FOR CONSTRUCTION OF STREET REHABILITATION AND CONCRETE IMPROVEMENTS (CIP PROJECT NOS. 21034, 21850, AND 24009) As part of the FY 2026-2027 Capital Improvement Program, the City Council approved the Annual Preventative Pavement Maintenance, Pavement Rehabilitation, and Sidewalk Replacement Projects. The planned work includes cold milling and overlaying approximately 8.4 miles of existing asphalt concrete pavement, applying slurry seal, and performing concrete repairs to damaged sidewalks, curbs, gutters, and spandrels. The project also includes additive scope for parking lot improvements to the Garvey Community Center and Zapopan Park. This portion of the work involves full -depth repairs to localized areas uplifted by tree roots, replacement of damaged concrete sections and restriping. Following a competitive bid process, staff determined that Hardy & Harper, Inc. submitted the lowest responsive and responsible bid and is qualified to perform the work. Staff recommends the City Council award the construction contract to Hardy & Harper in the amount of $2,790,000 and include a ten percent contingency for a total construction budget of $3,069,000, and adopt Resolution No. 2026-43 to increase the amount of Public Facilities funding allocated to the Annual Preventative Pavement Maintenance (CIP Project No. 21034) by $115,000 for repairs within the City owned parking lot. DISCUSSION The proposed project focuses on rehabilitating streets identified through the City's Pavement Management Program as requiring either preventative maintenance or structural rehabilitation. The scope of improvements is comprehensive, addressing both surface and structural needs to ensure long-lasting roadway conditions. AGENDA ITEM 4.0 City Council Meeting July 28, 2026 Page 2 of 4 Proposed work includes the following: • The removal and replacement of failed pavement sections, asphalt grinding and overlay, and full -depth pavement reconstruction at localized areas; • Replacement of damaged curbs, gutters, and sidewalks, the construction or upgrade of ADA-compliant curb ramps; • Installation of mid -block crosswalk along Willard Avenue. • Adjustment of utility manholes and valve covers; and • New pavement striping, markings, and raised pavement markers will also be installed, along with other incidental work required to complete the improvements, which will enhance road safety and visibility. Following the preparation of this detailed scope, the City proceeded with the bidding process to select a qualified contractor to perform the work. On June 1, 2026, a Notice Inviting Bids was published in local newspapers and trade publications, to notify potential bidders of the opportunity. The review process began with confirming that the bid was both responsible and responsive, ensuring all required documentation, including the Certificate of Reported Compliance issued by the California Air Resources Board (CARB) and possession of the appropriate California Contractor's License was received, and confirming Department of Industrial Relations (DIR) registration (checked Federal and State debarment files and vetted contractor references). After completing the evaluation, it was determined that Hardy & Harper, Inc. had met all necessary requirements. The bid included an Alternate Bid line item that specifically addressed optional improvements for two City's facilities. The alternate work consisted of parking lot repairs at the Garvey Community Center and the restriping of the Zapopan Park parking lot. Consistent with California Public Contract Code Section 20103.8(a), the Additive Alternate Bid items were not used in identifying the lowest responsible bidder but were presented as options to enhance the overall project. Hardy & Harper, Inc. submitted a $205,000 bid for the Additive Alternate Bid. City Council Meeting July 28, 2026 Page 3 of 4 Staff recommends awarding the construction contract to Hardy and Harper inclusive of the Additive Alternate Bid items, as they provide an opportunity to address aging infrastructure at both locations. By including the Additive Alternate Bid items, the contract amount would total $2,790,000 plus a 10% contingency. STAFF RECOMMENDATION It is recommended that the City Council: 1. Authorize the Interim City Manager to execute a construction contract with Hardy & Harper Inc. in the amount of $2,790,000 plus a 10% contingency in the amount of $279,000 to cover the cost of unforeseen construction expenses; and 2. Adopt Resolution 2026-43 amending the City's Fiscal Year 2026-2027 CIP Budget to appropriate additional funds in the amount of $115,500 in Public Facilities (Fund 510) to cover the cost related to parking lot repairs. FISCAL IMPACT Funding for the project is partially included in the approved Fiscal Year 2026-27 Capital Improvement Program (CIP) budget. However, an additional appropriation of $115,500 from the Public Facilities Fund (Fund 510) is needed to cover the parking lot repair improvements. Therefore, the adoption of resolution No. 2026-43 to request additional funds would be needed to cover the shortfall in funding for the parking lot repairs and contingency related to those improvements. The following is the breakdown of the requested construction contract budget: Base Bid $2,585,000 Additive Alternate Bid $205,000 Construction Contract $2,790,000 Contingency (10%) $279,000 Total Construction Budget $3,069,000 ENVIRONMENTAL REVIEW Section 15301 of the California Environmental Quality Act (CEQA) guidelines exempts projects consisting of the operation, repair, maintenance, permitting, leasing, licensing, or minor alteration of existing public or private structures, facilities, mechanical equipment, or topographical features, involving negligible or no expansion of use beyond that existing at the time of the lead agency's determination. The project is classified as a Class 1 Categorical Exemption, pursuant to Section 15301 of CEQA guidelines.
