The property is zoned R-2 with a lot size of 14,876 t square feet. The front unit was believed to have been owner-occupied, and the other two units are tenant-occupied. The case was initiated in March 2005, and compliance has not been achieved in nearly seven months. The case chronology is as follows: • March 23, 2005 - "Please" letter and "bulky item" trash notice mailed to property owner. • April 28, 2005 - Inspection: no progress. • May 9, 2005 - Property declared substandard by Building Official and a Declaration of Substandard Property filed with Los Angeles County Recorder's office. A 15-day certified letter was mailed to the property owner and posted at the property. • May 17, 2005 - Property owner, Kenny Nguyen, obtained a building rehabilitation permit. He informed staff that he resides in Maryland. • June 16, 2005 - Inspection: no progress. • July 7, 2005 - Building inspector sent follow-up letter requesting compliance. A "For Sale" sign was posted on the property. • August 29, 2005 - Inspection: no progress. • August 31, 2005 - Building inspector left message for real estate listing agent. • September 27, 2005 - Inspection: no progress. To date, no progress has been achieved in correcting the defects, and there has been no response from the property owner. A Notice of Hearing was mailed and posted on the property on October 11, 2005. All interested parties have been notified. CITY BUILDING OFFICIAL'S RECOMMENDATION: It is recommended that the Board find the property substandard and order all substandard conditions be removed and/or corrected by December I, 2005. Section 9908 of the Rosemead Building Code declares all such substandard buildings a public nuisance and requires the abatement thereof by repair, rehabilitation, or demolition of the substandard conditions. As the owner of record, you are hereby ordered to comply with the requirements of said code, by repair, rehabilitation, or demolition of the substandard conditions listed, within fifteen (15) days after receipt of this notice.
