A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ROSEMEAD PROVIDING REVENUE SHARING CREDIT
FOR COUNTY FIRE PROTECTION TAXES PAID BY CITY
PROPERTY OWNERS BY ELIMINATING EXISTING TAX AND
ESTABLISHING A TAX IN PLACE THEREOF
THE CITY COUNCIL OF THE CITY OF ROSEMEAD RESOLVES AS FOLLOWS:
Section 1. Pursuant to Government Code Section 43073,
the City Council of the City of Rosemead, a city encompassed entirely
within the territory of the hereinafter specified district, hereby
elects to pay to the Los Angeles Consolidated Fire Protection Dis-
trict an amount of money equal to the amount said District would
derive from the imposition of its tax on all property within the in-
corporated limits of the city. Such payment shall be in lieu of the
imposition of said District's tax on property within the boundaries
of the city.
Section 2. Pursuant to Government Code Section 43073, the
City Counc11 tie City of Rosemead, in order to generate the funds
necessary to make the payment referred to in Section 1 of this Resolu-
tion, hereby establishes a city tax rate for fiscal year 1975-1976
in the amount equal to the amount of the rate set by the Board of
Supervisors of the County of Los Angeles for the Los Angeles County
Consolidated Fire Protection District for the 1975-1976 fiscal year.
The revenue from such tax shall be utilized solely for the payment
described in Section 1 hereof.
Section 3. The City Council of the City of Rosemead hereby
requests that the County Tax Collector list the Los Angeles County
Consolidated Fire Protection District on the property tax bill or on
an accompanying statement, clearly indicating that the city has
elected to include the cost of the special district service in a city
tax rate rather than have the District impose the tax. This Resolu-
tion shall serve as direction and authorization to the Los Angeles
County Auditor-Controller to transfer the monies collected pursuant
to Section 2 of this Resolution to the Los Angeles County Consoli-
dated Fire Protection District.
Section 4. The adoption of this Resolution in no way
imposes or impries the levy of a city property tax for general muni-
cipal purposes, and is in fact a step which is consistent with long-
standing City Council policy of seeking to maximize the services
provided by the city without the imposition of a city property tax
as a method of paying for such services.
Section 5. The City Clerk is directed forthwith to mail a
certified copes this Resolution by certified mail to the Los Angeles
County Auditor-Controller, the County Assessor and the County Tax
Collector.
Section 6. The City Clerk shall, within 15 days of
adoption hereo , post copies of this Resolution in at least three
public places in the City of Rosemead designated for the posting
of city ordinances and notices and shall file proof of such
posting in the official records of said City Clerk.
