PC - Item 3A - Conditional Use Permit 14-06 at 4501 Rosemead Boulevard iit\rem ROSEMEAD PLANNING COMMISSION STAFF REPORT aRaORaRa TO: THE HONORABLE CHAIR AND MEMBERS OF THE ROSEMEAD PLANNING COMMISSION FROM: PLANNING DIVISION DATE: MARCH 16, 2015 SUBJECT: CONDITIONAL USE PERMIT 14-06 4501 ROSEMEAD BOULEVARD Summary Yuan Yuan Chen of Moonlight Bar and Restaurant has submitted a Conditional Use Permit application requesting approval for a new On-Sale General (Type 47) ABC license in conjunction with a bona fide public eating establishment, located at 4501 Rosemead Boulevard, in the C-3 (Medium Commercial) zone (APN: 5389-017-021). Environmental Determination Section 15309 of the California Environmental Quality Act (CEQA) guidelines exempts projects that consist of inspections to check for the performance of an operation, or the quality, health, and safety of a project from environmental review. Accordingly, Conditional Use Permit 14-06 is classified as a Class 9 Categorical Exemption pursuant to Section 15309 of CEQA guidelines and therefore exempt from further environmental analysis. Staff Recommendation Based on the analysis and findings contained in this report, it is recommended that the Planning Commission ADOPT Resolution No. 15-03 (Exhibit "A") and APPROVE Conditional Use Permit 14-06 with findings, subject to thirty-one (31) conditions of approval outlined in Attachment "A" attached hereto. Property History and Description The subject site is located in the north part of the City along Rosemead Boulevard. According to Building and Safety Division records, a restaurant was constructed in 1976 for the establishment of a Bahooka Family Restaurant. The property is currently developed with an 8,582 square foot restaurant. Planning Commission Meeting March 16,2015 Page 2 of 24 • tF j. - 111 -1 IrLI , . I _ South East Elevation Site & Surrounding Land Uses The project site is designated in the General Plan as Commercial and on the zoning map it is designated C-3 (Medium Commercial) zone. The site is surrounded by the following land uses: North: General Plan: Commercial Zoning: C-3 (Medium Commercial) Land Use: Commercial South: General Plan: Commercial Zoning: C-3(Medium Commercial) Land Use: Commercial East: General Plan: Commercial and Public Facilities Zoning: C-3D (Medium Commercial with a Design Overlay)and R-1 (Single Family Residential) Land Use: Commercial and Educational Institution West: General Plan: Low Density Residential Zoning: R-1 (Single Family Residential) Land Use: Residential Planning Commission Meeting March 16,2015 Page 3 of 24 Restaurant Operations The applicant is currently planning to operate a full service dine-in restaurant. The daily hours of operation will be from 11:00 a.m. to 2:00 a.m., Monday through Sunday. As indicated on the restaurant's menu, which has been attached as Exhibit "B," the restaurant serves a full array of fusion Chinese American style cuisine. The restaurant will employ fifteen (15) employees on the largest shift. The floor plan (attached as Exhibit "C") submitted by the applicant indicates that the restaurant provides seating for three-hundred and eighty-nine (389) patrons inside the restaurant. Tenant Improvement The applicant is in the process of completing the restaurant tenant improvements. The owner has indicated that they are hoping to complete construction by the beginning of April, and open sometime thereafter in May. According to the plans, Moonlight Bar and Restaurant will total 8,582 square feet. The floor plan consists of a waiting area, restaurant dining areas, a kitchen, a bar area, preparation areas, service areas, coolers, freezers, a locker room, liquor storage, and restrooms. State Department of Alcoholic Beverage Control (ABC) and Public Safety Report Staff has received a worksheet from the State Department of Alcoholic Beverage Control (ABC), which indicates that the subject restaurant is currently located in a census tract that has an overdue concentration of alcohol permits. The number of allowable on-sale ABC licenses for this census tract (No. 4322.02) is four (4). Currently, there are five (5) authorized on-sale licenses for this census tract. Although the Department of Alcoholic Beverage Control has found that there is an "overdue concentration" of on-sale beer and wine licenses for this census tract, the City of Rosemead can, as a policy matter, decide that clustering these uses is appropriate. State ABC has also determined that this location is in a high crime district. The City of Rosemead Public Safety Department has found no unusual situations or concerns and no incidences have occurred on the subject site. For these reasons, the City of Rosemead Public Safety Department has indicated that they are in support of this request, notwithstanding the ABC's finding. The serving of beer and wine as an ancillary use to a full service dine-in restaurant will not cause obstructions to pedestrian traffic, vehicular traffic, or parking. Regular inspections by the State ABC and the Rosemead Public Safety Department will ensure that the location is monitored and the serving of alcoholic beverages will not result in interference with children on their way to school, shoppers using streets, or defacement of surrounding properties. Restaurant staff will be trained on how to properly serve alcohol, including but not limited to checking identification to avoid serving to minors and being aware of intake levels of patrons. Management staff will be required to undertake an ABC seminar course to properly handle the serving of alcohol. Staff feels that this use is consistent with the surrounding commercial properties and existing land uses in the general area, with no foreseeable negative impacts to the adjacent neighborhood or adjoining properties. The applicant has indicated that there will Planning Commission Meefing March 16, 2015 Page 4 of 24 be fifteen (15) video surveillance cameras throughout the entire premise, which includes eleven (11) within the restaurant area and four (4) within the parking lot area. Site Improvements Staffs site inspection revealed that several matters need attention due to the lack of property maintenance over the last several years. For this reason, several conditions of approval have been added to address the property maintenance issues. The property maintenance items include: 1. The exterior of the building shall be rehabilitated and any area requiring the replacement of wood siding shall be installed. 2. Any area requiring the replacement of fencing shall be rehabilitated (wood fencing along the south side of the property and the concrete block wall along the west side of the property). 3. The parking lot shall be restriped and re-slurry sealed. In addition, all broken wheel stops shall be removed and replaced. 4. All light poles shall be repainted to match the existing color. 