PRESENTATIONS: 1. ORAL COMMUNICATIONS FROM THE AUDIENCE It. PUBLIC HEARINGS - NONE /ll / LEGISLATIVE V A. RESOLUTION NO. 2002-51 - CLAIMS AND DEMANDS Recommendation: Adopt Resolution No. 2002-51, for payment of City expenditures. B. RESOLUTION NO. 2002-52 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ROSEMEAD DISAPPROVING THE NEGATIVE DECLARATION FOR ROSEMEAD REDEVELOPMENT PROJECT AREA NO. 1, AMENDMENT 4; AND STAYING CONSIDERATION OF AMENDMENT 4 PENDING COMPLETION OF AN ENVIRONMENTAL "ACT REPORT Following public hearings on Rosemead Redevelopment Project Area No. 1, Amendment 4, and the Negative Declaration prepared for the Plan Amendment, the City Council scheduled consideration of the Plan Amendment and Negative Declaration for this Agenda. After reviewing the public comments and correspondence received, City staff believes that evidence has been presented CCAGF-NDA: 11-12-02 Page M I indicating that the Project could have a significant impact on the environment and that, consequently, an Environmental Impact Report should be prepared for the Plan Amendment. Staff, therefore, recommends that the Council adopt the subject resolution that would disapprove the Negative Declaration and stay further Consideration of Amendment 4 pending the filing of an application deemed to be complete in accordance with California Government Code Section 65943 for retail development of the 23.7 acre site located at the southwest corner of Walnut Grove Avenue and Rush Street in the City of Rosemead, completion of an Environmental Impact Report and a duly noticed public hearing or hearings. Recommendation: Adopt Resolution No. 2002-52 disapproving the Negative Declaration and staying consideration of Amendment 4. e--J C. RESOLUTION NO. 2002-53 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ROSEMEAD MAKING CERTAIN FINDINGS AND DETERMINATIONS WITH RESPECT TO COMMUNITY DEVELOPMENT COMMISSION PAYMENT FOR COSTS ASSOCIATED WITH THE RECONSTRUCTION OF VIRGINIA AVENUE WEST OF DENTON AVENUE By adopting this resolution, the City Council finds that Community Development Commission payment for costs associated with the project benefits Project Area No. I. There are no other means of financing, and the project will eliminate blighting conditions by providing standard street improvements, including drainage and street lighting, enhanced public safety and improved vehicular access along roadways within and adjacent to Project Areas No. 1, thus enhancing the value of abutting properties. Recommendation: Adopt Resolution 2002-53 IV. CONSENT CALENDAR- RECOMMENDATION: APPROVAL ~(z~ APPROVAL OF UNDERTAKING AGREEMENT FOR PARCEL MAP 26540 - 2504-2512 FALLING LEAF AVENUE The applicant for Parcel Map 26540 has submitted an Undertaking Agreement and Certificate of Deposit to guarantee the construction of sewer laterals subsequent to the recordation of the parcel map. Pursuant to the Subdivision Map Act, the subject parcel map does not require City Council approval. Recommendation: Approve the Undertaking Agreement. ACCEPTANCE OF PARCEL MAP 26406 - 3366 SAN GABRIEL BOULEVARD This subdivision was considered by the Planning Commission on August 20, 2001. A corner cut-off dedication at the corner of San Gabriel Boulevard and Hellman Avenue was required to be granted on the map for street and sidewalk purposes. All other conditions of approval have been met and the map is ready for Council's approval. Recommendation: Approval Parcel Map No. 26406; accept the street dedication; and direct the City Clerk to arrange for the recordation of the map. V. MATTERS FOR DISCUSSION AND ACTION VI.
