2400 - Nationwide Environmental Services - Street Sweeping ServicesMAINTENANCE SERVICES CONTRACT [STREET SWEEPING SERVICES — NATIONWIDE ENVIRONMENTAL SERVICES] THIS AGREEMENT ("AGREEMENT") is made and entered into effective as of the 1st day of July, 2026, by and between the CITY OF ROSEMEAD, a general law city, located in the County of Los Angeles, State of California, hereinafter referred to as CITY and Nationwide Environmental Services, a California corporation, with principal offices at 11914 Front Street, Norwalk, CA, 90650, hereinafter referred to as CONTRACTOR. WIT NESSETH: For and in consideration of the promises and of the mutual covenants and agreements herein contained, said parties hereby agree as follows: 1. RECITALS. This AGREEMENT is made and entered into with respect to the following facts: (a) That CITY issued a Request for Proposals to obtain Street Sweeping maintenance services for the CITY; and (b) That CITY received four proposals, and after evaluating these proposals based upon qualifications, staff determined that CONTRACTOR was the most qualified to provide those certain street sweeping maintenance services to the CITY; and (c) That based upon Staff's recommendation, the Rosemead City Council has determined that CONTRACTOR is qualified to provide those certain Street Sweeping maintenance services, and therefore the Rosemead City Council has elected to engage the services of CONTRACTOR upon the terms and conditions hereinafter set forth. 2. SERVICES. CONTRACTOR shall perform those services described in Exhibit A attached hereto and incorporated herein by reference. To the extent that Exhibit A is a proposal from CONTRACTOR, such proposal is incorporated only for the description of the scope of services and no other terms and conditions from any such proposal shall apply to this AGREEMENT. Performance of the work specified herein is made an obligation of CONTRACTOR under this AGREEMENT, subject to any changes made subsequently upon the mutual written agreement of the parties. 4936-2161-9799 vl Maintenance Contract $50k or More 12/2025 Form 3 SCOPE. The services to be performed by CONTRACTOR under this AGREEMENT shall include, but not be limited to, those services specified in Paragraph 2 hereof. 4. FEE. Compensation to CONTRACTOR for the total services to be rendered pursuant to this AGREEMENT shall be in an amount not to exceed One Million Six Hundred Fifty -Four Thousand Nine Hundred Ninety -One Dollars ($1,654,991.00), allocated as follows: First Year (July 1, 2026 — June 30, 2027): $535,440 Second Year (July 1, 2027 — June 30, 2028): $551,503 Third Year (July 1, 2028 — June 30, 2029): $568,048 5. EXTRA SERVICES. No extra services shall be rendered by CONTRACTOR under this AGREEMENT unless such extra services first shall have been authorized in writing by the CITY. Any such services so authorized shall be paid by the CITY at the rates set forth in Exhibit A of this AGREEMENT. 6. PAYMENT BY CITY. (a) CONTRACTOR must furnish CITY with an invoice for all services rendered pursuant to this AGREEMENT. CONTRACTOR may not submit invoices more often than once every 30 days. (b) CITY will review each invoice and determine whether the services rendered in in accordance with this AGREEMENT. The CITY may require CONTRACTOR to provide a release of all undisputed amounts contained in the invoice. (c) If CITY disputes any item on an invoice, CITY will give CONTRACTOR notice stating the reasons for the dispute. The parties will meet and confer in good faith to attempt to resolve the dispute. (d) Except as to any charges for the services rendered that the CITY disputes, CITY will cause CONTRACTOR to be paid within 30 days of the date of the invoice or the date that CONTRACTOR furnishes CITY with a release of all undisputed amounts, whichever occurs later. (e) In the event there is any claim specifically excluded by CONTRACTOR from the operation of any release, CITY may retain an amount not to exceed the amount of the excluded claim. (f) Said compensation shall cover all expenses, losses, damages, and consequences arising out of the nature of the work during its progress or prior to its acceptance including those for well and faithfully completing the work and the whole thereof in the manner and time specified in the AGREEMENT, and also including those arising form actions of the elements, unforeseen difficulties or obstructions encountered in the prosecution of the work, suspension or discontinuance of the work, and all other unknowns or risks of any description connected with the work. 4936-2161-9799 vl Maintenance Contract $50k or More 12/2025 Form 7. CITY SUPERVISION. The Director of Public Works or his/her designee, shall have the right of general supervision of all work performed by CONTRACTOR and shall be the CITY's agent with respect to obtaining CONTRACTOR's compliance hereunder. No payment for any services rendered under this AGREEMENT shall be made without the prior written approval of the CITY 8. TIME. The term of this AGREEMENT shall expire on June 30, 2029, unless sooner terminated as provided in Section 12 herein. The CITY retains at its sole and absolute discretion options to extend said AGREEMENT for up to two (2) one-year extensions. 9. TERMINATION OF AGREEMENT. (a) Except as otherwise provided, CITY may terminate this AGREEMENT at any time with or without cause upon providing written notice to CONTRACTOR at least four (4) months before the effective termination date. Notice of termination will be in writing. In the event of a termination for convenience, the CITY, based upon work accomplished by CONTRACTOR prior to notice of such termination, shall determine the amount of fees to be paid to CONTRACTOR for such services based upon accepted practices of the CONTRACTOR'S field of work, and such finding by the CITY, and shall be final and conclusive as to the amount of such fee. (b) Should the AGREEMENT be terminated pursuant to this Section, CONTRACTOR shall immediately cease work except for work necessary to secure the job site and any materials not yet incorporated into the work. Once the job site is secured, CONTRACTOR shall vacate the premises. CITY may procure on its own terms services similar to those terminated. (c) By executing this document, CONTRACTOR waives any and all claims for damages that might otherwise arise from CITY's termination under this Section. 10. INDEPENDENT CONTRACTOR. CONTRACTOR is and will at all times remain as to CITY a wholly independent contractor. Neither the CITY nor any of its officers, employees, or agents will have control over the conduct of CONTRACTOR or any of CONTRACTOR's officers, employees, agents or subcontractors, except as expressly set forth in the AGREEMENT. CONTRACTOR may not at any time or in any manner represent that it or any of its officers, employees, agents, or subcontractors are in any manner officers, employees, agents or subcontractors of CITY. 11. NONASSIGNMENT. This AGREEMENT is not assignable either in whole or in part by CONTRACTOR without the written consent of CITY, which shall not be unreasonably withheld. For the purposes hereof, an assignment shall be deemed to include a change in any person or entity that is the controlling shareholder of CONTRACTOR as presently constituted, or any merger or dissolution of CONTRACTOR. Notwithstanding the above, CONTRACTOR or any shareholder in CONTRACTOR may assign or transfer its shareholder interest to a person who is a member of the Samuelian 4936-2161-9799 vl Maintenance Contract $50k or More _3 12/2025 Form family by birth or marriage, or to a trust for the benefit of a person who is a member of the Samuelian family by birth or marriage, without the prior approval of the City Council." 12. INDEMNIFICATION. To the furthest extent permitted by law (including, without limitation, Civil Code Section 2782), CONTRACTOR hereby agrees to and shall hold CITY, its elective and appointive boards, officers, agents, employees, and volunteers, harmless from any liability for damage or claims for damage for personal injury, including death, as well as from claims for property damage which may arise from CONTRACTOR's negligent acts, errors or omissions under this AGREEMENT. CONTRACTOR agrees to, and shall defend CITY and its elective and appointive boards, officers, agents, employees, and volunteers from any suits or actions at law or in equity for damages caused, or alleged to have been caused, by reason of any of the aforesaid negligent acts, errors or omission; provided (a) That CITY does not, and shall not, waive any rights against CONTRACTOR which it may have by reason of the aforesaid hold -harmless AGREEMENT because of the acceptance by CITY or the deposit with CITY by CONTRACTOR, of any of the insurance policies hereinafter described in this AGREEMENT. (b) That the aforesaid hold -harmless AGREEMENT by CONTRACTOR shall apply to all damages and claims for damages of every kind suffered, or alleged to have been suffered, by reason of any of the aforesaid operations of CONTRACTOR, or any subcontractor of CONTRACTOR, regardless of whether or not such insurance policies shall have been determined to be applicable to any of such damages or claims for damages. (c) The provisions of this section do not apply to Claims occurring as a result of the CITY's sole negligence or willful acts or omissions. In the event of any dispute between CONTRACTOR and CITY, as to whether liability arises from the sole or active negligence of the CITY or its officers, employees, or agents, CONTRACTOR will be obligated to pay for CITY's defense until such time as a final judgment has been entered adjudicating the CITY as solely or actively negligent. CONTRACTOR will not be entitled in the absence of such a determination to any reimbursement of defense costs including but not limited to attorney's fees, expert fees, and costs of litigation. 