5. All graffiti shall be removed. Municipal Code Requirements Section 17.28.020(C) provides the criteria by which the Planning Commission may approve, approve with conditions, or disapprove an application: A. The plans indicate proper consideration for the relationship between the proposed structure and site developments that exist or have been approved for the general neighborhood; The proposed use is located within an established commercial district of the City and is designated Commercial in the General Plan. Goal 2 of the Land Use Element is to expand opportunities for concentrated commercial and industrial uses that contribute jobs and tax revenues to the community. B. The plan for the proposed building and site development indicates the manner in which the proposed development and surrounding properties are protected against noise, vibrations and other factors which may have an adverse effect on the environment, and the manner of screening mechanical equipment, trash, storage and loading areas: The applicant is maintaining all existing light fixtures. All lighting is fully shielded and directed downwards to mitigate glare of adjacent properties. This development will not generate any permanent impacts to noise levels for the surrounding area. All construction work will be required to comply with the timeframe, and decibel levels Planning Commission Meeting March 16, 2015 Page 5 of 24 indicated in the City's Noise Ordinance. In addition, a condition of approval has been added to require the construction of a fully enclosed trash enclosure as well as the installation of a locking device on the proposed grease trap. Conditions of approval will also specifically address factors such as noise, construction hours, screening of mechanical equipment, landscaping, lighting, and the overall maintenance of the property. C. The proposed building or site development is not, in its exterior design and appearance, so at variance with the appearance of other existing buildings or site developments in the neighborhood as to cause the nature of the local environment to materially depreciate in appearance and value; Conditions of approval will specifically address factors involving the overall maintenance of the property. The improvements to the site in terms of maintenance of landscaping, the restriping and re-slurry sealing of the parking lot, the replacement of all broken wheel stops, the removal of graffiti, and the rehabilitation of perimeter fencing and building exterior will provide a marked improvement over the existing appearance of the building along Rosemead Boulevard. D. The proposed building or structure is in harmony with the proposed developments on land in the general area, especially in those instances where buildings are within or adjacent to land shown on the General Plan as being part of the Civic Center or in public or educational use, or are within or immediately adjacent to land included within any precise plan which indicates building shape, size or style: The property is not part of the Civic Center Plan, precise plan or land reserved for public or educational use, so there is no special need to create harmony with the general area. E. The proposed development is in conformity with the standards of this Code and other applicable ordinances in so far as the location and appearance of the buildings and structures are involved; and This proposed development meets all of the minimum code requirements for the C- 3 (Medium Commercial) zone, and all applicable referenced code sections of the Rosemead Municipal Code. F. The site plan and the design of the buildings, parking areas, signs, landscaping, luminaires and other site features indicates that proper consideration has been given to both the functional aspects of the site development, such as automobile and pedestrian circulation, and the visual effect of the development from the view of public streets. Access to the site would be via one (1) existing driveway approach along Rosemead Boulevard. The parking lot is conveniently located to the rear of the building. All existing parking lot lighting is fully shielded and directed downwards to mitigate glare on adjacent properties. In addition, the improvements to the site in Planning Commission Meeting March 16,2015 Page 6 of 24 terms of maintenance of landscaping, the restriping and re-slurry sealing of the parking lot, the replacement of all broken wheel stops, the rehabilitation of perimeter fencing, and the removal of graffiti will provide a marked improvement over the existing appearance of the building along Rosemead Boulevard. Section 17.30.040(E) of the Rosemead Municipal Code allows on-sale alcohol licenses in upon the granting of a Conditional Use Permit by the Planning Commission. Rosemead Municipal Code Section 17.132.040 sets the following criteria that must be met. A. Approval of the application will not be or incompatible or injurious to other properties or land uses in the vicinity or create conditions materially detrimental to the public health, safety, and general welfare; Moonlight Bar and Restaurant is requesting approval for a new On-Sale General (Type 47) ABC license in conjunction with a bona fide public eating establishment. The site will be operated in accordance with applicable City regulations and is in conformity with the development in and around the project site. Regular site inspections by the State ABC and the City of Rosemead Public Safety Department will be conducted to ensure that the location is monitored for compliance with applicable local, State, and Federal laws and shall not be detrimental to the public health, safety, and general welfare. In addition, conditions of approval have been added to protect the adjacent residential neighborhoods from being affected by this commercial establishment. B. The use is consistent with the General Plan; The proposed use is located within a commercial district of the City and is designated Commercial in the General Plan. Goal 2 of the Land Use Element is to expand opportunities for concentrated commercial and industrial uses that contribute jobs and tax revenues to the community. C. The use is consistent with the provisions of the Zoning Code; and This proposed development meets all of the minimum code requirements for the C- 3 (Medium Commercial) zone, and all applicable referenced code sections of the Rosemead Municipal Code. D. Processing and approval of the permit application are in compliance with the requirements of the California Environmental Quality Act. Section 15309 of the California Environmental Quality Act (CEQA) guidelines exempts projects that consist of inspections to check for the performance of an operation, or the quality, health, and safety of a project from environmental review. Accordingly, Conditional Use Permit 14-06 is classified as a Class 9 Categorical Exemption pursuant to Section 15309 of CEQA guidelines and therefore exempt from further environmental analysis.
