SUBJECT: REQUEST FOR RELIEF FROM ORDINANCE NO. 811-MORATORIUM
ON THE ISSUANCE OF ANY PERMITS OR ENTITLEMENTS FOR
GARMENT MANUFACTURING, PROCESSING OR ASSEMBLING -
CONDITIONAL USE PERMIT 94-611 (MODIFICATION) dba, TOM BOY
FASHION, 8909 GARVEY AVENUE, UNITS B2, B3, B4, and B5.
BACKGROUND
Conditional Use Permit 94-611 was initially approved for garment manufacturing operations on
May 2, 1994. The approval allowed two tenant spaces, units B2 and B3 to be occupied for such
uses. Upon inspection of CUP 94-611 in September 2000, Staff discovered that the current
business operator, Tom Boy Fashion, had expanded into units B4 and B5. In order to continue
garment operations within these units, the owner of Tom Boy Fashion applied for a modification
of Conditional Use Permit 94-611 and requested relief from Ordinance No. 811 on December 7,
2000.
Ordinance No. 811, a 45-day moratorium on the issuance of any new permits or entitlements for
garment manufacturing, processing, or assembling in the M-1 zone, passed by the City Council
on August 8, 2000 was subsequently extended for 10 months and 15 days on September 12, 2000
pursuant to Ordinance No. 812. The applicant requests relief from Ordinance No. 811 on the
grounds that the interim zoning ordinance does allow exceptional circumstances to the
moratorium and that the granting of an exception would not be detrimental to the public welfare.
DISCUSSION
Following administrative protocol for requests for relief of moratoriums and attached
entitlements, staff had presented the modification request of Conditional Use Permit 94-611 at