13. NON-DISCRIMINATION. CONTRACTOR shall not discriminate in its recruiting, hiring, promotion, demotion or termination practices on the basis of race, religious creed, color, national origin, ancestry, physical disability, mental disability, medical condition, martial status, sex, age, or sexual orientation in the performance of this AGREEMENT and shall comply with the provisions of the California Fair Employment and Housing Act as set forth in Part 2.8 of Division 3, Title 2 of the California Government Code; the Federal Civil Rights Act of 1964, as set forth in Public Law 88-352, and all amendments thereto; Executive Order 11246; and all administrative rules and regulations issued pursuant to such acts and order. 4936-2161-9799 v 1 Maintenance Contract $50k or More 4- 12/2025 Form 14. PREVAILING WAGES. CONTRACTOR is aware of and agrees to abide by the provisions of California Labor Code Sections 1720, et seq., as well as 1771, 1773, 1773.1, 1773.6, 1773.7, 1775 and 1776, pertaining to the obligation to pay prevailing wages with respect to the performance of work as described in Paragraph 2 herein. Copies of the prevailing rate of per diem wages and the general prevailing rate for holiday and overtime work for each craft are available upon request from the CITY. A copy of the prevailing rate of per diem wages shall be posted at the job site. In the event the law changes to no longer require the payment of Prevailing Wage Rates, the parties agree to meet in good faith to renegotiate the cost of the contract to address any reduced wages being paid to the Contractor's employees. CONTRACTOR and its subcontractors must keep accurate certified payroll records showing the name, occupation, and the actual per diem wages paid to each worker employed in connection with this AGREEMENT. If requested by CITY, CONTRACTOR must provide copies of the records at its cost. 15. UNAUTHORIZED ALIENS. CONTRACTOR hereby promises and agrees to comply with all of the provisions of the Federal Immigration and Nationality Act (8 USCA 1101, et seq.), as amended; and, in connection therewith, shall not employ unauthorized aliens as defined therein. Should CONTRACTOR so employ such unauthorized aliens for the performance of work and/or services covered by this AGREEMENT, and should the Federal Government impose sanctions against the CITY for such use of unauthorized aliens, CONTRACTOR hereby agrees to, and shall, reimburse CITY for the cost of all such sanctions imposed, together with any and all costs, including attorney's fees, incurred by the CITY in connection therewith. 16 WAIVER. Waiver by any party hereto of any term, condition, or covenant of this AGREEMENT shall not constitute the waiver of any other term, condition or covenant hereof. 17. ATTORNEY'S FEES. If litigation is reasonably required to enforce or interpret the provisions of this AGREEMENT, the prevailing party in such litigation shall be entitled to an award of reasonable attorney's fees, in addition to any other relief to which it may be entitled. 18. BINDING EFFECT. This AGREEMENT shall be binding upon the heirs, executors, administrators, successors and assigns of the parties hereto. 19. PROVISIONS, CUMULATIVE. The provisions of this AGREEMENT are cumulative and in addition to and not in limitation of any rights or remedies available to CITY. 20. NO PRESUMPTION RE: DRAFTER. The parties acknowledge and agree that the terms and provisions of this AGREEMENT have been negotiated and discussed between the parties and their attorneys, and this AGREEMENT reflects their mutual AGREEMENT regarding the same. Because of the nature of such negotiations and discussions it would be inappropriate to deem any party to be the drafter of this AGREEMENT; and, therefore, no presumption for or against validity or as to any interpretation hereof, based upon the identity of the drafter, shall be applicable in interpreting or enforcing this AGREEMENT. 4936-2161-9799 v I Maintenance Contract $50k or More 5_ 12/2025 Form 21. ASSISTANCE OF COUNSEL. Each party to this AGREEMENT warrants to each other party as follows: (a) That each party either had the assistance of counsel or had counsel available to it, in the negotiation for, and execution of, this AGREEMENT, and all related documents; and, (b) That each party has lawfully authorized the execution of this AGREEMENT. 22. MODIFICATION. This AGREEMENT shall not be modified except by written agreement of the parties. 23. GOVERNING LAW. This AGREEMENT shall be interpreted and construed according to the laws of the State of California. 24. NOTICE. If the notice is mailed, notice will be deemed given three days after deposit of the same in the custody of the United States Postal Service, postage prepaid, for first class delivery, or upon delivery if using a major courier service with tracking capabilities. Changes may be made in the names or addresses of persons to whom notices are to be given by giving notice in the manner prescribed in this paragraph. Neither party shall be responsible for delays or failures in performance resulting from acts beyond the control of the offending party. Such acts shall include, but not be limited to, acts of God, fire, flood, earthquake, or other natural disaster, nuclear accident, explosion war, terrorist attack, embargo, strike, lockout, riot, freight embargo, public regulated utility, or government statutes or regulations superimposed after the fact. Notwithstanding the foregoing, this provision shall only have effect if written 4936-2161-9799 vt Maintenance Contract $50k or More 12/2025 Form notice of the force majeure event is given by the party claiming such excuse for delay within ten days of the commencement of such event. 26. INSURANCE. CONTRACTOR shall not commence work under this AGREEMENT until CONTRACTOR shall have obtained all insurance required by this AGREEMENT and such insurance shall have been approved by CITY as to form, amount and carrier, nor shall CONTRACTOR allow any subcontractor of CONTRACTOR to commence work on any subcontract until all similar insurance required of the subcontractor of CONTRACTOR shall have been so obtained and approved. A. WORKERS' COMPENSATION INSURANCE. CONTRACTOR shall take out and maintain, during the life of this contract, Workers' Compensation Insurance and Employer's Liability Insurance for all of CONTRACTOR's employees employed to perform the SERVICES as described section 2 of the AGREEMENT; and, if any work is sublet, CONTRACTOR shall require the subcontractor of CONTRACTOR similarly to provide Workers' Compensation Insurance and Employers' Liability Insurance in accordance with the laws of the State of California, Section 3700 for all of the latter's employees, unless such employees are covered by the protection afforded by CONTRACTOR. If any class of employees engaged in work under this AGREEMENT is not protected under any Workers' Compensation law, CONTRACTOR shall provide and shall cause each subcontractor of CONTRACTOR to provide adequate insurance for the protection of employees not otherwise protected. CONTRACTOR shall indemnify CITY for any damage resulting to it from failure of either CONTRACTOR or any subcontractor of CONTRACTOR to take out or maintain such insurance. Workers Compensation Insurance in the amount of not less than Statutory Limits set by the State of California. Employer's Liability Insurance in the amount of not less than ONE MILLION DOLLAR ($1,000,000). B. GENERAL LIABILITY PROFESSIONAL LIABILITY AUTOMOBILE LIABILITY INSURANCE. Commercial General Liability Insurance. CONTRACTOR shall maintain commercial general liability insurance with coverage at least as broad as Insurance Services Office form CG 00 01, in an amount not less than $1,000,000 per occurrence, $2,000,000 general aggregate, for bodily injury, personal injury, and property damage. The policy must include contractual liability that has not been amended. Any endorsement restricting standard ISO "insured contract" language will not be accepted. 