Rehab Appeals Board - Item II.A - 2745 Charlotte Avenue HearingTO: HONORABLE CHAIRMANT AND MEMBERS BUILDING REHABILITATION APPEALS BOARD FROM: BILL CR(E, CITY MANAGER DATE: NOVEMBER 15, 2005 RE: 2745 CHARLOTTE AVENUE - HEARING The subject property consists of an owner - occupied single family dwelling. The property is zoned R -2 with a lot size of 7500 t square feet. The case was initiated in June 2005, and compliance has not been achieved in over five months. The case chronology is as follows: • June 7, 2005 - "Please" letter mailed to property owner. • June 22, 2005 - Inspection: no progress. Inspector unable to determine if house was inhabited. • July 13, 2005 - Property declared substandard by Building Official and a Declaration of Substandard Property filed with Los Angeles County Recorder's office. A 1,5 -day certified letter was mailed to the property owner and posted at the property. A "bulky item" trash pickup schedule was also sent. • August 1, 2005 - Inspection: no progress. Building inspector contacted the Sheriff's Department to'determine the possibility of having their Youth Team assist in cleaning the property. • August 8, 2005 - Certified letter was returned "unclaimed" and was re -sent via first class mail. It appeared the building was occupied, however, no one responded to knocks at the door. Junk, debris, overgrown vegetation, and inoperable vehicles remained in the yard. • August 25, 2005 - Building inspector was informed by Sheriffs Department representative that the Youth Team would be unable to assist with the cleanup due to the fact that staff had been unable to contact the property owner. (Their program requires permission from the owner.) • September 27, 2005 - Inspection: minimal progress. • October 27, 2005 - Inspection: no progress. Potential fire hazard. • November 1, 2005 - Inspection by Building Official. The propertyowner, Mr. Lopez was at the site. Mr. Lopez is somewhat physically disabled and unable to do the cleanup work. The Building Official suggested some available options, i.e., community volunteers, the Sheriff s Youth Team, and the bulky item pickup through Consolidated Disposal. To date, little progress has been achieved in correcting the defects. A Notice of Hearing was mailed and posted on the property on November 8, 2005. All interested parties have been notified. Section 9908 of the Rosemead Building Code declares all such substandard buildings a public nuisance and requires the abatement thereof by repair, rehabilitation, or demolition of the substandard conditions. As the owner of record; you are hereby ordered to comply with the requirements of said code, by repair, rehabilitation, or demolitionof the substandard conditions listed, within fifteen (15) days after receipt of this notice. Be advised that if you are renting this property to others the City may file a "Notice of Non- Compliance" with the State Franchise Tax Board. Section 17274 of the Revenue and Taxation Code states: No deduction shall be allowed for interest taxes depreciation or amortization with respect to substandard (rental) housing." This notice will be posted on the property. If you disagree with the findings, or cannot comply with the order within the time specified, you may request a public hearing. Such request for hearing must made, in writing; within fifteen (15) days after posting of this notice on the subject property.
