TRIPEPI, CITY MANAGER DATE: JANUARY 5, 1993 RE: RESOLUTION NO. 93-03 - APPROVING EXCHANGE OF PROPERTY TAX RESULTING FROM "ANNEXATION 18" TO CITY OF SAN GABRIEL FROM CITY OF ROSEMEAD On October 9, 1990, the City Council held a public hearing on a zone change for.. the property located at 2031-32 Denton Avenue. After several continuations, it was removed and placed for consideration as a deannexation to the City of San Gabriel. The two parcels south of Saxon Avenue are inaccessible to services provided by Rosemead, thus making it more logical to deinnex the properties to the City of San Gabriel. In April 1992, the City of San Gabriel agreed to annex the properties south of Saxon Avenue and approved a resolution in November 1992 to make the decision final. Part of the annexation process requires negotiations on the transfer of property taxes between the two cities. However, since Rosemead is a "No Tax" City, San Gabriel will receive no additional property taxes as a result of the annexation. Upon approval of the resolution by the City of San Gabriel, City of Rosemead and County of Los Angeles, the Local Agency Formation Commission (LAFCO) will hear and rule on the proposed annexation. After LAFCO's decision, the cities will need to take a final action. Attached for Council's review is a copy of Resolution No. 93-03 and a map of the deannexation area. It is recommended that the City Council adopt Resolution No. 93-03 approving and accepting the negotiated exchange of property tax revenues resulting from "Annexation 18." A.40:1 COUNCIL AGENDA- JAN 1 2 1993 ITEM No. Jy-C ROSEMEAD RESOLUTION NO. 93-03 SAN GABRIEL RESOLUTION NO. 92-38 JOINT RESOLUTION OF THE BOARD OF SUPERVISORS OF THE COUNTY OF LOS ANGELES, THE CITY COUNCIL OF THE CITY OF SAN GABRIEL AND THE CITY COUNCIL OF THE CITY OF ROSEMEAD APPROVING AND ACCEPTING NEGOTIATED EXCHANGE OF PROPERTY TAX REVENUE RESULTING FROM "ANNEXATION 18" TO THE CITY OF SAN GABRIEL (DETACHMENT FROM THE CITY OF ROSEMEAD AND FROM CONSOLIDATED FIRE PROTECTION DISTRICT OF LOS ANGELES COUNTY) WHEREAS, pursuant to Section 99 of the Revenue and Taxation Code, prior to the effective date of any jurisdictional change, the governing bodies of all agencies whose service areas or service responsibilities would be altered by such change must determine the amount of property tax revenue to be exchanged between the affected agencies and approve and accept the negotiated exchange of property tax revenues by resolution; but if the affected agency is a. special district, the Board of Supervisors must negotiate on behalf of the district; and WHEREAS, the Board of Supervisors of the County of Los Angeles, the City Council of the City of Rosemead and the City Council of the City of San Gabriel have determined that the amount of property tax revenues to be exchanged between their respective agencies as a result of reorganization proposal Identified as 'Annexation 18" to the City of San Gabriel (Detachment from the City of Rosemead and Consolidated Fire Protection District), is as set forth below. NOW THEREFORE, BE IT RESOLVED as follows: 1. The negotiated exchange of property tax revenues between the County of Los Angeles and the cities of Rosemead and San Gabriel resulting from the reorganization proposal identified herein is approved and accepted. 2. The City of Rosemead currently receives no property tax revenue attributable to the subject territory; therefore, there shall no transfer from the City of Rosemead to the City of San Gabriel of property tax revenue or incremental tax attributable to the "Annexation 18" area. 3. For fiscal years commencing July 1, 1993 or the July t after the effective date of this jurisdictional change, whichever is later, all property tax revenue received by the Consolidated Fire Protection District attributable to the San Gabriel "Annexation 18" area shall be transferred to the County of Los Angeles. 4. In the event that all or portion of the subject territory is included within a' redevelopment project pursuant to California Community Redevelopment Law, Health & Safety Code Sections 33000 et seq., the City of San Gabriel shall not adopt the ordinance approving the redevelopment plan with respect to the annexed area until such time as a report of the Fiscal Review Committee has been prepared pursuant to Health & Safety Code Section 33353.5, the report has been reviewed, and the Redevelopment Agency of the City of San Gabriel and the County have diligently and in good faith negotiated for the allocation of tax increment revenue for the project area. Agency and County shall begin negotiations on the allocation of tax increment revenues within fifteen (15) days after receipt of the County of the preliminary report from the Agency pursuant to Health & Safety Code Section 33344.5. -2- V PASSED, APPROVED and ADOPTED this day of 1992 by the City Council of the City of San Gabriel.