4936-2161-9799 vl Maintenance Contract $50k or More 12/2025 Form Pollution Liability Insurance. Pollution legal liability insurance coverage shall be in an amount no less than $1,000,000 per occurrence and $2,000,000 in the aggregate. Coverage shall be extended a minimum of three (3) years beyond the term of the contract and such insurance shall contain all standard extensions customary for such policy and shall cover prior acts. iii. Automobile Liability Insurance. CONTRACTOR shall maintain automobile insurance at least as broad as Insurance Services Office form CA 00 01 covering bodily injury and property damage for all activities of the CONTRACTOR arising out of or in connection with work to be performed under this agreement, including coverage for any owned, hired, non -owned, or rented vehicles, in an amount not less than $5,000,000 combined single limit for each accident. C. PROOF OF INSURANCE. CONTRACTOR shall provide certificates of insurance and required endorsements to CITY as evidence of insurance coverage required herein. Insurance certificates and endorsements must be approved by CITY prior to the commencement of work. Current certification of insurance shall be kept on file with CITY for the contract period and any additional length of time required thereafter. CITY reserves the right to require complete, certified copies of all required insurance policies, at any time. D. NOTICE TO COMMENCE WORK. The CITY will not issue any notice authorizing CONTRACTOR or any subcontractor to commence work under this AGREEMENT until CONTRACTOR has provided to the CITY Clerk the proof of insurance as required.. E. DURATION OF COVERAGE. CONTRACTOR shall procure and maintain for the contract period, and any additional length of time required thereafter, insurance against claims for injuries to persons or damages to property, or financial loss which may arise from or in connection with the performance of work hereunder by CONTRACTOR, their agents, representatives, employees, or subcontractors. F. PRIMARY/NONCONTRIBUTING. Coverage provided by CONTRACTOR shall be primary and an insurance or self-insurance procured or maintained by CITY shall not be required to contribute with it. The limits of insurance required herein may be satisfied by a combination of primary and umbrella or excess insurance. Any umbrella or excess insurance shall contain or be endorsed to contain a provision that such coverage shall also apply on primary and non- contributory basis for the benefit of CITY before the CITY's own insurance or self-insurance shall be called upon to protect it as named insured. G. CITY'S RIGHTS OF ENFORCEMENT. In the event any policy of insurance required under this agreement does not comply with these specifications or is canceled and not replaced, CITY has the right but not the duty to obtain the insurance it deems necessary, and any premium paid by CITY will be promptly reimbursed by CONTRACTOR or CITY will withhold amounts sufficient to pay 4936-2161-9799 vl Maintenance Contract $50k or More 12/2025 Form premium from CONTRACTOR'S payments. In the alternative, CITY may cancel this agreement. H. ACCEPTABLE INSURERS. All insurance policies shall be issued by an insurance company currently authorized by the Insurance Commissioner to transact business of insurance or is on the List of Approved Surplus Line Insurers in the State of California, with an assigned policyholder's Rating of A - (or higher) and Financial Size Category Class VII (or larger) in accordance with the latest edition of Best' Key Rating Guide, unless otherwise approved by the Director of Human Resources & Risk Management. WAIVER OF SUBROGATION. All insurance coverage maintained or procured pursuant to this agreement shall be endorsed to waive subrogation against CITY, its elected or appointed officers, agents, officials, employees, representatives and volunteers or shall specifically allow CONTRACTOR or others providing insurance evidence in compliance with these specifications to waive their right of recovery prior to a loss. CONTRACTOR hereby waives its own right of recovery against CITY and shall require similar written express waivers and insurance clauses from each of its subcontractors. J. ENFORCEMENT OF CONTRACT PROVISIONS (NON ESTOPPEL). CONTRACTOR acknowledges and agrees that any actual or alleged failure on part of the CITY to inform CONTRACTOR of non-compliance with any requirement imposes no additional obligations on the CITY nor does it waive any rights hereunder. K. REQUIREMENTS NOT LIMITING. Requirements of specific coverage features or limits contained in this section are not intended as limitation on coverage, limits or other requirements, or a waiver of any coverage normally provided by any insurance. Specific reference to a given coverage feature is for purposes of clarification only as it pertains to a given issue and is not intended by any party or insured to be all inclusive, or to the exclusion of other coverage, or a waiver of any type. If the CONTRACTOR maintains higher limits than the minimums shown above, the CITY requires and shall be entitled to coverage for the higher limits maintained by the CONTRACTOR. Any available insurance proceeds in excess of the specified minimum limits of insurance and coverage shall be available to the CITY. L. NOTICE OF CANCELLATION. CONTRACTOR agrees to oblige its insurance agent or broker and insurers to provide the CITY with a thirty (30) day notice of cancellation (except for nonpayment for which a ten (10) day notice is required) or nonrenewal of coverage for each required coverage. If any of the CONTRACTOR'S insurers are unwilling to provide such notice, then CONTRACTOR shall have the responsibility of notifying the CITY immediately in the event of CONTRACTOR'S failure to renew any of the required insurance coverages, or insurer's cancellation or nonrenewal. M. ADDITIONAL INSURED STATUS. General Liability, Automobile Liability, and umbrella/excess liability insurance policies shall provide or be endorsed to provide that CITY and its officers, officials, employees, agents, 4936-2161-9799 vl Maintenance Contract $50k or More 12/2025 Form representatives, and volunteers shall be additional insureds under such policies. N. PROHIBITION OF UNDISCLOSED COVERAGE LIMITATIONS. None of the coverages required herein will be in compliance with these requirements if they include any limiting endorsement of any kind that has not been first submitted to CITY and approved of in writing. O. SEPARATION OF INSUREDS. A severability of interests provision must apply for all additional insureds ensuring that CONTRACTOR'S insurance shall apply separately to each insured again whom claim is made or suit is brough, except with respect to the insurer's limits of liability. The policy(ies) shall not contain any cross -liability exclusions. P. PASS THOUGH CLAUSE. CONTRACTOR agrees to ensure that its subcontractors, subcontractors, and any other party who is brough onto or involved in the project/service by CONTRACTOR (hereinafter collectively "subcontractor"), provide the same minimum insurance coverage and endorsements required of CONTRACTOR. CONTRACTOR agrees to monitor and review all such coverage and assumes all responsibility for ensuring that such coverage is provided in conformity with the requirements of this section. However, in the event CONTRACTOR'S subcontractor cannot comply with this requirement, which proof must be submitted to the CITY, CONTRACTOR shall be required to ensure that its subcontractor provide and maintain insurance coverage and endorsements sufficient to the specific risk of exposure involved with subcontractor's scope of work and services, with limits less than required of the CONTRACTOR, but in all other terms consistent with the CONTRACTOR's requirements under this agreement. This provision does not relieve the CONTRACTOR' of its contractual obligations under the agreement and/or limit its liability to the amount of insurance coverage provided by its subcontractors. This provision is intended to solely provide CONTRACTOR with the ability to utilize a subcontractor who may be otherwise qualified to perform the work or services but may not carry the same insurance limits as required of the CONTRACTOR under this agreement given the limited scope of work or services provided by the subcontractor. CONTRACTOR agrees that upon request, all agreements with subcontractors, and others engaged in this project, will be submitted to CITY for review. Q. CITY'S RIGHT TO REVISE SPECIFICATIONS. The CITY reserves the right to at any time during the term of the contract to change the amounts and types of insurance required by giving the CONTRACTOR ninety (90) days advance written notice of such change. If such change results in substantial additional cost to the CONTRACTOR, the CITY and CONTRACTOR may renegotiate the CONTRACTOR'S compensation. R. SELF -INSURED RETENTIONS. Any self -insured retentions must be declared to and approved by CITY. CITY reserves the right to require that self -insured retentions be eliminated, lowered, or replaced by a deductible, or require proof of ability to pay losses and related investigations, claim administrative, and 4936-2161-9799 vl Maintenance Contract $50k or More _ 1 0_ 12/2025 Form defense expenses within the retention through confirmation from the underwriter. S. TIMELY NOTICE OF CLAIMS. CONTRACTOR shall give CITY prompt and timely notice of claims