Rehab Appeals Board - Item 2B - 3924 Earle Ave7 TO: HONORABLE CHAIRMAN AND MEMBERS BUILDING REHABILITATION APPEALS BOARD FROM: BILL CRO , ITY MANAGER DATE: NOVEMBER 16, 2004 RE: 3924 EARLE AVENUE - HEARING The subject property consists of a tenant-occupied single-family residence with an unpermitted addition. The property is zoned R-1 with a lot size of 7500 t square feet. A property rehabilitation case was initiated May 11, 2004, and full compliance has not been achieved in over six months. Case chronology is as follows: • May 11, 2004 - "Please" letter and Los Angeles County record search information mailed to property owner. • May 20, 2004 - Building inspector met with property owner at site. Additional violations were noted. A revised list of defects was compiled and mailed to the property owner. • June 22, 2004 - Inspection: minor progress - sonic yard area cleanup. • June 29, 2004 - Property declared substandard by Building Official and a Declaration of Substandard Property filed with Los Angeles County Recorder's office. 15-day certified letter mailed to the property owner and posted at the property. Another record search information sheet was included. REHAB AC END-A NOV 2 3 2004 ITEFJ2 No. i7'. B_ • July 14, 2004 - "Repair per rehab" permit issued to property owner. • August 16, 2004 - Inspection: minor progress - additional cleanup. • September 16, 2004 - Inspection: no progress. Conditions at property had further deteriorated. Numerous trash cans and recycling containers being stored in driveway area. • September 20, 2004 - Building inspector sent letter to owner requesting compliance. • October 20, 2004 - Inspection: no progress. • October 26, 2004 - Inspection: no progress. Trash cans and containers remained visible from street. To date, little progress has been achieved in correcting the list of defects, and plans have not been submitted to legalize the unpermitted construction. A Notice of Hearing was mailed and posted on the property on November 9, 2004. All interested parties have been notified. CITY BUILDING OFFICIAL'S RECOMMENDATION: It is recommended that the Board find the property substandard and order all substandard conditions be removed and/or corrected by January 3, 2005. However, if plans are submitted and approved, permits are issued, and sufficient progress is achieved by January 3, 2005, OR if the unpermitted construction is removed, the abatement date may be extended to February 1, 2005. Junk and miscellaneous items are being stored throughout site. 3. Appliances are being stored at building exterior. 4. Plumbing for laundry facilities have been installed without the required approvals and permits. 5. An expired plumbing permit for water heater, dated 6-19-96. (Enclosed find copy of permit and corrections) 6. Window screens are missing isn several locations. 7. Hazardous/unapproved electrical wiring at building exterior. 8. Room at rear of building has been constructed without out the required approvals and permits and is blocking light and ventilation to the interior rooms. 9. Water heater is not properly vented, lacks the required seismic anchors, and the temperature and pressure relief piping must terminate outside within 6" of grade. 10. Numerous trash cans and recycling bins are being stored in driveway visible from street and causing unsightly conditions. Access to interior of entire dwelling and garage was not gained. Therefore, additional substandard conditions and building code violations may become evident during subsequent site visits. A permit record search from Los Angeles County is recommended. It is very important that you contact the Planning Department in order to legalize all unpermitted structures. Section 9908 of the Rosemead Building Code declares all such substandard buildings a public nuisance and requires the abatement thereof byrepair, rehabilitation, or demolition of the substandard conditions. As the owner of record, you are hereby ordered to comply with the requirements of said code, by repair, rehabilitation, or demolition of the substandard conditions listed, within fifteen (15) days after receipt of this notice. Be advised that if you are renting this property to others the City may file a "Notice of Non-Compliance" with the State Franchise Tax Board. Section 17274 of the Revenue and Taxation Code states: No deduction shall be allowed for interest taxes depreciation or amortization with respect to substandard (rental) housing."
