CC - Item 4F - Selection of Consultant for Comunity Development Block Grant and Home Program ServicesTO: HONORABLE MAYOR AND MEMBERS ROSE ,w1EAD CITY COUNCIL FROM:' BILL OWE, CITY MANAGER DATE: JULY 20, 2004 RE: SELECTION OF CONSULTANT FOR COMMUNITY DEVELOPMENT BLOCK GRANT (CDBG) AND HOME PROGRAM SERVICES As required by the guidelines of the Department of Housing and Urban Development (HUD), the City of Rosemead issued a Request for Proposals (RFP) for CDBG and HOME program services. In response, the City received one proposal from Willdan by the closing deadline. As a result, the City extended the deadline for submission from June 24, 2004 to July 15, 2004. The City did not receive any additional proposals. Thorouahness The proposal was thorough and included all required elements. Technical Approach Willdan lists twelve (12) persons in its proposal with responsibility for program services. Of that number, seven (7) will have regular on -site hours and five (5) will be available on an as- needed basis, e.g. labor compliance and environmental review. Willdan proposes to provide residential rehabilitation, code and commercial services on -site at the City. Willdan has provided services in the requested services since 1979. Willdan provided summaries of the responsibilities of each team member, along with resumes for each, which also show specific cities and projects. Firm's Overall Expertise Willdan states in its proposal that it has provided CDBG /HOME administration to 47 cities and three (3) counties within the State of California. Willdan is currently providing administrative services to six (6) cities; Willdan is currently providing property rehabilitation services to eleven (11) communities. Finally, it is providing code enforcement services for four (4) communities. Cost Willdan's cost proposal is inclusive. Willdan's overall cost estimates are within the City's budget authority for the 2004 -2005 fiscal year. The RDA also funds a commercial rehabilitation program in conjunction with the CDBG- funded rehabilitation program. 11. OVERVIEW These are federally- funded programs operated by the Department of Housing and Urban Development (HUD) and, therefore, the entity as in administering the program is expected to comply with all applicable federal guidelines, policies and procedures. The City is seeking contract services for administration and implementation. Grants administration includes the following: project oversight, IDIS oversight, Annual Planning functions including assistance in preparation of the City's Consolidated Annual Plan and CAPER preparation, special projects. Proposals are due by 5:00 p.m. Thursday, June 24, 2004. III. Provide timely status reports, staffing schedules and meetings with City Manager's Office and other Departments as required. 18. Preparation of application intake and approval based on federal income guidelines and program eligibility guidelines. 1 2 Conduct initial property inspection for code violations necessary to bring property into conformance with the City's adopted rehabilitation standards. 3 Prepare and submit historical clearance documentation. 4 Prepare and obtain property environmental clearances. Obtain lead and /or asbestos tests, risk assessments and incorporate in work descriptions and specifications. 5 Preparation of work description and obtain homeowner approval. 6 Preparation of plot plans, specifications and contract documents for bidding purposes. 7 Set up contractor walk - through'and be present during walk- through to ensure homeowner's questions are answered. $ Receive and review bids, rank bids and perform cost analysis. Check licenses of contractor, including lead workers /supervisors and for HUD debarment. 9 Prepare staff reports and present to Council as required in conformance with City Residential Rehabilitation Guidelines. 10. Prepare Owner Participation Agreements, Contractor Agreements, Loan documents, financial statements and obtain proper signatures. 11 Prepare and execute promissory notes, deed of trusts, covenants and al required documents for processing loans, rebates and grants. Execution and recording of all documents included. 12 Conduct progress inspections to ensure work is proceeding in a timely manner and according to plans and /or schedule of completion. 13. Authorize progress payments, ensuring that all lien releases and permit requirements are met. 14. Conduct final inspections, prepare Notices of Completion, acquire homeowner signatures for work completed to homeowner and City satisfaction and in accordance with contract specifications. 15 Execute contract completion by acquiring final lien releases, close out of building permits, and close out cases by ensuring permanent file contains all documentation required for government audit purposes. 16 Be available to answer questions from the public and from applicants. 17. Maintain the City's deferred loans. process demands and repayments. 18 Work with Finance and other Departments as necessary. 19. Provide database for clients and maintain timely status reports, staffing schedules, meetings as required in the City. 20 Prepare program materials, brochures, outreach materials, Council staff reports and follow up reports and provide outreach Subject: RFP CDBG and HOME Grants administration and delivery Page No: 5 CODE ENFORCEMENT /COMPLIANCE, Target Areas Task # Task 1 Using City's complaint form, document source of complaint regarding substandard housing conditions. 