made or suits instituted that arise out of or result from CONTRACTOR'S performance under this agreement, and that involve or may involve coverage under any of the required liability policies. T. ADDITIONAL INSURANCE. CONTRACTOR shall also procure and maintain, at this own cost and expense, any additional kinds of insurance, which in its own judgment may be necessary for its proper protection and prosecution of the work. 27. ELECTRONIC TRANSMISSION OF AGREEMENT AND SIGNATURE. Of this total, commercial streets account for approximately 17 curb miles, which are swept twice per week. In addition, there are approximately 10 curb miles of median locations and 2 curb miles of parking lot areas that require weekly sweeping. Street sweeping is conducted Monday through Friday each week. In residential areas, sweeping takes place between 6:00 a.m. to 4:00 p.m. On major arterials, sweeping occurs between 2:00 a.m. to 6:00 a.m. on Tuesday and Fridays. The Contractor's proposal must address how the indicated services will be delivered. The Contractor shall be responsible for providing, at its expense, all labor, materials, and equipment necessary to perform street sweeping services on a weekly basis, including: • Sweeping all arterial, collector industrial, residential and commercial streets, cul- de -sacs, median island curbs, full roadbed on Rosemead Boulevard, and City park lots. • Removal of large items such as cardboard, palm fronds, and rocks. • Recycling of collected sweepings. • Providing additional sweeping services for special events and emergencies. The city currently conducts street sweeping by zones wherein each zone is serviced on the same day within a four-hour period, as shown in Attachment C. The City is now exploring a potential adjustment to the existing schedule in which both sides of residential streets could be swept on different days and/or different times. Vendors are required to submit a cost proposal for both Option A and Option B. Contractor shall provide all labor and equipment necessary to perform street sweeping services to City in accordance with the terms and conditions of the Agreement and Attachments B, C, and D. Provide an organizational chart showing all proposed contract team members. Describe the responsibilities of each person on the contract team. Identify the Contract Manager and the person(s) who will be the key contact(s) with the City of Rosemead. Indicate how many hours each team member will devote to the contract by task, along with a statement indicating the availability of the members of the contract team for the duration of the contract. Definitions "Streets" shall mean all dedicated public rights -of -way within the existing or future limits of the City. Page 1 of 11 "Debris" shall mean all litter, rubbish, leaves, sand, dirt, garbage, and otherforeign material removal from a paved street with a street sweeper. "Curb -mile" means a swept path not less than eight (8) feet wide for a cumulative total length of 5,280 feet. "Roadbed" means entire street pavement from curb to curb. Description of Required Services and Experience Manner of Service. Contractor shall provide a Complete Sweep of all Curb Miles on all publicly maintained City Streets once a week, at a minimum. Within any curb mile, Contractor shall be responsible for sweeping all curbs including median islands and the corners from any cross street intersecting the subject street. The entire area of each intersection shall be swept. The balance of each street shall be swept as needed. The entire roadbed of Rosemead Boulevard (within City limits) shall be swept each time the street is swept. No debris shall be left on the street pavement after sweeping is completed. All curbs of select City parking lots in the City shall be swept once per week, the selected Contractor will sweep these areas using a method approved by the Public Works Manager. Contractor shall obey all laws governing the operation of the sweepers on a public street and shall perform its operations so that sweepers are traversing their routes in the normal direction of traffic. 2. Labor and Materials. Contractor shall furnish all materials, labor, supervision and equipment necessary to perform all work required for regularly scheduled sweeping of all public streets in the City. Exceptions resulting from equipment breakdowns shall be immediately reported to the City with a catch-up schedule. 3. Maps. Contractor shall provide the street sweeping service route maps to the City Representative upon request, within ninety (90) days from receipt of written notice. The maps shall be provided in a format that can be posted to the City website. 4. Sweeping Method. Unsweepable items that impede sweeping, such as palm fronds, rocks, trash and debris shall be removed from the sweeping path and properly disposed of by the operator rather than driving around them. Items that impede sweeping and are immovable such as construction debris and impaired vertical or horizontal clearance by tree limbs shall be reported to the City immediately for correction. Contractor is not responsible for areas missed due to parked cars or other personal property. Sweeper operators shall immediately report to Contractor and the City all Illicit discharges observed during routes. Contractor shall train all operators to recognize Illicit discharges and stormwater pollution sources prior to work as street operators and annually thereafter, using City - approved training materials. Such training shall be documented and made available for review by the City. Page 2 of 11 5. Standing Water/Drainage Problems. In areas where drainage is a problem, Contractor shall make as many passes as necessary to remove debris from standing water. In addition, all sand, dirt, rocks, gravel, vegetation, and other sweepable debris shall be removed from the street during the sweeping operation. If standing water is over the top of curb, then Contractor shall not be required to sweep that specific area. Sweeper operators shall report all areas with drainage problems to Contractor and City monthly. 6. Standards of Service. All areas swept under this Agreement shall be thoroughly cleaned. All debris shall be picked up by the sweeper unit and disposed of at Contractor's expense. Sweeping shall include the removal of all sand, gravel, dirt, litter, vegetation, and any and all other debris that accumulates between sweeps. Curb lines shall be swept along both sides of the roadway, or to the edge of pavement where no curb exists, along all curbs on raised medians, overall portions of painted medians, painted left and right turn pockets, and all intersection cross gutters. Sweeping shall normally require one pass over an area. Contractor shall make additional passes or make such extra effort required to adequately clean the street to the satisfaction of the City. Extra effort shall be required when sweeping equipment leaves a dirt/silt smear in its swept path. Such services will be requested in writing at least twenty-four (24) hours in advance, whenever practical, except for emergency call -outs. The service standards in this Article may be reviewed and modified as conditions warrant to maintain cleanliness by the City or as necessary to comply with any regulatory permits issued to City. 7. Water. Contractor shall obtain water services from the appropriate water utility the water necessary in the street sweeping operation and use sufficient water to prevent dust arising during sweeping operations. Contractor shall consult with the appropriate water utility for a map of preferred hydrant locations to be used whenever feasible. The cost of the water shall be borne by Contractor. 7.1. When possible, Contractor shall use reclaimed or tertiary recycled water 7.2. Contractor shall not discharge liquid waste from the sweeper units onto City streets or into the storm drain system. 7.3. Washing of sweepers on City property is prohibited. Contractor shall implement best management practices when loading water into the street sweepers to prevent any overflow/potable water discharges into the storm drain system. 8. Sweeper Speed. Contractor shall operate the sweepers at a speed of not more than five (5) miles per hour in residential areas and eight (8) miles per hour in commercial areas when sweeping or when the sweeper brooms are down, unless Contractor can demonstrate that the sweeper can operate efficiently and safely at a higher speed. City will use industry standards, Environmental Protection Agency information, and the sweeper manufacturer's recommendations on the speed of sweepers when considering greater speeds. 9. Width of Sweeper Path. Contractor shall sweep all curb miles and all bike lanes with all brooms down, unless parked vehicles, structures, or other objects prohibit Page 3 of 11 the safe sweeping of this path width. The path shall begin at the face of the curb and include the flow line of the gutter. Unless blocked by parked cars, Garbage Carts, Recycling Carts, or Organics Carts the face of the curb and gutter shall always be included within the sweeper path. On those residential streets with no curb, the width of the sweeper path shall be not less than eight (8) feet measured from the edge of the pavement toward the center of the street. 