CC - 1975-12 - Sanitary Sewer on Highcliffs 1 CITY OF ROSEMEAD RESOLUTION NO. 75-12 ROSEMEAD IMPROVEMENT NO. 2 HICHCLIFF STREET FOR THE ACQUISITION OF NECESSARY RIGHTS OF WAY AND THE CONSTRUCTION OF SANITARY SEWERS RESOLUTION ORDERING ACQUISITION AND IMPROVEMENT WHEREAS, the Resolution of Intention in the matter of Rosemead Improvement No. 2, for the acquisition of necessary rights.of way and the construction of sanitary sewers in Highcliff Street in the City of Rosemead, was adopted by the City Council of the City of Rosemead December 19, 1974; and I WHEREAS, due notice of the time and place for hearing objections or protests to the proposed acquisition and work has been published, posted, and mailed to the property owners as required by law; and WHEREAS, said hearings have been held and all objections or pro- tests in these matters have been duly considered; and WHEREAS, this improvement is for locally funded sanitary sewers located in an already urbanized area for the protection of public health and is, therefore, categorically exempt from the requirements for preparation of an environmental assessment; and WHEREAS, the City Clerk has filed a notice of project determina- tion with the County Clerk. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ROSEMEAD RESOLVES: SECTION 1. 'That all protests against the proposed acquisition and improve- ment be and they are hereby overruled and denied, upon the finding which is hereby made, that they are made by owners of less than 4 of the area of the proposed district. SECTION 2. That the acquisition and work described in the Resolution of Intention for Rosemead Improvement No. 2, adopted on the nineteenth day of December, 1974, is required by public interest and convenience, and it is hereby ordered that said acquisition be made and that said work be done. SECTION 3. That in accordance with the provisions of Section 5256 of the Streets and Highways Code, this City Council hereby.waives the pay ment in advance of all incidental expenses and acquisition costs. Said bids shall be received until the hour of 3:00 p.m. of March 20, 1975, at the office of the City Clerk of the City of Rosemead. Said bids shall be opened, examined, and declared by the City Manager at a public meeting to be held at 3:15 p.m. on March 20, 1975, in the Council Chambers of the Rosemead City Hall, who shall report the results of the bidding to the.City Council of the City of Rosemead at its next regularly scheduled meeting after March 20, 1975.
