City Council - Item 3F - Light Manufacturing Zoning Districtr* ORDINANCE NO. 815 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ROSEMEAD, COUNTY OF LOS ANGELES, STATE OF CALIFORNIA APPROVING MUNICIPAL CODE AMENDMENT NO. 98-01, AMENDING SECTION 17.112.030 OF THE ROSEMEAD MUNICIPAL CODE REQUIRING A CONDITIONAL USE PERMIT FOR THE DEVELOPMENT OF MORTUARIES/ FUNERAL HOMES IN THE M-1 LIGHT MANUFACTURING ZONING DISTRICT. - THE CITY COUNCIL OF THE CITY OF ROSEMEAD DOES HEREBY ORDAIN AS FOLLOWS: SECTION 1. The City Council- HEREBY FINDS, DETERMINES AND DECLARES that Municipal Code Amendment No. 98-01 meets the City's goals and objectives as follows: A. The City Council of the City of Rosemead wishes to promote the City. ofRosemead's interest in protecting and preserving the quality and character of the residential, commercial, and industrial areas in the City, and the quality of life through effective land use planning; and B. It is the purpose and intent of the Ordinance to provide for the reasonable and uniform regulation of mortuaries/ funeral homes uses in the City of Rosemead. It is recognized that such land uses may be appropriate for the Light Manufacturing Zoning District only. It is therefore the purpose of this Ordinance to establish a conditional use permit process for the establishment and conduct of mortuaries/ funeral homes uses which in turn will protect the public health, safety, and welfare, preserve locally recognized values of community appearance, minimize the potential for nuisances related to the operation of such uses, and maintain local property values; and C. The City staff has prepared an initial study pursuant to the California Environmental Quality Act (CEQA). This study has determined that the proposed zoning amendments will not have any adverse impact on the environment, and accordingly has prepared and recommends adoption of Negative Declaration. SECTION 2. Pursuant to the City of Rosemead's CEQA Procedures and State CEQA Guidelines, it has been determined that the adoption of this ordinance will not have a significant impact on the environment. This conclusion is based upon the record, initial study and comments received during the pubic review period. Therefore, a Negative Declaration has been prepared according to CEQA. The City Council, having final approval authority over this project, has reviewed and considered any comments received during the public review prior to the approval of this project. Furthermore, the City Council has exercised its own independent judgment in reaching the above conclusion. The City Council, therefore, approves the Negative Declaration. Furthermore, on the basis of substantial evidence, the City Council hereby finds any presumption of adverse impact has been adequately rebutted. Therefore, pursuant to Fish and Game Code Section 711.2 and Title XIV, California Code of Regulations, Section 735.5(a)(3), the City Council finds that the project has a de minimis impact and therefore the payment of Fish and Game Department filing fees is not required in conjunction with this project. SECTION 3. The City Council HEREBY AMENDS Section 17.112.030 (Uses Permitted by Conditional Use Permit in Specific Zones) by adding mortuaries/ funeral home uses as follows: "17.112.030(29) . Mortuaries/ Funeral Homes _ in , the M-1 zone." SECTION 4. If any section, subsection, sentence, clause or word of this ordinance is for any reason held to be invalid by a court of competent jurisdiction, such decisions shall not affect the validity of the remaining portions of this Ordinance. The City Council of the City of Rosemead HEREBY DECLARES that it would have passed and adopted this Ordinance, and each and all provisions thereof, irrespective of the fact that any one or more of said provisions may be declared to be invalid. The City Council HEREBY AMENDS Section 17.84.010 by adding to "Automobile Parking Requirements Generally" as the following wherein for each business, commercial, manufacturing, or industrial building hereafter erected, converted, reconstructed, or enlarged, where the work done to the structure is greater than fifteen thousand dollars ($15,000) valuation, there shall be provided and maintained off-street parking facilities to accommodate the motor vehicles used by occupants, customers, clientele, and employees of such building or structure. The aggregate amount of parking space for each type of use shall not be less than that stated in this chapter. Required parking space or spaces shall be in addition to required driveways and necessary or required turn areas. For each Single-family detached dwelling there shall be provided a parking spaces (enclosed garage) as required by this chapter, provided however, that compliance may be deferred if the Planning Director finds each of the following facts: The proposed addition does not exceed 120 square-feet and no other building permits for additions have been issued for the subject dwelling, and that there has been no conversion of required automobile parking spaces to any other use on the subject property, and that the proposed addition does not, by virtue of its placement on the subject property, preclude future construction of an enclosed garage per the City's development standards. SECTION 4. If any section, subsection, sentence, clause or word of this ordinance is for any reason held to be invalid by a court