10. Street Sweeping Frequency. 10.1. Residential Streets. Contractor shall provide street sweeping service for each curb mile of residential streets in the City once per week on a scheduled route basis. However, in those instances where the scheduled street sweeping service day falls on a Holiday, Contractor may adjust the route schedule as necessary. This specifically includes: • All public residential streets within the City limits. 10.2. Commercial Streets. Contractor shall provide street sweeping service for each curb mile of commercial streets in the City twice per week on a scheduled route basis. However, in those instances where the scheduled street sweeping service day falls on a Holiday, Contractor may adjust the route schedule as necessary. 10.3. Parking Lots. Contractor shall provide street sweeping service for each curb mile of select parking area in the City once per week on a scheduled route basis. However, in those instances where the scheduled street sweeping service day falls on a Holiday, Contractor may adjust the route schedule as necessary. 10.4. Change in Frequency. The City may direct Contractor to change the frequency of street sweeping for any City street. Contractor shall implement City -directed changes in frequency within fifteen (15) Work Days of receipt of written notice from the City Representative to adjust sweeping frequency. Any changes shall be discussed and mutually agreed to in manner and cost. 11. Street Sweeping Hours of Service. 11.1. Days. Routine street sweeping shall be conducted Monday through Friday unless otherwise approved by the Public Works Director. 11.2. Hours. Standard operating hours for street sweeping under this agreement shall be determined by the City and the Contractor. Identified arterial streets and commercial streets shall be swept from 2:00 AM to 6:00 AM. Residential streets shall be swept from 6:00 AM to 4:00 PM. Some areas may be posted with different hours than noted above. It is the Contractors responsibility to familiarize themselves with these areas and adjust the sweeping schedule accordingly with City approval. 11.3. Holidays. The contractor is not required to sweep streets on Sundays nor on any of the following holidays: New Years Day Martin Luther King Day Page 4 of 11 President's Day Independence Day Veterans Day Christmas Day Memorial Day Labor Day Thanksgiving Day During the week of a holiday, the Contractor shall adjust the weekly schedule so as to return to the normal weekly schedule the following week. Sweeping scheduled for a holiday shall be completed within seven (7) days following the holiday. No modification of this holiday schedule shall be effective unless authorized in writing by the Public Works Director. 12. City Special Events Contractor will provide street sweeping services free of charge in conjunction with up to four (4) City sanctioned events each year. At times, sweeping may be required before and after the event. These events may include the City's Fourth of July Parade and Festival (July each year), the Superhero 5k Fun Run (May each year), and the City's Moon Festival (September each year). 13. Street Changes. City and Contractor acknowledge that it may be necessary or desirable to add or delete City streets for which Contractor will provide street sweeping services or to temporarily modify sweeping schedules. City will provide notice of any such changes to Contractor which may be caused by the following: • Construction or development on or along a street. • Pavement maintenance activities, including the chip seal program or the slurry seal program. • Inclement weather when running water renders sweeping ineffective. • Special sweeping on alternative schedule. • Other legitimate reasons that make sweeping impractical as determined by the City Representative. 14. Street Additions. As new streets are constructed and accepted by City, City may, at City's sole option, designate such streets as part of the Service Area for the purposes of street sweeping services. If the City Representative designates such streets as part of the Service Area, Contractor shall provide street sweeping service on such streets under the terms and conditions of this Agreement within fifteen (15) workdays of receipt of written notice from the City Representative to begin service. Any changes under this section shall be subject to Agreement section 3.3.4 "Extra Work". 15. Street Deletions. City may require some City streets to be temporarily or permanently removed from the list of scheduled streets for which Contractor provides street sweeping service under this Agreement. Contractor shall immediately cease providing street sweeping service to any City Street upon receipt of written notice from the City Representative to stop such service. When a City Page 5 of 11 Street has been temporarily removed from the list of scheduled streets, Contractor shall resume street sweeping service on such street in the next regularly scheduled cycle following the receipt of written notice from the City Representative to resume service. 16. Revised Maps. Contractor shall revise the street sweeping service route maps to show the addition or deletion of City Streets as provided above and shall provide such revised maps to the City Representative upon request, within ninety (90) days from receipt of written notice. The maps shall be provided in a format that can be posted to the City website. 17. Parking Citation Officer — Coordination. The City may use a Parking Control Officer to cite vehicles for parking during street sweeping hours. The contractor shall coordinate their sweeping activities with the Parking Control Officer. All costs for coordination are the responsibility of the contractor, and no additional compensation will be allowed. 18. Adverse Weather Conditions. Because of varying rain conditions throughout the City, Contractor may verbally request permission from the City Representative to cancel sweeping during heavy and persistent rainstorms within the Service Area. Contractor may cancel sweeping only with the prior consent of the City Representative. 19. Hazardous Waste. Contractor shall not be required to remove any Hazardous Waste from the street surface. If, while performing street sweeping services, any suspected Hazardous Waste is encountered, Contractor shall immediately report the location to the City Representative, and any other responsible agency. 20. Disposal of Sweep Waste. Contractor shall transport and deliver all sweep waste to designated bins. Contractor will collect all bins containing sweep waste and deliver to a facility in a manner that meets applicable regulatory requirements. In the event the facility is closed on a workday or is otherwise unable to accept the sweep waste, Contractor shall transport and deliver the sweep waste to another legally permitted facility. 21. Spillage. During hauling, all sweep waste shall be contained, covered and enclosed so that leaking, spilling and blowing of the sweep waste is prevented. Contractor shall be responsible for the immediate clean-up of any spillage caused by Contractor. 21.1. Equipment oil, hydraulic fluids, or any other liquid or debris resulting from Contractor's operations or equipment must be covered immediately with an absorptive material and removed from the street surface. Contractor must notify City within two (2) hours of any spills resulting from Contractor's operations or equipment. When necessary, Contractor must apply a suitable cleaning agent to the street surface to provide adequate cleaning. 21.2. The above paragraphs notwithstanding, Contractor must clean up any spillage caused by Contractor within two (2) hours upon notice from the City. If City deems necessary, Contractor must engage third -party environmental clean-up specialist to remove any equipment oil, hydraulic fluids, or any other Page 6 of 11 liquid or debris that remains on street after Contractor's own clean-up efforts. If clean-up is not conducted to satisfaction of City, City has right to engage environmental clean-up specialist to perform additional clean-up work at the expense of Contractor. 21.3. To facilitate such cleanup, Contractor's vehicles must at all times carry sufficient quantities of petroleum absorbent materials along with a broom and shovel. 22. Street Sweeping Service Routes. Not less than forty-five (45) days prior to commencement of street sweeping services, Contractor shall submit to the City Representative, Service Area maps precisely defining the Sweeper Routes for review and approval by the City Representative. The route maps shall include the days of the month sweeping shall occur, the sweeping schedules in adjacent areas, the areas of the City to be swept, the start and finish of each route, the location of each dumpsite, and any special needs such as early starts, and late finishes. 