2 Conduct initial site inspection from public right -of -way, within 15 days of request. If necessary, obtain permission to enter premises from person in control of premises. Note and photograph substandard conditions. Prepare plot plan of property, as required. 3 If permission to enter is required, refer case to City Attorney to obtain a search warrant. Refer life /safety hazardous conditions to Building Official, if required, for possible summary abatement. 4 Review building permit job file, zoning files and assessor's records to determine permit status of the property and owner of record. Send Notice of Violation signed by Building Official via certified mail within five (5) days 5. of the inspection along with information on and an application for, the City's Housing Rehabilitation Program, if applicable. Reinspect property fifteen days after notice to see if substandard conditions have been 6. corrected. Close and document case if conditions are corrected. If conditions are not corrected, but progress has been made, arrange single extension 7. of time and schedule reinspection. If voluntary compliance efforts fail, order a title search. Issue a Notice and Order by the 8. Building Inspector within five days of the second inspection and notify all interested parties. post Notice and Order on property. During the thirty (30) day posting period, make every effort to contact the owner 9. personally or by telephone to obtain compliance. If efforts for compliance fail, schedule case for an Administrative Hearing. Prepare and 10. send Notice of Hearing via certified mail to the vested owner and allow receipt at least ten days prior to hearing. Post notice at least ten days prior to hearing. Conduct hearing before the Building Official. Building Official will issue a decision 11. regarding the existence of substandard conditions and issue citation with deadline for abatement if substandard conditions exist. Deadline for abatement shall not exceed sixty days. If owner is instead found to be in compliance, close and document case. 12. If owner is not found in compliance, notify owner of the time and place of the hearing 13. before the Rehabilitation Appeals Board (City Council) which shall be held within thirty days. If Board does not find substandard conditions at the hearing, close and document case. 14. If Board confirms substandard conditions and the citation stands, transmit citation to the 15. District Attorney for prosecution. Give notice to the State Franchise Tax Board that the housing unit has been determined to be "substandard." The qualified agency must also: Work cooperatively with subrecipient organizations in the collection of data and information needed and in the implementation of funded projects and programs. Work cooperatively with local and regional agencies and task forces and with the City to collect and analyze data as needed for planning purposes. IV. SUBMITTAL INSTRUCTIONS All responses to this Request for Proposals must include the following 1. Identification of the legal entity. 2. Cover letter for proposal, signed by the person legally able to bind the entity to the proposal, along with a certification that the price of the proposal shall remain valid for 60 days. 3. Specific Requirements: • Number of years implementing each of the following: CDBG, HOME, Rehabilitation, Commercial Rehabilitation, Project Management, Code Enforcement /Compliance programs and projects in a municipal setting. • Number of years experience working with the City of Rosemead assisting or administering CDBG or HOME programs. • Specific hands -on IDIS experience. • City /County experience writing Consolidated Plans, Action Plans, CAPERS, etc. 4. Identification, role and experience of principal staff and any consultants who would be used. 5. Information regarding projects of similar type and scope, including name of project, type, locality for whom it was performed or prepared (at least three [3]). 6. Evidence of financial capacity. 7. Evidence of Insurance: Comprehensive Liability - $2,000,000 aggregate, auto liability, including non - hired /non -owned automobiles - $1,000,000; Workers' Compensation — Statutory Limit. 8. Statement of Understanding and Description of methodology for carrying out the project, including location of staff and office, number of hours per week, proposed benchmarks for performance. 9. Cost proposal, broken down�by hourly rate, along with draft timeline for each item: CDBG Administration, HOME Administration, Rehabilitation Services, Commercial Rehabilitation Services, Code Enforcement /Compliance. Assume a July 1, 2004 start date. Actual start date may be earlier or later. In preparing the ordinance, Mr. Warot worked closely with an advisory committee representing a cross - section of housing and development interests in Sutter County. • City of Susanville - Mr. Warot assisted the City in procuring $1 million in State CDBG funds for housing rehabilitation purposes. • City of Colusa - Mr. Warot was responsible for oversight of a $1 million housing rehabilitation program. As a prerequisite to using State CDBG funds, Mr. Warot updated the Housing Element of the City's General Plan, a process that was completed in a period of 5 months, including certification by HCD. He also prepared a successful application for $500,000 in State CDBG funds for continued operation of the program. • County of Colusa - Mr. Warot prepared a successful application for $432,000 in State CDBG funds for the rehabilitation of substandard housing and the renovation of the Pierce High School swimming pool in the community of Arbuckle. • City of Oroville - Mr. Warot served as the project manager for the updating of the Housing Element of the City's General Plan. The entire process, including a series of public workshops /meetings and certification by HCD, was completed in a period of 7 months. The City received a Blue Ribbon Communities Award from HCD in 1993 for the commitment made in the element to the provision of housing for all economic segments of the community. • City of Jackson - Mr. Warot headed a consulting team responsible for assisting a local non - profit housing corporation with the preservation of 30 units of "at- risk" housing. This was the first project in the country to be successfully carried out under the provisions of the Low- Income Housing Preservation and Resident Homeownership Act of 1990. • County of Los Angeles - As Chairman of the City Advisory Committee for the L.A. Urban County CDBG Program, Mr. Warot was the spokesperson for the 48 cities that comprise the country's largest urban county program. The specific activities j� are: CDBG /HOME program administration; residential rehabilitation; commercial rehabilitation; and code enforcement/compliance. We understand that the responsibilities of the consultant will entail the full {administration of these programs !i including, but not limited to, grant application and management, preparation of all required grant activity and planning reports, project clearance and implementation, day- to -day record keeping, documentation of compliance with federal regulations, and attendance at public meetings. Willdan is proposing to provide the City with complete administration of the CDBG and HOME funded programs identified in your RFP. In order to allow City staff to direct their attention and efforts to the many other tasks required of them, Willdan will administer these programs so as to minimize demands upon the time and effort of City staff. Willdan will assure full City oversight of all activities by providing to City staff, as appropriate, specific recommendations for action along with full evaluations of all appropriate alternatives. 0 N The assignments for CDBG and HOME grants administration and delivery for the City of Rosemead will be accomplished by our project team based at our Los Angeles regional office in the City of Industry. This office is located adjacent to the Crossroads Parkway interchange with the Pomona (Route 60) Freeway. These services would be delivered to the City by a well - qualified team of professionals, who are intimately familiar with the City of Rosemead and its CDBG and HOME funded projects /programs. Our staffing plan will provide for coverage at City Hall by up to two,persons during normal working hours, Monday through Thursday. Dean Sherer, Virgilio Vita, and Edaurdo Vega, and Mona Christian, will be called upon to assist with general grant administration and/or the implementation of specific CDBG or HOME funded projects, when their specialized skills are needed. Mr. Richard La Rochelle and Ms. Rose Arguello will assist Mr. Donovan with the administration of the code enforcement/compliance program as needed. As requested in your RFP, we have developed a schedule of proposed performance benchmarks. This schedule is graphically depicted on Exhibit 1 on the following page. Q y f I WILLDAN Serving COST ESTIMA TE COST ESTIMATE CDBG AND NOME PROGRAM SERVICES As requested in your RFP, the following is a breakdown of our estimated costs for performing each of the major service components. These cost estimates are based on the level of effort to be devoted by each team member, and their associated hourly billing rates. The anticipated level of effort, in turn, is based on our experience in administering the City's CDBG /HOME Programs since 1979. C�7a]YeLr r, vrarnmer Our cost for CDBG Administration in Fiscal Year 2004 -05 will not exceed $138,308, which represents approximately 10 percent of the City's annual CDBG allocation of $1,394,618. This will allow the City to use an additional $140,616 for in -house administrative expenses or other eligible programs while still meeting the 20 percent maximum limit established by HUD for general administrative cost. HOME Administration Our cost for the general administration of the City's HOME grant in Fiscal Year 2004 -05 ' is included in the abovementioned cost for CDBG Administration. Our, cost for the delivery or management of specific HOME funded projects, . such as first -time homebuyer assistance, will not exceed $56,857. Housing Rehabilitation Services Willdan's cost for the administration of the City's CDBG funded housing rehabilitation program will not exceed $64,000 in accordance with the HUD guideline for rehabilitation program delivery cost. Commercial Rehabilitation Services Willdan's cost for administering the City's CDBG funded commercial rehabilitation program during the 2004 -05 fiscal year will not exceed $35,926. Similar to the housing rehabilitation services being offered by Willdan, this fee is within the activity delivery cost guideline established by HUD for property improvement programs. With regard to the Rosemead Redevelopment Agency's funded commercial rehabilitation, Willdan will (� administer this program during Fiscal Year 2004 -05 for a cost not -to- exceed $30,385. Code EnforcementlCompliance Our cost for administering the City's CDBG funded code enforcement/compliance program during the 2004 -05 fiscal year will not exceed $179,360. This fee includes the delivery of services within the Zapopan Target Area and other CDBG eligible areas throughout the City.
