CC - Item 2A - 2005-18 Service Charge for Release of Stored/Impounded Vehicles• TO: HONORABLE MAYOR AND MEMBERS ROSEMEAD CITY COUNCIL FROM: BILL CROWE, CITY MANAGER DATE: JUNE 16, 2005 is SUBJECT: PUBLIC HEARING: RESOLUTION 2005-18 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ROSEMEAD ESTABLISHING A SERVICE CHARGE FOR RELEASE OF STORED OR IMPOUNDED VEHICLES In August 1995, the Rosemead City Council adopted Resolution 95-39 establishing a service charge for the release of stored and impounded vehicles. This fee was based upon the city's cost of a 56 hour traffic car in 1995. Since the implementation of this recovery fee nearly 9 years ago there has been no increase in the fee even though the City has experienced a yearly increase in law enforcement costs. In 1995 the 1.5 hour procedure cost $117.98. In fiscal year 2004/2005 the cost will be $200.35. This represents an increase of 70%. Lieutenant Wallace is recommending that the fee be increased from $65.00 to $100.00. This increase is consistent with fees charged by the surrounding cities of El Monte, Baldwin Park, West Covina and Monterey Park. RECOMMENDATION It is recommended that after the Public Hearing is closed, the Rosemead City Council adopt Resolution 2005-18 increasing the fee for release of stored or impounded vehicles from $65.00 to $100.00. A 1] RESOLUTION NO. 2005-18 • A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ROSEMEAD ESTABLISHING A SERVICE CHARGE FOR RELEASE OF STORED OR IMPOUNDED VEHICLES WHEREAS, the Los Angeles County Sheriffs Department impounds and stores vehicles within the City of Rosemead; and WHEREAS, all related costs for impound storage, and release of said vehicles are paid by the City of Rosemead under contract with the Los Angeles County Sheriffs Department; and WHEREAS, $100.00 has been determined to be the reasonable cost associated with impounding and storing vehicles in the City of Rosemead, and does not exceed the estimated cost for providing such services; and WHEREAS, the costs would be imposed for impounding and storing of vehicles that are abandoned, on the street with expired registration of more than one year, creating a safety hazard, blocking driveways and streets, having more than five outstanding parking tickets, being operated by an unlicensed driver or a driver with a suspended license, and when the driver is arrested and there is no safe or legal way to park the vehicle; and WHEREAS, the neglected or illegal operation of the vehicle by the driver or registered owner results in impounding or storing; and WHEREAS, no fees shall be charged for recovered stolen vehicles; and WHEREAS, the laws of the State of California authorize cities to adopt and implement rates, fees, and/or charges for municipal services, provided that such rates, fees, and/or charges do not exceed the estimated reasonable cost of providing such services; and WHEREAS, the City of Rosemead desires to recover such reasonable costs associated with impounding and storing vehicles resulting from hazardous, illegal, or negligent actions. • NOW, THEREFORE, the City Council of The City of Rosemead resolves as follows: Section 1. That The City of Rosemead direct its administrative staff to coordinate with Los Angeles County Sheriff's Department administrative staff, Temple Station, to implement a $100.00 service charge for the release of stored or impounded vehicles.