22.1. The City Representative may provide written comments on the preliminary maps to Contractor no later than twenty (20) Work Days after receipt of the maps from Contractor. Contractor shall revise the maps to reflect such comments and return them to the City Representative within twenty (20) workdays after receipt of the City Representative's comments. 22.2. Upon approval by the City Representative of the final Sweeper Route maps, Contractor shall develop and maintain the Sweeping Routes on a computerized mapping system that is compatible with City's mapping system to the extent possible. Street Sweeping maps provided to the City shall be in a format that is suitable for posting to the City website. 22.3. Changes in maps shall be provided by the City, and Contractor shall update the maps in Contractor's system every month. Such changes shall also be reflected in Contractor's printed route maps. Contractor shall submit to the City Representative, in writing, any proposed route change (including maps thereof) not less than forty-five (45) days prior to the proposed date of implementation. 22.4. The City Representative may provide written comments to Contractor on such proposed change no later than ten (10) workdays after receipt of the proposal from Contractor, and Contractor shall revise the routes to reflect such comments and return them to the City Representative within ten (10) workdays of receipt of such comments. 22.5. Contractor shall not implement any route changes without the prior written approval of the City Representative. If the approved route change will change the day on which street sweeping service will occur, Contractor shall notify the affected Service Recipients of route changes not less than thirty (30) workdays before the proposed date of implementation in a manner approved by the City Representative. 23. Other City Sweep Service. If during the Term, circumstances exist that require work associated with the street sweeping service program that is not specifically Page 7 of 11 provided for in this Agreement, the City Representative may require Contractor to perform such other associated work ("OAW"). Any changes under this section shall be subject to Agreement section 3.3.4 "Extra Work". 23.1. When Contractor performs OAW, the labor, materials, and equipment used in the performance of such work shall be subject to the prior written approval of the City Representative. 23.2. Examples of OAW that Contractor may be required to perform include: performance of special sweeps, flood clean-up, street sanitation for parades and celebrations, City requested clean-up services, and any contingency where sweeper and supporting sweeper equipment could assist in a particular instance. 24. Street Sweeping Quality of Work. The standards of performance which Contractor is obligated to meet are those good street sweeping practices which leave the service area in a debris and dirt -free condition and using sufficient water to avoid airborne dust arising from equipment operation. 25. Street Sweeping Equipment. 25.1. General Provisions. All street sweeping service equipment used by Contractor in the performance of services under this Agreement shall be of a high quality and of the vacuum type in conformance with the City's MS4 Permit. The collection vehicles shall be designed and operated to prevent collected materials from escaping from the collection vehicles. Hoppers shall be closed on top and on all sides with screening material to prevent collected materials from leaking, blowing, or falling from the collection vehicles. All sweepers shall have an operational amber dome lights and flashing back-up taillight alarm and shall conform to all Federal, State and local government safety requirements. 25.2. Clean Air Collection Vehicles. During the Term, to the extent required by law, Contractor shall provide its Street Sweeping vehicles to be in full compliance with all Applicable Laws, including State and federal clean air requirements that are adopted including, but not limited to, the California Air Resources Board Heavy Duty Engine Standards. California Air Resources Board (CARB) — Contractor's fleet shall be fully compliant with all CARB regulations governing heavy-duty diesel vehicles. South Coast Air Quality Management District — Rule 1186 relating to alterative fueled sweeping equipment. Equipment shall meet all applicable certifications for PM 10 and other pollutants as set forth by the South Coast Air Quality Management District. All equipment shall meet or exceed all applicable AQMD and CARB regulations. 25.3. Vehicle Noise Level. All Street Sweeping operations shall be conducted as quietly as possible and must comply with Applicable Laws, including federal EPA noise emission regulations, currently codified at Code of Federal Regulations, Title 40, Part 205. Page 8 of 11 25.4. Backup Equipment. Contractor shall have available to it, at all times, backup collection and street sweeping service equipment that can be put into service and operation within one (1) hour of any breakdown. Such reserve equipment shall correspond in size and capacity to the equipment used by Contractor to perform Contractor's duties under this Agreement. 25.5. Condition of Equipment. All equipment shall be maintained in good mechanical condition, including brushes and brooms that shall be replaced at regular intervals. At the start of service, all vehicles and equipment used in accordance with sweeping activities shall be new or no older than one year old and must meet all applicable local, state, and federal air quality laws, rules, and regulations Sweepers must be identifiable by a unique number or some other prominent symbol, such as a company logo. 25.6. Remediation of Leaks and Spills. The Contractor Shall notify the City immediately upon observation of any leak or spill discarded from its vehicle. The Contractor shall immediately take all measures necessary to prevent the discharge of any pollutant into a storm drain. The cleanup of any leak or spill from its vehicle must take place immediately, removing the oil in the most effective manner. All sweepers must be equipped with absorbent for such cleanup efforts. 25.7. Storage. Sweeping equipment shall not be stored in the public right of way unless mechanical failure prevents immediate removal. In the event of mechanical failure, all efforts must be made to remove the equipment from the public right of way as soon as possible. The City must approve any overnight storage in public right of way. Contractor may enter into optional Storage Agreement with City to store Sweeper equipment at City facility. In the absence of such Storage Agreement with City, sweeping equipment shall not be stored on City Property. 25.8. City inspection. All equipment is subject to inspection by the City at anytime 26. Staffing. All Street Sweeper operators shall abide by the requirements set forth in this Agreement. Contractor's employees shall be required to wear a clean uniform bearing the Contractor's name. Employees who normally and regularly come into contact with the public shall also bear some means of individual identification, such as a nametag or identification card. Employees shall not remove any portion of their uniform while working in the City. Employees driving the Contractor's vehicles shall at all times possess and carry A valid commercial drivers license issued by the state of California. Any person employed by the Contractor who fails or refuses to carry out the directions of the City, acts in a disorderly, improper, or unsafe manner or shows signs of intoxication or impairment shall be immediately removed from thejob site by the Contractor. Prior to returning a removed employee to work within the City, the Contractor shall provide in writing the reason for the individuals behavior and the means used to prevent the behavior from occurring again. Failure of the Contractor Page 9 of 11 to prevent, prohibit, or resolve problems with its employees working within the city will result in sweeping operations being suspended until further notice. The City may enter a contract with another party for street sweeping services during such a suspension, and the Contractor will be liable for all costs. 27. Communication. Contractor shall have direct communication with all sweeping operators in the field utilizing radios or cellular telephones. Each sweeper operator shall have the ability to communicate verbal information immediately to City staff, Police and Fire Department personnel, residents, and to report illicit stormwater discharges and hazardous street or drainage conditions to the City. Contractor shall also report missed routes and citizen complaints and resolution to the City on a weekly basis, when applicable. 27.1. Contractor shall supply a 24-hour message telephone number to the City Traffic Engineer so that the City can notify Contractor of traffic counter installations. 27.2. Drivers shall be aware of their locations to raise their brooms and avoid destruction of traffic counter cables. Contractor shall use due diligence to avoid traffic counter cables. 