of competent jurisdiction, such decisions shall not affect the validity of the remaining portions of this Ordinance. Ms. McLaughlin stated that the Sheriffs Department is recommending approval of the Entertainment Permit contingent upon the 8 additional conditions of approval. The Hearing Officer then asked the Planning Director if the Planning Department had anything to say regarding the business or conditions. Mr. Johnson stated the he would need a new floor plan indicating where the platform or stage would be located for entertainment. Mr. MacGillivray stated that the doors would remain closed and with the addition of the block wall in the rear the.neighbors should not be disturbed with any noise. He also wish to change the hours of entertainment from 10:00 p.m. , Sunday through Thursday, to 11:00 p.m., and from 12:00 a.m. to 1:00 a.m., Friday and Saturday nights. The Hearing Officer asked the witness to state her name and if she had any concerns with the establishment. Ms. Mary House, 9623 Steele Street, stated that.the business had been very quiet and that she had no problems at this time. Valley Boulevard CONDITIONS OP APPROVAL December 6, 1999 Approval of Conditional Use Pennit 99-784 shall not take effect for any purpose until the applicant has filed with the City of Rosemead an affidavit stating that he/she is aware of and accepts all of the conditions set forth in the letter of approval and this list of conditions. Z. Conditional Use Permit 99-784 is approved for a period of six (6) months, at which time it shall be reviewed by the Planning Commission for an extension. The occupant shall file a request for an extension at least thirty (30) days before expiration with the Planning Department. 3. Conditional Use Permit 99-784 is for an on-sale alcohol (Type 47) license in conjunction with a bona fide restaurant from the California Stale Alcohol Beverage Control Board. All requirements and appropriate licenses of the California Stale Alcohol Beverage Control Board shall be complied with and maintained at all times. A copy of the current license shall be provided to the Planning Department prior to occupancy 4. A six-foot (6') high block wall shall be constructed along the south property line within six months from the date of this approval. 5. Adequate lighting shall be maintained in the parking area. Motion-activated lights shall be installed where deemed appropriate by the Director of Planning. All exterior lighting shall be directed away from adjacent properties and shielded on all sides. 6. Applicant shall eliminate parking spaces 91, 19, 20, 22, 23, 24, 25, 26, 27 and 28. 7. Paved areas located at the subject site shall receive a slurry seal pavement application and those parking stalls allowed shall be restriped according Exhibit "B", Exhibit °D" and to City of Rosemead parking standards. This includes minimum standard parking stall dimensions of' 9' wide by 20' long, a minimum of 25% compact parking stall coverage, minimum compact parking stall dimensions of 8' wide by 16' long and double-striking of parking stalls. Said improvement shall be completed within six (6) months from date of approval. 8. Ncw wheel slops must be placed between new parallel parking stalls located at front of subject property. New masonrytrash enclosure would need to be provided with opaque metal door that can be latched closed. In addition, file construction of a new enclosure world require eliminating parking stall #7, demolishing the existing enclosure and replacing the appropriate number of parking stalls where the existing enclosure once stood. Said improvement shall be completed within six (6) months from date of approval. 12. ' Applicant shall repair the following items: broken light standard attached to, front of building, slumping razor wire fence along.west property line and defunct rain gutter that has detached froth building along rear portion of building. 13. Applicant shall be compliance with the requirements of and maintain in good standing a City issued business license. 14. No alcohol is to be sold for off-site consumption. 15. The hours of operation shall be posted in the front window or door. Hours of operation shall be limited to:. Monday through Sunday 6:00 am to 2:00 am., 16. Signs shall comply with Chapter 17.104 of the Rosemead Municipal Code. Specifically, signs shall not cover more than 15% of window.area or 25% of wall areas. All signs must comply with Section 17.104.050 regarding identification of the business in English. 17. The numbers of the address signs shall be at least G' tall with a minimum character width of 1/4", contrasting in color and easily visible at driver's level From the street. The location, color and size of such sign shall be subject to the approval of the Planning Director. 18. All hash, rubbish and garbage receptacles shall be regularly.cleaned, and inspected and maintained in a clean, safe and sanitary condition. All food and liquid waste shall be packaged to prevent leakage. 19. All open area not coveted by concrete, asphalt, or structures shall be landscaped and maintained on a regular basis. 20. The site shall be maintained in a clean, weed and litter fi-ce state in accordance with Sections 8.32.010, .020, .030 and .040 of (lie Rosemead Municipal Code, which pertains to the storage, accumulation, collection, and disposal of garbage, rubbish, trash, and debris.
