Ordinance No. 929 is now before Council at the required second reading for adoption. Staff Recommendation Staff requests that City Council ADOPT Ordinance No. 929 at its second reading. Pre ared by: GL RI MOLLE CITY CLERK Attachment A — Ordinance No. 929 ITEM NUMBER: I ORDINANCE NO. 929 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ROSEMEAD, CALIFORNIA, SETTING SPEED LIMITS IN ACCORDANCE WITH THE CALIFORNIA VEHICLE CODE WHEREAS, California Vehicle Code sections 22357 and 22358 authorize local agencies to change speed limits on local streets by ordinance, which ordinance need not be made a part of the Municipal Code but which must be based on findings made in an engineering and traffic surrey; and WHEREAS, in 2012, the City's traffic engineering consultant completed a citywide engineering and traffic surrey on various streets throughout the City; and WHEREAS, the City's Traffic Commission completed two (2) public review meetings on February 7, 2013 and March 7, 2013 to discuss findings and recommendations contained in the engineering and traffic survey; and WHEREAS, the City Council desires to adopt the speed limits suggested by the engineering and traffic surrey and, where applicable, to revise current speed limits to conform to the engineering and traffic survey so as to regulate traffic in a safe and efficient manner. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ROSEMEAD DOES HEREBY ORDAIN AS FOLLOWS: SECTION 1. Modified Speed Limit for City Streets Based on the engineering and traffic survey completed by the City in 2012, the speed limits for various streets and highways in the City are hereby set to conform to the recommendations made in the City survey, a copy of which is attached hereto as Attachment "A." SECTION 2. Unmodified Speed Limits With respect to any speed limit for any street or highway in the City not modified by Section 1, the speed limit in effect prior to the adoption of this ordinance shall remain in effect. SECTION 3. Severabilitv The City Council hereby declares that the provisions of this Ordinance are severable and if for any reason a court of competent jurisdiction shall hold any sentence, paragraph, or Section of this Ordinance to be invalid, such decision shall not affect the validity of the remaining parts of this Ordinance. SECTION 4. Certification The City Clerk shall certify to the adoption of this ordinance and shall cause the same to be posted as required by law. 1 SECTION 5. Notice This Ordinance shall be in full force and effect thirty (30) days after its passage. Within fifteen (15) days after adoption of this Ordinance, this Ordinance shall be published at least once in a newspaper of general circulation published and circulated in the City of Rosemead.
