Attached for your consideration is information regarding training offered by the California
Department of Health Services regarding sale of tobacco products to minors. We are requesting
that the City Council authorize the attendance of Deputies Bartholomew and Chivas. P.O.S.T
(Peace Officers Standards and Training) certification will be available for law enforcement
personnel.
RECOMMENDATION
It is recommended that the City Council authorize the attendance of Deputies Bartholomew and
Chivas at the California Department of Health Services training session on June 10, 2004, in
Sacramento.

Research has shown that enforcement of youth tobacco access laws is the most
effective intervention to keep illegal tobacco sales rates down. The California
Department of Health Services, Tobacco Control Section (CDHS/TCS) and the
California Attorney General's (AG) Office strongly encourage local law enforcement
agencies to regularly enforce PC Section 308(a) Sale of Tobacco Products to Minors.
To assist cities and counties with their local enforcement efforts, CDHS/TCS is
providing PC Section 308(a) enforcement training for local law enforcement agencies.
Corporal Kelly Gordon from the Montebello Police Department and Officer Rich Sevilla
from the Newark Police Department will be conducting these trainings and P.O.S.T.
(Commission on Peace Officer Standards and Training) Certification will be available to
interested attendees. °
The trainings are approximately four hours. in length and highlight the operational
guidelines for conducting PC Section 308(a) site inspections. It is important to note that
the June 10, 2004, training that is being held in Sacramento will be approximately six
hours in length and highlight not only the operational guidelines for conducting PC
Section 308(a) inspections, but also the new statewide licensing law (Assembly Bill 71),
and the civil prosecution of PC Section 308 (a) using Business and Professions Code
17200.
CDHS/TCS and the AG's Office strongly encourage local law enforcement agencies to
attend one of the following PC Section 308(a) trainings in order to learn how to conduct
more effective PC Section 308(a) operations in California's cities and counties:
