RE: COOPERATIVE AGREEMENT BETWEEN THE CITY AND COMMUNITY
DEVELOPMENT COMMISSION FOR PARK ADA (AMERICANS WITH
DISABILITIES ACT) AND BALLFIELD LIGHTING IMPROVEMENTS
Attached for the Community Development Commission's review is a cooperative
agreement between the City and the Community Development Commission for the subject
project.
The construction costs for ADA surfacing (at Rosemead, Garvey and Zapopan Parks), play
equipment upgrades (at Garvey and Zapopan Parks), and walkway repairs (at Garvey
Park) have been budgeted by the City utilizing Community Development Block Grant
(CDBG) Funds. The construction costs for the ADA play equipment upgrades (at
Rosemead Community Recreation Center and Rosemead Park) and ballfield lighting
improvements at Garvey Park are proposed to be budgeted by the Community
Development Commission.
RECOMMENDATION
It is recommended that the Community Development Commission approve the attached
agreement.

AGREEMENT BETWEEN THE ROSEMEAD COMMUNITY
DEVELOPMENT COMMISSION AND THE CITY OF ROSEMEAD
FOR PARK ADA AND BALLFIELD LIGHTING IMPROVEMENTS
THIS AGREEMENT is entered into this 12th day of August, 2003, by and between
the CITY OF ROSEMEAD (hereinafter "CITY") and the ROSEMEAD COMMUNITY
DEVELOPMENTCOMMISSION (hereinafter "COMMISSION").
WHEREAS, pursuant to Health and Safety Code Section 33000 et seq., the City
Council of the City of Rosemead established the Rosemead Community Development
Commission under authority of the California Community Redevelopment Law; and
WHEREAS, pursuant to Health and Safety Code Section 33000 et seq., the City
Council of the City of Rosemead, by enactment of Ordinance No. 340, on June 27, 1972,
and Ordinance No. 809, on June 27, 2000, established the Rosemead Redevelopment
Project Area Nos. 1 and 2, respectively; and
WHEREAS, CITY and COMMISSION have a common interest in and wish to
facilitate redevelopment within the City and to provide for the cooperation of CITY and
COMMISSION in carrying out redevelopment activities; and
WHEREAS, CITY and COMMISSION both desire to perform the construction of
park ADA and ballfield lighting improvements described herein.
NOW, THEREFORE, the parties agree:
Section 1. Each party shall have access to the services and facilities of the other
party and its staff. Each party shall also cooperate with the other in providing for
redevelopment activities within CITY.
Section 2. CITY shall supply to COMMISSION such information and reports as
from time to time the COMMISSION may require.
Section 3. CITY will assist COMMISSION in the planning, financing, acquisition,
construction and maintenance or operation of redevelopment activities undertaken by the
COMMISSION within CITY in accordance with applicable state and federal law.
Section 4. CITY and COMMISSION shall jointly undertake the planning,
engineering and construction of the park ADA and ballfield lighting improvements. CITY
shall be "Lead Agency", as defined in Public Resources Code Section 21067.
Section 5. COMMISSION shall pay the cost of construction for ADA play
equipment upgrades at Rosemead Park and Rosemead Community Recreation Center,
and ballfield lighting improvements at Garvey Park. The total COMMISSION obligation for
the project shall not exceed Forty-two Thousand Five Hundred Dollars ($42,500). The
CITY shall pay the cost of construction for ADA surfacing at Rosemead, Garvey and
Zapopan Parks; play equipment upgrades at Garvey and Zapopan Parks; and walkway
repairs at Garvey Park. The total CITY obligation for the project shall not exceed Three
Hundred Eighty-three Thousand Five Hundred Dollars ($383,500).
IN WITNESS WHEREOF, the parties hereto have executed this Agreement on the
date first written above.
