HAWKESWORTH, ACTING CITY MANAGER DATE: JUNE 9, 2009 SUBJECT: PLANNING COMMISSIONER TERMS OF OFFICE SUMMARY As the Council is aware, all of the Planning Commission terms currently expire at the same time. In order to correct this and return to staggered terms, the Municipal Code must be amended. Staff has conferred with the City Attorney and has prepared an Ordinance (Attached) which will re-establish staggered terms for the Planning Commission. The City Council will need to randomly select two of the recent appointees that will serve only one year terms. Staff Recommendation That the City Council adopt Ordinance 875 authorizing the amendment to Section 2.28.020 of the Rosemead Municipal Code. ORDINANCE NO. 875 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ROSEMEAD, CALIFORNIA, AMENDING CHAPTER 2.28.020 OF THE ROSEMEAD MUNICIPAL CODE CONCERNING THE PLANNING COMMISSION. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ROSEMEAD, CALIFORNIA, DOES HEREBY ORDAIN AS FOLLOWS: SECTION 1. Chapter 2.28.020 of the Rosemead Municipal Code is hereby amended to read in its entirety as follows: 2.28.020 Members - Terms - Vacancies. The Planning Commission shall consist of five members, each of whom shall be appointed by the Mayor with the consent of the majority of the members of the City Council and otherwise in accordance with state law. An appointed member of the Planning Commission may be removed at any time by the Mayor, with approval of the Council, or by a majority vote of the City Council. Each member of the Planning Commission shall have a term of office of two years which shall be staggered. Three members shall be appointed in the odd numbered years and two members shall be appointed in even numbered years; except for the year 2009 in which all five members will be appointed and the City Clerk shall draw at random the names of the two members that shall serve only a one year term. Terms shall commence on June 1" and expire on May 31 s` of the appropriate calendar year, unless a lesser term is necessary to fill a vacancy. Should any vacancy exist on the Planning Commission, otherwise than by expiration of term, such vacancy shall be filled by appointment for the unexpired portion of the term.