27.3. The contractor shall utilize route -tracking GPS technology to document sweeping activities, and all data and portal access shall be made available to City staff. 28. Emergency Response The Contractor shall provide the City with a good working number to a designated liaison(s) that is reachable/available twenty-four (24) hours per day, seven (7) days per week, for any emergency response and urgent operational coordination. The designated liaison(s) shall: 28.1. Be available to respond to the City inquires within thirty (30) minutes of contact. 28.2. Have decision -making authority to mobilize crew and deploy equipment. 28.3. Coordinate directly with City staff, including Public Works, Parking Enforcement, Police and Fire, when applicable. 28.4. The Contractor shall have a target arrival within two (2) hours of the initial call, for crew/ driver to be onsite for any after -hour emergency callout. The Contractor shall notify the City in writing within Twenty-four (24) hours of any changes to the designated liaison(s) or contact information. 29. Deficiencies and Corrections. The City may also make regular unannounced inspections of Street Sweeping locations if a swept area is deemed to be below acceptable performance standards, the substandard section shall be re -swept within one (1) workday of notification. Contractor shall resweep at their own expense. The City shall be notified of the completed re -sweep. Page 10 of 11 30. City MS4 Permit. Contractor shall meet street sweeping requirements included in the City's current Stormwater Discharge Permit as it may be amended, revised, or reissued from time to time ("MS4 Permit"). 31. Records and Reports. The following reports shall be submitted to the City each month along with the invoice for services. 1) Monthly Log Report. The Contractor shall keep a daily log of all streets swept, including the name and location of the streets and the number of curb - miles swept, along with a description of any special services performed. The log shall be signed by the Supervisor on a daily basis. Each month, a report shall be prepared from the daily log giving a brief description of all routine special and emergency activities. 2) Emergency Calls. The Contractor shall maintain a positive recording of all emergency service calls, by telephone recording device or by a time punch- type trouble ticket. Such information shall be entered on the monthly log report. 3) Amount of Debris. The Contractor shall maintain a separate measurement and record detailing the amount of debris collected during sweeping activities. This information, required as part of the City's NPDES permit, must be submitted to the City each month in a tabulated, easy to read format. 4) Recycled Debris. All materials collected during street sweeping activities shall be transported and recycled /disposed of in accordance with City, County, State, and Federal requirements. When possible, debris will be diverted from landfill disposal. The City shall be notified which facilities are used to process sweeping debris. The successful Contractor shall be solely responsible for all fees involved in the recycling /disposal of sweepings collected in the City. Indicate the facilities where sweeping debris will be taken and programs that will be used to ensure the diversion of debris from landfill disposal. The Contractor shall maintain a separate measurement and record detailing the amount of debris deposited at a composting or recycling facility. The record shall also identify the name and address of the facility. This information shall be submitted to the City in a tabulated, easy to read format. 5) Complaints. Complaints received by the City regarding the Contractor's performance will be transmitted to the Contractor's office in writing, by telephone, or email, and handled by the Contractor's Supervisor. All complaints are to receive a follow-up response within twenty-four (24) hours following notification of the Contractor. A report of the Contractor's investigation and the corrective action taken shall be made promptly by the Contractor to the Public Works Director. Ani Samuelian, President (Contract Manager) Ani Samuelian has been employed with NES since 1994 and currently serves as the company's President. In this executive role, she oversees all operational aspects of the organization, including contract administration, insurance, human resources, accounts payable and receivable, payroll, and customer service. His extensive responsibilities include supervising daily operations, designing efficient routes, managing disposal operations, and monitoring field operations for optimal performance. Nejteh manages the mechanics team, ensuring all equipment is well -maintained. He regularly meets with City staff to coordinate sweeping schedules and addresses any concerns. He is a Certified Stormwater Inspector, contributing to NES's commitment to environmental stewardship, and actively participates in industry associations such as the L.A. Chapter Maintenance Superintendents Association (MSA), the North American Power Sweeping Association (NAPSA), and the California Contract Cities Association (CCCA). Sweeper Operators The designated sweeper operators assigned to the City of Rosemead contract bring extensive expertise in municipal street sweeping. Each operator possesses comprehensive training in equipment handling, route optimization, and adherence to all safety protocols and regulatory requirements. All operators maintain valid California Commercial Driver's Licenses and clean driving records. Each operator is uniformed and identifiable in accordance with contract requirements and is equipped with a cellular phone for constant communication with dispatch. Two dedicated sweeper operators will be assigned to the Rosemead contract, each working approximately 40 hours per week performing scheduled street sweeping services. Backup sweeper operators are fully trained and familiar with the routes and schedules within the City of Rosemead, ensuring seamless integration and preventing any service disruptions. This wide-ranging experience gives NES the ability to operate in cities of all sizes and profiles, ranging from compact residential neighborhoods to expansive industrial zones with complex scheduling and environmental requirements. Our team is highly experienced in complying with stormwater regulations, NPDES mandates, South Coast AQMD Rule 1186, and local enforcement protocols. We have successfully supported cities with both posted and non -posted sweeping programs, operated in dense commercial corridors, and serviced municipal parking lots, alleys, medians, and special -use facilities. NES prides itself on maintaining a drug -free workplace and employing highly trained, licensed personnel who are fully equipped to perform municipal street sweeping services to the highest standard. Our operators undergo comprehensive training in defensive driving, vehicle safety, route navigation, and regulatory compliance. We emphasize ongoing education and operational consistency, which allows us to deliver safe, efficient, and high - quality services to our clients. Page 8 Rosemead I Street Sweeping Services Proposal Approach and Scope of Work Nationwide Environmental Services (NES) will provide comprehensive, citywide street sweeping services in full compliance with the City of Rosemead's RFP No. 2026-02, including all requirements set forth in Attachments A through D. Our methodology is designed to meet all scheduling, performance, safety, and environmental requirements outlined in the RFP. NES also incorporates internal best practices to enhance transparency, responsiveness, and long-term service quality. NES will perform all services in accordance with RFP No. 2026-02. NES' "Clean Sweep" Policy NES will implement its "Clean Sweep" policy throughout the contract term, making as many passes as necessary to ensure all designated areas are maintained free of debris, consistent with the City's expectations and regulatory standards. Environmental Compliance and NPDES NES' sweeping operations support the City's stormwater management goals and contribute to National Pollutant Discharge Elimination System (NPDES) compliance, including the City's MS4 Permit requirements. By consistently removing pollutants before they enter the storm drain system, NES helps protect water quality and the environment. Our team follows Best Management Practices (BMPs) and adheres to all applicable environmental regulations. All operators are trained to recognize and report illicit discharges and stormwater pollution sources, with documented training provided prior to assignment and annually thereafter. Service Area and Frequency NES will sweep all City -designated areas in accordance with the schedule as listed in the RFP, covering all residential streets, commercial corridors, medians, and designated parking lots. NES will deploy two (2) brand-new, AQMD-compliant CNG sweepers dedicated to the Rosemead contract, with additional backup units available from our fleet of over 70 sweepers. Backup equipment can be deployed within one (1) hour of any breakdown, as required by the RFP. See the Street