RESOLUTION NO. 73-84
A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF ROSEMEAD DECLARING ITS INTENTION
TO VACATE A PORTION OF CHESTNUT AVENUE
IN TRACT NO. 6261 IN THE CITY OF ROSEMEAD
THE CITY COUNCIL OF THE CITY OF ROSEMEAD DOES HEREBY RESOLVE
AS FOLLOWS:
SECTION 1. The City Council of the City of Rosemead
hereby delcares its intention to vacate the following public
street :
That portion of Chestnut Avenue, in the City of
Rosemead, County of Los Angeles, State of
California, as shown on map of Tract No. 6261,
filed in Book 109, pages 22 and 23, of Maps, in
the office of the Recorder of said County, and
that portion of Delta Street, formerly Allen
Street, in said City, as shown on said map,
which extends from the southerly prolongation
of the easterly line of Lot 33, said tract,
easterly to the southerly prolongation of the
straight line in the easterly boundary of
Lot 47, said tract.
SECTION 2. A map showing such proposed vacation is
on file in the office of the City Clerk to which map reference
is made for particulars as to the proposed vacation. ,
SECTION 3. The City Council elects to proceed with
said vacation under the provisions of the Street Vacation Act
of 1941.
SECTION 4. The City Council has determined that
the public convenience and necessity require the reservation
of easements and rights of way for all existing franchises and
renewals thereof pursuant to Streets and Highways Code Sections
8330 and 8331; specifically reserving to the Los Angeles County
Flood Control District and to the City of Rosemead an easement
for flood control purposes and appurtenant structures in and
across that portion of above described Chestnut Avenue herein
being vacated, which lies westerly of the southerly prolongation
of the westerly line of said.Lot 47.
SECTION 5. A public hearing shall be held on Tuesday,
September 25, 1973 at the hour of 8:00 p.m. In the Council Chambers
in the Rosemead City Hall, 8838 E. Valley Boulevard, Rosemead,
California, at which time and place any and all persons interested
in or objecting to said proposed vacation may appear and be heard.
SECTION 6. The City Clerk shall have posted this
Resolution in three (3) public places in the manner prescribed
for posting ordinances of the City. Notices of the.proposed
vacation shall be posted along the line of the portion of said
street proposed to be vacated not more than 300 feet apart, with
a minimum of three notices to be so posted in the manner and in
the form required by Section 8322 of the Streets and Highways Code.
Such notices shall be so posted at least ten (10) days before
the day set for hearing.
PASSED, APPROVED AND ADOPTED this 28th day of August, 1973.
