PRESENTATIONS: DURHAM TRANSPORTATION 1. ORAL COMMUNICATIONS FROM THE AUDIENCE II. PUBLIC HEARINGS - EXPLANATION OF THE PUBLIC HEARING Z PRO EDURES BY THE CITY ATTORNEY A. PUBLIC HEARING REGARDING REALLOCATION OF CDBG FUNDS FOR FY 2000-2001 On May 9, 2000, the Council approved the CDBG budget for FY 2000-2001. That budget was based on anticipated costs of projects and anticipated resources. Because the budget was based on preliminary estimates, the City needs to reallocate resources based on actual bids and/or revised estimates of costs for projects. Recommendation: Approve the City's proposed reallocation of CDBG funds for FY 2000-2001 and authorize this as an amendment to the City's Annual Funding Plan. M. GISLATIVE A. RESOLUTION N6.2000-60 - CLAIMS AND DEMANDS Recommendation: Adopt Resolution No. 2000-60, for payment of City expenditures. CCAGENDA:NOVEMBER 28, 2000 Page # I B. RESOLUTION NO. 2000-61 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ROSEMEAD APPROVING AND ADOPTING THE SECOND AMENDMENT TO THE SAN GABRIEL VALLEY COUNCIL OF GOVERNMENTS JOINT POWERS AUTHORITY AMENDED AND RESTATED JOINT EXERCISE OF POWER AGREEMENT A Joint Powers Agreement that became effective March 1, 1994 established the San Gabriel Valley Council of Governments (SGVCOG). The city is a party to the Agreement and a member of the SGVCOG. Effective September 17, 1998, an amendment to the agreement created the Alameda Corridor East Construction Authority for the purpose of implementing the Alameda Corridor East (ACE) Project, consisting of improvements at 55 grade crossings on Union Pacific Railroad throughout the San Gabriel Valley. To assist in funding the project, member cities are being asked to adopt a resolution approving and adopting an amendment to the SGVCOG Joint Powers Authority Amended and Restated Joint Exercise Powers Agreement by adding the power to borrow money, incur indebtedness and/or issue bonds for the benefit of the ACE Project and to be repaid exclusively from funds pledged or designated for the ACE Project. The proposed resolution includes a provision relieving the City of Rosemead from any liability whatsoever arising from such borrowing. Recommendation: Adopt Resolution No. 2000-61. RESOLUTION NO. 2000-62 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ROSEMEAD REQUESTING THAT LACMTA INCLUDE THE 710 FREEWAY COMPLETION IN THE 2000 LONG RANGE TRANSPORTATION PLAN UPDATE LACMTA is responsible for adopting the County's long-range transportation plan which currently excludes the 710 Freeway completion project. This resolution requests that the MTA Board include the 710 Freeway project. Rec mendation: Adopt Resolution No. 2000-62. RESOLUTION NO. 2000-63 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ROSEMEAD, CALIFORNIA ORDERING THE CANVASS OF THE GENERAL MUNICIPAL ELECTION TO BE HELD ON TUESDAY, MARCH 6, 2001, BE MADE BY THE CITY, CLERK This resolution authorizes the City Clerk to complete the canvass of the Election prior to the second Tuesday following the Election and to certify the results to the City Council on the second Tuesday following the Election. Recommendation: Adopt Resolution No. 2000-63.' E. RESOLUTION NO. 2000-64 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ROSEMEAD ADOPTING THE 2001 SUPPLEMENT TO THE "GREENBOOK" STANDARD SPECIFICATIONS FOR PUBLIC WORKS CONSTRUCTION By adopting this resolution, the Council resolves that the 2001 Supplement of the Standard Specifications for Public Works Construction will be adopted for use for public works project. Recommendation: Adopt Resolution No. 2000-64. CCAGENDA:NOVEMBER 28, 2000 Page P2 F". ORDINANCE NO. 815 - AN ORDINANCE OF THE CITY COUNCIL APPROVING MUNICIPAL CODE AMENDMENT NO. 98-01, AMENDING SECTION 17.112.030 OF THE RMC REQUIRING A CONDITIONAL USE PERMIT FOR THE DEVELOPMENT OF MORTUARIES/FUNERAL HOMES IN THE M-1 LIGHT MANUFACTURING ZONING DISTRICT This ordinance was introduced at the November 14, 2000 regular meeting of the City Council, which amends the Rosemead Municipal Code to now require a conditional use permit for the development of mortuaries/funeral himes in the M-1; Light Manufacturing Zoning District. Recommendation: Adopt Ordinance No. 815. RESOLUTION NO. 816 - AN ORDINANCE OF THE CITY COUNCIL APPROVING MUNICIPAL CODE AMENDMENT NO. 00-01, AMENDING SECTION 17.84.080 OF RMC, WHEREIN ANY CONSTRUCTION DONE TO AN EXISTING STRUCTURE IS GREATER THAN $15,000 VALUATION, THE MINIMUM PARKING REQUIREMENTS SHALL BE PROVIDED Ordinance No. 2000-64 was introduced at the November 14, 2000 regular meeting of the City Council. This ordinance will increase the improvement valuation cost which initiates the minimum parking requirements for commercial and industrial buildings. Recommendation: Adopt Ordinance No. 816. IV. CO NT CALENDAR - RECOMMENDATION: APPROVAL C-A AUTHORIZATION TO ATTEND CALIFORNIA CONTRACT CITIES ASSOCIATION'S ANNUAL LEGISLATIVE TOUR, JANUARY 8-10, 2001, SACRAMENTO This year's program will include sessions with State Senate, Assemblymembers and Leadership. Recommendation: Authorize the attendance of any Councilmember, the City Manager, the City Att rney and staff as designated by the City Manager. CC-B UTHORIZATION TO ATTEND THE LEAGUE OF CALIFORNIA CITIES MAYORS AND COUNCILMEMBERS INSTITUTE, JANUARY 10-12,2001 - SACRAMENTO This year's session includes Land Use Planning, Brown Act, Conflict of Interest Laws, and Effective Communication with the Media. Reco mendation: Authorize the attendance of any Councilmember, City Manager, Cit Attorney and staff as designated by the City Manager. /C- C APPROVAL OF AN ENTERTAINMENT PERMIT FOR PAUL'S STEAKHOUSE, 9632 VALLEY BOULEVARD An Administrative Hearing was held on November 20, 2000 regarding the approval of an Entertainment Permit. Recommendation: Grant an Entertainment Permit to Paul's Steakhouse, 9632 Valley Boulevard contingent upon the owner signing the attached list of conditions. V.
