SUBJECT: REQUEST TO WAIVE FEES FOR OCCUPANCY PERMIT

The applicant, Thuong Le, of the Vietnamese American Seniors Association in San Gabriel
Valley, has submitted a request to waive the fee for an Occupancy Permit to establish this
organization at the subject site. Rosemead Municipal Code Section 17.124.090 requires an
Occupancy Permit for any land to be occupied or used.
At present, there are two existing non-profit organizations in the city that have processed fees for
occupancy permits, including Alcoholic Anonymous, 3015 Walnut Grove Avenue Unit C, and
Boys & Girls Club of America, 7850 Garvey Avenue. The fee itself is $364.20, consisting of a
Planning Department fee ($225.00) and a Building Department fee ($134.55). This fee is
processed only one-time (based on change of business ownership or land use, etc.) with no
annual renewal. Based on the financial statement provided by the applicant (Exhibit B), the
organization has sufficient funding to pay the occupancy fee in full and to further process the
occupancy permit.
The City's fee resolution permits the City Council to consider fee waivers where a substantial
financial hardship is involve. Council action is to be based on a letter and proof of financial
hardship received and filed with the City Clerk (Exhibits A & B).
RECOMMENDATION
It is recommended that the Rosemead City Council deny the fee waiver request by the
Vietnamese American Seniors Association in San Gabriel Valley.