Sweeper Inventory Form section for detailed vehicle specifications including VIN numbers. Parking Lot Sweeping NES will sweep all designated City parking lots once per week on Fridays from 2:00 AM to 6:00 AM, using a method approved by the Public Works Manager. The five designated facilities include: City Hall/Rosemead Community Center, Garvey Community Center, Garvey Park, Rosemead Park, and Zapopan Park. Sweeping Method and Standards NES operators will remove unsweepable items such as palm fronds, rocks, trash, and debris from the sweeping path, where reasonably practicable and safe to do so, rather than Page 9 Rosemead I Street Sweeping Services Proposal Nation, ic/e �n irvnmenta,/ driving around them. Items that are immovable, excessive in quantity, or otherwise beyond the operational capability of the sweeper, such as construction debris or impaired vertical/horizontal clearance from tree limbs, will be reported to.the City immediately. All curb lines will be swept along both sides of the roadway, all raised and painted medians, turn pockets, and intersection cross gutters. Where standing water or drainage issues are present, operators will make as many passes as reasonably necessary. Sweeper speed will not exceed 5 mph in residential areas and 8 mph in commercial areas. Water Usage NES will obtain water from the appropriate water utility at Contractor's expense and use sufficient water to prevent dust during sweeping operations. No liquid waste will be discharged onto City streets or into the storm drain system. No sweeper washing will occur on City property. NES will implement best management practices when loading water. Disposal of Sweep Waste and Recycling All debris collected during sweeping will be transported and delivered to a permitted facility at Contractor's expense, in compliance with all City, County, State, and Federal requirements. NES is committed to diverting sweeping debris from landfill disposal whenever possible. Debris will be processed at recycling and composting facilities. NES will provide the City with the names and addresses of all disposal facilities used and maintain separate records detailing the amount of debris deposited at composting or recycling facilities. Monthly tonnage reports will be submitted to the City. Make -Up Sweeps for Holidays and Obstructions When sweeping is postponed due to a recognized holiday, NES will complete the make-up sweep within seven (7) days following the holiday, returning to the normal weekly schedule the following week. NES will notify the City in advance of any proposed schedule changes and obtain prior approval from the Public Works Director. City Special Events NES will provide street sweeping services free of charge for up to four (4) City events each year, including before and after sweeping as needed. As detailed in our Community Benefit section, NES views these events not just as contract obligations but as opportunities to demonstrate our commitment to the Rosemead community. ADDED VALUE: 20 HOURS OF COMPLIMENTARY SWEEPING PER YEAR In addition to the regularly scheduled sweeping services and the four (4) free City event sweeps, NES will provide up to twenty (20) hours of complimentary street sweeping per year at no additional cost to the City. These hours may be used at the City's discretion for special projects, supplemental cleanup needs, neighborhood beautification efforts, or any other sweeping service beyond the regular schedule. Scheduling of complimentary hours will be coordinated through the City's Public Works Representative. Page 10 Rosemead I Street Sweeping Services Proposal Nat+in,n ��4e En irvnn�eu�ta/ eruice�s ' Additional Rosemead Boulevard Sweeping (3x Per Wi ADDED VALUE: ROSEMEAD BOULEVARD 13 SWEEPS PER WEEK NES will sweep the entire roadbed of Rosemead Boulevard three (3) times per week, city limit to city limit, at no additional cost. While the RFP requires sweeping of major arterials twice per week, NES recognizes that Rosemead Boulevard is the City's primary commercial corridor and highest -traffic roadway. The additional weekly sweep will maintain a consistently clean appearance, reduce debris accumulation between service days, and reinforce Rosemead's commitment to a well -maintained streetscape. All three sweeps will be performed full roadbed, curb to curb, during the early morning arterial sweeping hours (2:00 AM to 6:00 AM). Route Maps and GPS Tracking NES will submit Service Area route maps to the City Representative not less than forty-five (45) days prior to commencement of service for review and approval. Maps will include sweeping days, schedules for adjacent areas, start and finish points for each route, dumpsite locations, and any special scheduling needs. All maps will be provided in a format suitable for posting to the City website. NES will utilize route -tracking GPS technology on all sweepers to document sweeping activities in real time, and all data will be made available to City staff. Parking Citation Coordination NES will coordinate sweeping activities with the City's Parking Control Officer at no additional cost. Our operators and dispatch team will maintain direct communication with parking enforcement to ensure efficient and coordinated service. Emergency Response NES will respond to City -initiated emergency sweeping requests with a target arrival within two (2) hours of the initial call. In the event of any equipment oil, hydraulic fluid, or other spill, NES will immediately cover the affected area with absorbent material, notify the City within two (2) hours, apply appropriate cleaning agent as necessary, and take all measures to prevent discharge into the storm drain system. Monthly Log Report: Daily log of all streets swept and special services. 2. Emergency Calls: Recorded by telephone or email. 3. Amount of Debris: Tonnage collected 4. Recycled Debris: Amount diverted, facility name and address. S. Complaints: Log of complaints received, investigation results, and corrective actions. All complaints addressed within 24 hours. Weekly missed route and complaint reports submitted to the City. Communication All NES sweeper operators will be equipped with cellular phones for direct, real-time communication with dispatch, City staff, and emergency services. NES will provide a 24- hour message telephone number to the City Traffic Engineer for traffic counter installation notifications. Drivers will be trained to be aware of traffic counter cable locations and raise their brooms accordingly. Office Location and Dispatch NES' corporate office at 11914 Front Street, Norwalk, CA, is staffed Monday through Friday from 7:00 AM to 5:00 PM. Our dispatch team operates 24/7, including weekends and holidays, with bilingual staff available for public inquiries. Prevailing Wage Compliance NES understands that the City has requested compliance with prevailing wage requirements for the services contemplated under this Agreement. Accordingly, NES will comply with the City's request. In the event the State of California or the Department of Industrial Relations clarifies, revises, or reverses its interpretation and prevailing wages are determined not to be required for the services contemplated under this Agreement, NES and the City shall negotiate in good faith an adjustment to the contract amount to reflect the change in applicable labor requirements. Equipment NES will deploy two (2) dedicated, brand-new CNG-powered vacuum -type street sweepers for the City of Rosemead contract, fully compliant with all CARB regulations, AQMD Rule 1186, and all applicable Federal, State, and local air quality requirements. All sweepers feature operational amber dome lights, flashing back-up taillight alarms, GPS tracking with City portal access, and dash cameras. Brushes and brooms are replaced at regular intervals to maintain peak performance. Each sweeper is identifiable by a unique number and the NES company logo. Street sweepers (TYMCO Model 600 CNG) have a seven -yard hopper capacity. To maintain optimal performance, the sweepers are off loaded at 75% to 80% capacity at a nearby transfer site. This allows us to minimize downtime and maintain route efficiency. During heavy seasons, we may swap out sweepers with identical backup units to prevent delays. A separate driver handles the offloading while the route operator continues sweeping. This ensures continuity so that we may complete the route within its posted time zones. BLANKET ADDITIONAL INSURED — GRANTORS OF FRANCHISES The following is added to SECTION II — WHO IS AN INSURED: Any person or organization that grants a franchise to you is an insured, but only with respect to liability for "bodily injury", "property damage" or "personal and advertising injury" arising out of your operations in the franchise granted by that person or organization. If a written contract or agreement exists between you and such additional insured, the limits of insurance provided to such insured will be the minimum limits that you agreed to provide in the written contract or agreement, or the limits shown in the Declarations, whichever are less.
