideration to be paid pursuant to said Agreement is hot less than fair market value in accordance with covenants and conditions governing the use of said property. RESOLUTION NO. 79-68 Page 2 SECTION 2. The Disposition and Development Agreement and the sale of land pursuant thereto are hereby approved. - - SECTION 3. The City Council further finds and determines that a negative declaration has been prepared on the proposed development in conformity with C.E.Q.A. and the guidelines adopted pursuant thereto and no further environmental assessment needs to be prepared with respect to the development contemplated by this Disposition and Development Agreement.
