SUBJECT: REVIEW OF PROJECT AND CONTRACT— PUBLIC PLAZA
SUMMARY
As a part of July 2010 tax increment bond issuance by the former Redevelopment
Agency, the City included funding for a project to build a public plaza in the area
between City Hall and the Library. Construction of the new parking lot, known as Phase
I and Phase II, was completed in spring 2012. At this time, the City desires to utilize
existing tax increment bond proceeds for the construction of Phase III, the Public Plaza
in the area between City Hall and the Library.
Prior to the dissolution of the Redevelopment Agency, city staff worked with a
landscape architect and multiple other consultants to create a project that includes
multiple water features, improved landscaping and irrigation, and decorative paving
throughout to increase the aesthetics and utility of the Civic Center. The plaza will be a
complement to the already completed work at the Civic Center and will encourage
public use with the multiple seating areas, interactive water features, and space for
public events. City staff conducted a public bid process for the construction of this
project and received four bids. Because this is a joint project on both County Library and
City property, the City is awaiting the approval of the license agreement by the County
Board of Supervisors, which is expected to occur in the next couple of weeks. Staff will
present this project to the City Council for award as soon as the license agreement is
approved by the County, and will recommend that a contract for construction be
awarded to E.C. Construction.
Staff Recommendation
It is recommended that the Oversight Board approve Resolution 2013 -0006 confirming
the selection of E.C. Construction for the Public Plaza.
DISCUSSION
City staff conducted a public bid process for the construction of the Public Plaza.
Notices were published in local newspapers and trade publications on May gch and May
16th, 2013. On May 22, 2013, the City Clerk received and opened four (4) sealed bids
with the following results:

Staff reviewed all bid documents for completeness and accuracy and determined that
E.C. Construction is the lowest responsive bidder. E.C. Construction completed both
Phase I and Phase II of the project for the City and staff is confident in their ability to
complete construction of the Public Plaza.
Staff anticipates City Council approval of this contract no later than July 2013. A Notice
to Proceed will be issued within approximately four weeks of the City Council's award of
contract and construction will begin within ten days of that notice. The contractor will
have ninety (90) calendar days to complete the work. It is anticipated that the
construction will be completed in November 2013.
FINANCIAL REVIEW
This project will be funded entirely with tax increment bond proceeds and the contract
with E.C. Construction will not exceed the cost of the proposal plus a ten - percent
allowance for contingencies and change orders. The total budget for this project is
$2,250,000.00.
PUBLIC NOTICE PROCESS
This item has been noticed through the regular agenda notification process in
accordance with the Brown Act.

RESOLUTION: 2013 -0006
A RESOLUTION OF THE OVERSIGHT BOARD FOR THE SUCCESSOR AGENCY
TO THE ROSEMEAD COMMUNITY DEVELOPMENT COMMISSION CONFIRMING
THE SELECTION OF E.C. CONSTRUCTION FOR THE CONSTRUCTION OF THE
PUBLIC PLAZA
WHEREAS, the Rosemead Successor Agency received the Finding of Completion on
April 18, 2013 from the Department of Finance; and
a
WHEREAS, the Finding Completion states that the Rosemead Successor Agency may
utilize proceeds derived from bonds issued prior to January 1, 2011 in a manner consistent with
the original bond covenants per Health and Safety Code section 34191.4(c); and
WHEREAS, the Rosemead Successor Agency is holding approximately $7.1 million in
bond proceeds derived from bonds issued prior to January 1, 2011 for Capital Improvement
Projects identified in the bond covenants; and
WHEREAS, the Rosemead Successor Agency will be required to provide oversight of
the completion of the Capital Improvement Projects to ensure compliance with the bond
covenants; and
WHEREAS, the approved Capital Improvement Projects have been included on each
Recognized Obligation Payment Schedule filed by the Rosemead Successor Agency; and
NOW THEREFORE, THE OVERSIGHT BOARD FOR THE SUCCESSOR AGENCY
TO ROSEMEAD COMMUNITY DEVELOPMENT COMMISSION HEREBY RESOLVES:
The Rosemead Successor Agency Oversight Board confirms that E.C. Construction
is the lowest responsible bidder and confirms any decision by the City Council to
award a contract for the construction of the Public Plaza.
2. The contract with E.C. Construction shall not exceed the price of the bid plus ten
percent. If any contract amendments are required in excess of ten percent, then all
such changes shall be brought back to the Oversight Board for review and approval.
Successor Agency staff is directed to submit documents to the Department of
Finance as necessary, including an amended Recognized Obligation Payment
Schedule.
4. Successor Agency staff is directed to provide a copy of this Resolution to the County
Auditor - Controller, the State Controller's Office and the State Department of
Finance.
